S-771 Ordinance No. S-771 AN ORDINANCE AUTHORIZING A SPECIAL USE FOR CHURCH PURPOSES TO BE ESTABLISHED ON CERTAIN PROPERTY IN THE CITY OF ELGIN PURSUANT TO PROVISIONS OF CHAPTER 21 OF THE CITY CODE OF ELGIN, ILLINOIS, ENTITLED, "THE ELGIN ZONING ORDINANCE". WHEREAS, the City Council has been requested to authorize a Special Use for church purposes upon certain property to be acquired by Westminster Presbyterian Church, hereinafter described, in the City of Elgin, and WHEREAS, said property is zoned R-2, Single Family Residence District under provisions of "The Elgin Zoning Ordinance", and WHEREAS, a written report has been prepared and forwarded to the Zoning Board of Appeals and the City Council by the Plan Commission pertaining to this particular petition, and WHEREAS, a public hearing has been held by the Zoning Board of Appeals after due notice by publication as provided by statute and its findings and recommendations have been reported to the City Council, and WHEREAS, the City Council has determined that such Special Use requested is necessary for the public convenience; can be designed, lo- cated and operated so that the public health, safety and welfare wirl be protected; and will not cause substantial injury to the value of other pro- perty in the neighborhood in which it is located; provided that certai: conditions and restrictions hereinafter set forth are imposed ors such Special Use. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That a Special Use for the operation and maintenance of a church be, and the same hereby is, authorized pursuant to the provisions of Chapter 21 of the City Code of Elgin, Illinois, entitled, "The Elgin Zoning Ordinance" on the following described real estate, to-wit: Lot Q, Block 4 Eagle Heights Addition in the City of Elgin, Kane County, Illinois. Commonly known as 977 Diane Ave, Elgin, Ill. Section 2. That said Special Use is hereby granted and permitted under the following express conditions and restrictions, and shall be operated accordingly: r (a) Said Special Use shall terminate no later than December 31, 1969. (b) Said Special Use shall be confined to Sunday School and Church School uses and functions only, on a limited basis; namely, at anytime during Sundays, two days a week other than Sundays, and two full weeks during any Summer season. (c) That the exterior of the existing building on the above-des- cribed premises, which is residential in nature, shall be in no manner altered or changed structurally other than to subscribe to building or fire code regulations or requirements. It being the intent of this ordinance that said structure shall at all times retain its residential character and appearance. Section 3. That all ordinances or parts thereof in conflict here- with be, and the same are hereby, repealed and of no further force and effect. Section 4. That this ordinance shall be in full force and effect from and after its passage provided by law and shall be published in pamph- let form by authority of the City Council. Clyde L.
