S-844 Ordinance No. 5-844 AN ORDINANCE VACATING A PORTION OF A CERTAIN ALLEY IN THE COUNTY CLERK'S SUBDIVISION OF BLOCK 7 OF SHERMAN'S SUBDIVISION IN THE CITY OF ELGIN, KANE COUNTY, ILLINOIS. WHEREAS, a certain dead end alley runs through the approximate center of the County Clerk's Subdivision of part of Block 7 of Sherman's Sub- division in the City of Elgin, Kane County, Illinois, in a generally Easterly and Westerly direction, commencing at Illinois Avenue, and WHEREAS, the Westerly 53. 58 feet of said alley has heretofore been vacated for alley purposes, and WHEREAS, the Westerly 53. 58 feet of the unvacated portion of said alley being described as that portion of said alley lying adjacent to and bet- ween Lot C and Lot F of the County Clerk's Subdivision of part of Block 7 of Therman's Subdivision in the City of Elgin, Kane County, Illinois, has never been used or maintained as such, and WHEREAS, the public interest will be subserved by the vacation of said portion of the public alley lying adjacent to and between said Lots C and F of the County Clerk's Subdivision of Part of Block 7 of Sherman's Subdivision �+ in the City of Elgin, Illinois. 6 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the Westerly 53. 58 feet of the unvacated portion of that certain East-West alley in the County Clerk's Subdivision of part of Block 7 in Sherman's Subdivision in the City of Elgin, Kane County, Illinois, more particularly being described as that portion of said public alley lying adjacent to and between Lots C and F of the County Clerk's Subdivision of part of Block 7 in Sherman's Subdivision in the City of Elgin, Kane County, Illinois, be, and it hereby is, vacated for alley purposes. Section 2. That a certified copy of this ordinance, together with a Plat of the portion of said alley vacated, be filed with the Recorder of Deeds of Kane County, Illinois. Section 3. That the Petitioner pay to the City the sum of $10.00 for such vacation and pay all costs pertaining to plats and recording fees. Section 4. That this ordinance shall be 'effective from and after its passage, as provided by law, and shall be published in pamphlet form by authority of the City Council. Clyde L.
