S-751 t Ordinance No. S-751 AN ORDINANCE ANNEXING CERTAIN TERRITORIES IN SECTION 2, TOWNSHIP 41 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN, SITUATED IN ELGIN TOWNSHIP, KANE COUNTY, ILLINOIS TO THE CITY OF ELGIN, ILLINOIS. WHEREAS, a Petition signed by all of the owners of record of the territories hereinafter described has been filed with the City Clerk and no electors reside on said territories, and WHEREAS, said territories are not within the corporate limits of any municipality and are contiguous to the City of Elgin, Illinois, and WHEREAS, said Petition requests the annexation of such territories to the City of Elgin, Illinois, and contains therein a statement under oath that all of the owners of record of all land within such territories have joined in such Petition and that no electors reside thereon, and WHEREAS, such property is presently zoned under the existing Zoning Ordinance of Kane County, Illinois, in a manner that permits the same to be used for a college or university, and such a use presently legally exists upon said territories, and the Petition requests that such territories, if annexed to the City of Elgin, be zoned R-2 Single Family Resident District with a Special Use permitted thereon for a college and university so that such use will continue as a legal use of said territories when annexed to the corporate limits of the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ELGIN, ILLINOIS. Section 1. That the territories and lands described as follows, to-wit: Parcel 1: That part of the South half of Section 2, Town- ship 41 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the point of intersection of the center line of State Route No. 31 with the South line of said Section; thence Northerly along said center line on a curve to the right 235 feet; thence North 31 degrees 57 minutes East along said center line 100 feet; thence Northerly along said center line on a curve to the left 386. 5 feet; thence North 16 degrees 05 minutes East along said center line 100 feet; thence Northerly along said center line on a curve to the right 137. 4 feet for the point of beginning; thence South 65 degrees 59 min- utes East 133. 9 feet; thence South 40 degrees 09 minutes East 303. 8 feet; thence South 84 degrees 49 minutes East 397. 7 feet; thence South 58 degrees 40 minutes East 24 feet to the Westerly line extended Southerly of Riverside Manors Unit #1, being a subdivision of part of Section 2, Township 41 North, Range 8 East of the Third Princi- pal Meridian; thence North 10 degrees 44 minutes West along the extension of and the Westerly line of said Riverside Manor, Unit #1, 1037.48 feet to the Southeasterly line of Parcel No. N®4D=65.3 acquired by the Illinois State Toll Highway Commission through proceedings filed in the Circuit Court of Kane County as Case No. 57-305; thence Southwesterly along the Southeasterly line of said Parcel No. N-4D=65.3, 463.6 feet to the center line of said State Route No. 31; thence Southwesterly along said center line to the point of beginning, (EXCEPTING therefrom that part dedicated for public highway by grant recorded August 27, 1957 as document 842730 made by M. Paul Gonnsen and wife Goldie E. Gonnsen. ALSO EXCEPTING therefrom that part falling in State Route 31.) Con- taining 7. 74 acres more or less. ALSO an easement in favor of the above described premises over the Northerly line of the Joel Deuterman property Southerly of the above described premises running from State Route No. 31 to the Easterly line of said Deuterman property as disclosed by agreement made by D. F. Melms with said Deuterman dated March 25, 1946 and recorded in the Recorder's Office of Kane County, Illinois on December 16, 1947 in Book 1387, page 88 as Document No. 594902. Parcel 2: That part of the East half of fractional Section 2, Township 41 North, Range 8 East of the Third Principal Meridian described as follows: Commencing at the Southwest corner of Lot 9 in Riverside Manor, Unit No. 1, being a subdivision of part of said Section 2; thence Southeasterly along the West line extended of said Riverside Manor Unit No. 1, a distance of 175. 0 feet; thence Easterly a distance of 243. 33 feet, parallel with the Southerly line of Lot 9 in said Riverside Manor, Unit No. 1, and said Southerly line extended; thence Southeasterly along a line that forms an angle of 92 degrees 50 minutes from West to South with the last described course, a dis- tance of 27. 78 feet; thence Southeasterly, along a line that forms an angle of 52 degrees 23 minutes to the left with the prolongation of the last described course, a dis- tance of 143. 37 feet for the place of beginning; thence continuing Southeasterly, along the last described course extended, a distance of 1000. 5 feet; thence Northerly, along a line that forms an angle of 57 degrees 15 minutes from Northwest to North with the last described course, a distance of 677. 6 feet; thence Southwesterly 852. 59 feet to the place of beginning. Section 2. That the territories hereinbefore described be, and they are hereby, included in the R-2 Single Family Residence District with a Special Use permitted thereon for the operation and maintenance of a college and university, all as set forth in the Elgin Zoning Ordi- nance (Chapter 21 of the City Code of Elgin, Illinois) as amended. Section 3. That a certified copy of this ordinance, together with an accurate map of the said annexed territories be filed with the Recorder of Deeds of Kane County, Illinois. Section 4. That this ordinance shall be in full force and effect upon its passage as provided by law and shall be published in pamphlet form by authority of the City Council. Clyde L.
