AN ORDINANCE
VACATING A PORTION OF HOLLY STREET IN PART OF J. C. AND
W . H. KIMBALL'S ADDITION TO THE CITY OF ELGIN, KANE COUNTY ,
ILLINOIS.
WHEREAS, a certain portion of Holly Street, a public street platted
in part of J. C . and W . H. Kimball's Addition in the City of Elgin, Kane
County, Illinois , has never been improved, maintained or used for street
purposes , and
WHEREAS, the public interest will be subserved by the vacation
of the following described portion of said public street, to -wit:
Beginning at the Northeast corner of Lot 1 in Block 11 of
said J. C . and W. H. Kimball's Addition; thence Westerly
along the North line of said Lot, a distance of 168. 3 feet to the
Northwest corner thereof; thence Northerly along the West
line extended Northerly of said Lot 1, a distance of 66. 0
feet to the Southwest corner of Lot 6 in Block 1 of said
J. C . and W. H. Kimball's Addition; thence Easterly
along the South line of said Lot 6, a distance of 170. 94
feet to the Southeast corner thereof; thence Southerly
along the East line of said Lot 6 extended Southerly, a
distance of 66. 0 feet to the place of beginning. Being
situated in the City of Elgin, Kane County, Illinois .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ELGIN, ILLINOIS:
Section 1 . That the following described portion of a certain
public street, as platted and loacated in part of J. C . and W. H .
Kimball's Addition in the City of Elgin, Kane County, Illinois , to-wit:
Beginning at the Northeast corner of Lot 1 in Block 11 of
'said J. C . and W . H. Kimball's Addition; thence Westerly
along the North line of said Lot, a distance of 168. 3 feet to
the Northwest corner thereof; thence Northerly along the
West line extended Northerly of said Lot 1, a distance of
66. 0 feet to the Southwest corner of Lot 6 in Block 1 of said
J. C. and W . H. Kimball's Addition; thence Easterly along
the South line of said Lot 6 a distance of 170. 94 feet to the
Southeast corner thereof; thence Southerly along the East
line of said Lot 6 extended Southerly, a distance of 66. 0
feet to the place of beginning. Being situated in the City of
Elgin, Kane County, Illinois,
be, and the same hereby is , vacated for street purposes .
Section 2. That the City of Elgin does hereby reserve to itself and to
any and all public utility companies owning any public service facilities in any
parts of said public street vacated by this ordinance, full right of ingress and 4111)
egress in and from said street and an easement to go upon all or any part of
said street vacated by this ordinance for the purpose of continuing, main-
taining, reconstructing or extending any such public service facilities which
might be located thereon.
Section 3 . That a certified copy of this ordinance, together with a plat
of the portion of said public street vacated, be filed with the Recorder of Deeds
of Kane County, Illinois .
Section 4. That this ordinance shall be effective from and after its
passage, as provided by law, and shall be published in pamphlet form by
authority of the City Council.
