AN ORDINANCE
AMENDING CHAPTER 22 OF THE CITY CODE ENTITLED PLATS, SUBDIVISION
REGULATIONS, SURVEYS AND ADDITIONS .
WHEREAS , the General Assembly of the State of Illinois
enacted the "Condominium Property Act" of the State of Illinois ,
subsequent to the adoption of Chapter 22 of the City Code of
Elgin , Illinois , pertaining to subdivision regulations , and
WHEREAS , the Condominium Property Act of the State of
Illinois concerns the ownership of individual units in multiple-unit
structures , and
WHEREAS , the Subdivision Ordinance of the City of Elgin
should be amended to provide that the plat , as defined in the
Condominium Property Act , is not a plat of subdivision as defined
in Chapter 22 of the City Code of Elgin , Illinois .
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN , ILLINOIS :
Section 1 . That Section 22 . 3 of Chapter 22 of the City
Code be , and the same hereby is amended by adding to said Section
22 .3 the following additional paragraph , to-wit:
"Condominiums as defined and regulated by the
(01.- Condominium Property Act of the State of Illinois
are not subject to the requirements of this Section"
Section 2 . That all ordinances or parts thereof in conflict
herewith be , and the same hereby are , revoked and of no further
force and effect .
Section 3 . That this ordinance shall be in full force and
effect from and after its passage as provided by law and shall
be published in pamphlet form by authority of the City Council .
