G-1405 Ordinance No - C°1405 AN ORDINANCE f AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN , ILLINOIS , EN- TITLED "THE ELGIN ZONING ORDINANCE" . WhEREAS , a public hearing has been duly held pursuant to statute of the State of Illinois and the provisions of the Elgin Zoning Ordinance , and WHEREAS , the Elgin Zoning Board of Appeals has transmitted its recommendations to the City Council , all of which have been duly considered , NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN , ILLINOIS : Section 1 . That Sub-section B of Section 21 - 106 of Chapter 21 of the City Code of Elgin , Illinois , as amended , be , and the same hereby is , amended by adding thereto the following paragraph : That the boundaries hereinbefore described and laid out in the "Zoning District Map" , as amended , be , and they hereby are , altered and amended in the following manner , to-wit : By including in M-1 Limited Manufacturing District the following described premises , to-wit : rThat part of the Southeast Quarter of Section 32 and part of the Southwest Quarter of Section 33 , Township 42 North , Range 8 East of the Third Principal Meridian , described as follows : Commencing at the Southwest corner of the Southeast quarter of Section 32 , Thence North along the West line of said quarter section 741 . 5 feet; thence North 86 degrees 48 minutes East 2567 . 2 feet to the center line of a Northerly and Southerly road for the place of beginning ; thence Southerly along said center line to a point 82 , 5 feet North of the South line of the Southwest Quarter of Section 33 , measured at right angles thereto; thence East parallel with the South line of said Southwest Quarter to the East line of the West half of said Southwest Quarter ; thence North along said East line to the North line of said Southwest Quarter; thence West along said North line 528 feet ; thence South parallel with the East line of the West half of the Southwest Quarter aforesaid 800 feet ; thence West parallel with the North line of the Southwest Quarter of Section 33 and the North line of the Southeast Quarter of Section 32 , to the center line of the Northerly and Southerly road aforesaid; thence Southerly along said center line to the place of beginning , ALSO that part of the East half of the Southwest Quarter of said Section 33 lying Southerly of the South line of the Toll Road , EXCEPTING THEREFROM the South 82 . 5 feet (as measured at right angles to the South line of said East half) . (Except Parcel N-4D-59 acquired by the Illinois State Toll Highway Commission thrdugh proceedings filed in the Circuit Court of Kane County , Illinois , as Case No . 57-533 and also except that part of the East 528 feet of the Northwest Quarter of the Southwest Quarter of said Section 33 lying North of the Illinois State Toll highway) . Subject to all public and private roadways or easements as now located . Being situated in Dundee Township , Kane County , Illinois , Expressly providing , however , that the above described premises shall be subject to the following specific restrictions and conditions , to-wit : 1 . No residential or commercial uses shall be permitted upon the abovy described property other than the following specific uses : ( a) Motel , including accessory uses such as restaurant and beverage facilities and interior arcade type of shops forming an integral part of such motel complex . (b ) Offices and office buildings ( c) Research facilities (d) Retail and wholesale sales of products manufactured or assembled on the premises . Nothing in this restriction shall be construed to prohibit use concerned with the operation of establishments for the manufacture , assembly , disassembly , fabricating , repairing , storing , cleaning , servicing , or testing of materials , goods or products , provided operation of such use conforms with the applicable regulations and performance standards as setforth in the present Elgin Zoning Ordinance . 2 , The Owners and developer, their heirs , successors and assigns will install and maintain a 100-foot wide buffer strip of green belting on that portion of said territory with abuts the boundary lines of Century Oaks Subdivision residential lots , contiguous to the above described real estate , which green belt strip will not be utilized for buildings , vehicle parking or roads , provided that any road or roadway constructed adjacent to the North boundary thereof may utilize said green belt area as a shoulder and required right-of-way , so long as no portion of the pavement or traveled portion of such road extends into the green belt area , 3 . No access roads shall be permitted from the subject property connecting into or through the Century Oaks Subdivision , 4 . No exposed concrete block or common brick exterior wall facing shall be permitted on any structure erected on the above described premises , 5 . The set back requirements for buildings on said territory shall be as follows : Front yards not less than 50 feet in depth . Side yard not less than 25 feet in depth , a Section 2. That all ordinances or parts thereof , in con- flict herewith be , and the same hereby are , repealed and of no further force and effect . ew Section 3.
