S-808 Ordinance No. S-808 AN ORDINANCE ANNEXING CERTAIN TERRITORIES IN PARTS OF SECTIONS 29, 30, 31 AND 32, TOWNSHIP 41 NORTH, RANGE 9 EAST OF THE THIRD PRINCIPAL MERIDIAN, SITUATED IN HANOVER TOWNSHIP, COOK COUNTY, ILLINOIS, TO THE CITY OF ELGIN, ILLINOIS. WHEREAS, a petition signed by all of the owners of record and all of the electors residing on the territories hereinafter described has been filed with the City Clerk of the City of Elgin, requesting the annexation of such territories to the said City of Elgin, Illinois, and WHEREAS, said territories are not within the corporate limits of any municipality and are contiguous to the City of Elgin, Illinois, and WHEREAS, such petition requests the annexation of such territories to the City of Elgin, Illinois, and contains therein a statement under oath that all of the owners of record of all land within the territories::and all electors residing thereon have joined in such petition, and WHEREAS, such property is presently zoned for General Manufactur- ing uses all as designated in M-2, "General Manufacturing District", as set forth in "The Cook County Zoning Ordinance" adopted by the Board of Commiss- ioners of Cook County on March 8, 1960, as, amended, and the said petition re- quests that such territories, if annexed to the City of Elgin, be zoned in class- ification M-2, "General Manufacturing District", as set forth in the Elgin Zon- ing Ordinance, which classification will continue to permit the same or similar uses as permissable under the existing zoning of said property within the county, and WHEREAS, the City Council of the City of Elgin has duly advertised and held a public hearing, all as in the statute made and provided pertaining to the zoning of said property, if annexed to the City of Elgin, and is of the considered opinion that said lands be classified as M-2, "General Manufacturing District", as provided by the Elgin Zoning Ordinance, as amended. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the territories and lands described as follows, to-wit: Parts of Sections 29, 30, 31 and 32, Township 41 North, Range 9 East of the Third Principal Meridian described as follows: Beginning at the intersection of the West line of said Section 29, r with the Southerly right of way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence Southerly along said Westerly line a distance of 112. 54 feet; thence Easterly along a line that forms an angle of 90 degrees 39 minutes 30 seconds to the left with the prolongation of the last described course a distance of 107. 17 feet to a point in a line that is 50. 0 feet Southwesterly of (measured at right angles thereto) and parallel with the Southerly right of way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence Southeasterly along said parallel line a distance of 764. 9 feet to the Easterly line of a strip of land conveyed to Public Service Company of Northern Illinois by Warranty Deed recorded April 26, 1940, as Docu- ment No. 12472185; thence Southeasterly along said Easterly line a distance of 64. 54 feet; thence Southeasterly parallel with the Southerly right of way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad a distance of 628. 8 feet; thence South- erly parallel with the West line of said Section 29, a distance of 509. 8 feet to the center line of Spaulding Road; thence Easterly along said center line, a distance of 361. 0 feet to a point in a line that is 250. 0 feet Northwesterly of (measured at right angles thereto) and parallel with the center line of the main track of the Elgin, Joliet and Eastern Railway; thence Southwesterly along said parallel line 1720. 1 feet to the South line of the North 68 acres of the Northwest quarter of Section 32, Township and Range afore- said; thence Easterly along said South line a distance of 125. 37 feet to the Westerly right of way line of the Elgin, Joliet and Eastern Railway; thence Southerly along said Westerly right of way line 1545 feet to the South line of the Northwest quarter of said Section 32; thence Westerly along said South line 1443. 0 feet to the Southwest corner of said Northwest quarter; thence Westerly along the South line of the Northeast quarter of Section 31, Town- ship and Range aforesaid, a distance of 1342. 65 feet to the South- west corner of the East half of said Northeast quarter; thence Northerly along the West line of the East half of said Northeast quarter a distance of 2002. 7 feet; thence Easterly 22. 41 feet to the center line of Gifford Road; thence Northerly along said center line 3220 feet to the Southerly right of way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence Northwesterly along said Southerly right of way line to the West line of the North- east quarter of the Southeast quarter of Section 30, Township and Range aforesaid; thence Northerly along said West line to the Northerly right of way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence Southeasterly along said Northerly right of way line to the East line of said Section 30, being also the West line of Section 29, Township and Range aforesaid; thence Southerly along said West line 112. 46 feet to the place of beginning, VOLUME XXX October 28, 1965 354 situated in Hanover Township, Cook County, Illinois. be, and they are hereby, annexed to and made a part of the City of Elgin, Illinois, and that the boundary lines of the City of Elgin be, and they are hereby, enlarged and extended to include within the corporate boundaries thereof the said described territories. Section 2. That said territories hereinbefore described be, and they are hereby, included in the M-2, "General Manufacturing District", as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois) as amended, it being further provided that that property described in the petition filed in the City Clerk's office owned by The Chicago Gravel Company, an Illinois corporation, may be utilized for the mining and processing of gravel, sand and related products. Section 3. That a certified copy of this ordinance, together with an accurate map of said annexed territories be filed with the Recorder of Deeds of Cook County, Illinois. Section 4. This ordinance shall be in full force and effect from and after its passage, as provided by law, and shall be published in pamphlet form by authority of the City Council. r Clyde L. Decker & Planning Director James Spore Subject: Proposed Annexation South of Bartlett Road I. VICTOR MANUFACTURING & GASKET PRE-ANNEXATION AGREEMENT (October 14, 1965 - 29L .2 acres) 1. M-2 Zoning 2. Construction of water main on or before May 1, 1966. Main to be: 12" minimum diameter and minimum terminal point residual pressure of 45 lbs/sq.inch and a minimum flow of 1250 gallons per minute or 50 lbs/sq.inch and a minimum flow of 1000 gallons per minute. 3. Total estimated cost of main - $178,000 as follows: Portion "A" $ 64,000 (paid by Elgin) Portion "B" $114,500 ($17,000 paid by Elgin) --m II. WATER fJThe present 12" line with booster pump is adequate to handle full development on the Victor property. If the proposed 300 acre annexation is fully developed with fairly intensive water users it is the opinion of Carl Jepson that the existing system would not be adequate without an additional source of supply. We have stated that Victor Gasket would be reimbursed if any users directly benefited from the water main installation. However, no formal agreements have been drawn up. III. SANITARY SEUER If additional pumps are installed in the Gifford Road Lift Station, lift station capacity will be adequate. However, additional sanitary lines may be needed to the lift station. More information will be needed on the probable sewerage generation of the proposed development before definite conclusions can be drawn. Also, topographic data on the site will be needed before definite line requirements can be developed. The sanitary sewer problem is compounded by the sanitary district boundaries and agreements in this area. -2- r IV. STORK! SEWER The existing line in Bartlett Road has capacity to serve some of the property south of Bartlett Road, however, topographic data will be needed before a conclusion can be drawn on storm drainage for the entire parcel. V CONCLUSION Without additional information as to the size (300 or 500 acres) of the development and some feeling for the characteristics of the proposed industries definite answers to these utility questions are not possible.
