S-875 Ordinance No. S-875 AN ORDINANCE AMENDING ORDINANCE NO. S-838, PASSED ON AUGUST 25, 1966, F ENTITLED "AN ORDINANCE AMENDING ORDINANCE S-823 PASSED ON APRIL 14, 1966, ENTITLED 'AN ORDINANCE ANNEXING CERTAIN TERRITORIES SITUATED IN ELGIN TOWNSHIP, KANE COUNTY, ILLI- NOIS, AND AUTHORIZING SPECIAL USE FOR THE DEVELOPMENT, AND MAINTENANCE OF A PLANNED DEVELOPMENT FOR RESIDEN- TIAL PURPOSES TO BE ESTABLISHED THEREON' ". WHEREAS, Ordinance No. S-823, passed on April 14, 1966, entitled "An Ordinance annexing certain territories situated in Elgin Township, Kane County, Illinois, and authorizing special use for the development and maintenance of a planned development for residential purposes to be established thereon", provided for the annexation of certain territories and lands described therein to the City of Elgin, zoned R-5, General Residence District, as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois) as amended, with a special use for the operation and maintenance of a planned deve- lopment, as defined therein, to be established thereon, and WHEREAS, Ordinance No. S-838, passed on August 25, 1966, entitled "An Ordinance Amending Ordinance No. S-823, Passed On April 14, 1966, entitled 'An Ordinance annexing certain territories situated in Elgin Township, Kane County, Illinois, and authorizing spec- ial use for the development and maintenance of a planned development for residential purposes to be established thereon' ", deleted from the properties indicated as included in the R-5, General Residence District, with a special use for the operation and maintenance of a planned development, as set forth in the Elgin Zoning Ordinance, (Chapter 21 of the City Code of Elgin, Illinois) as amended, and including in the R-2, Single Family Residence District, as set forth in the Elgin Zoning Ordi- nance, (Chapter 21 of the City Code of Elgin, Illinois), as amended certain property described in Section 1 thereof, and WHEREAS, Ordinance No. S-865, passed on July 13, 1967, en- titled "An Ordinance Amending Ordinance No. S-823 Passed On April 14, 1966, entitled 'An Ordinance annexing certain territories situated in Elgin Township, Kane County, Illinois, and authorizing a special use for the operation and maintenance of a planned development for resi- dential purposes to be established thereon' ", altered the location and configuration of the buildings and other improvements of the Planned Development and approved plans, specifications and an amended plat which were by said ordinance made a part of and incorporated in said ordinance, and WHEREAS, said amended plat now requires that the legal des- cription of the real estate deleted by Ordinance No. S-838 be altered to conform thereto. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Ordinance No. S-838, passed by the City Council of Elgin, Illinois, on August 25, 1966, be, and the same hereby is, amended to remove from Section thereof the real estate description therein contained and to substitute therefore the following legal descrip- tion. That part of the East half of the Southwest quarter of Section 10, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Beg- inning at a point in the West line of McLean Boteestrd, 222. 3 feet North of the South line of said South/quarter; thence West parallel with the South line of said quarter section, a distance of 262. 0 feet; thence Northwesterly along a line that forms an angle of 67 degrees 51 minutes 50 seconds to the right with the prolongation of the last described line, a distance of 146. 53 feet; thence East, parallel with the South line of said quarter section, a distance of 60. 0 feet; thence Northerly along a_.line that forms an angle';of 90 degrees 24 minutes to the left with the prolongation of the last described line, a dis- tance of 12, 0 feet; thence East parallel with the South line of said quarter section, a distance of 262. 0 feet to the West line of McLean Boulevard; thence South along said West Line of McLean Boulevard, a distance of 147. 7 feet to the place of beginning (except the Southerly 7 feet thereof of even width measured along the Easterly 44) boundary line of said premises). Being situated in Elgin Township, Kane County, Illinois. Section 2. That water service of the city of Elgin and sanitary sewer service of the Elgin Sanitary District and the City of Elgin be per- mitted to be extended to both housing units located on the premises des- cribed in.Secticm 1 hereof. Section 3. That the automobile garage building now located on the premises annexed to the City of Elgin by said Ordinance No. S-823 and which will be destroyed by the improvements of said Planned Development may be replaced by a new garage building on the premises described in Section 1. Section 4. That Ordinance No. S-838 passed on August 25, 1966, shall in all respects, remain in full force and effect as specifically modified hereby. Section 5. That this Ordinance shall be in full force and effect from and after its passage as Provided by law and shall be published in pamphlet form by authority of the City Council. E. C.
