S743 1 Ordinance No. S-743 r AN ORDINANCE REQUIRING THE CONSTRUCTION OF SIDEWALKS OF APPROVED CITY SPECIFICATIONS ADJACENT TO ALL PROPERTY WITHIN THE CORP- ORATE LIMITS OF THE CITY OF ELGIN ABUTTING ON A PUBLIC STREET, ON OR BEFORE SEPTEMBER 1, 1965. WHEREAS, in the considered opinion of the City Council of the City of Elgin, Illinois, it is necessary and for the best interests of the general public that sidewalks of approved specifications be constructed uniformly throughout the entire City of Elgin, and WHEREAS, the City Council is of the further opinion that the con- struction of such sidewalks is of an urgent nature and bears a direct re- lationship to the public health, welfare, and safety, and WHEREAS, the City Council of Elgin, Illinois wishes to cause the construction of such sidewalks as soon as possible, but, however, wishes to afford a reasonable period, during which such sidewalks may be con- structed by the property, owners, on a voluntary basis, before the City initiates special assessment or special taxation proceedings to insure the construction thereof. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the construction of portland cement sidewalks of City specifications be, and the same hereby is, declared to be required adjacent to all lots, or portions thereof, within the corporate limits of the City of Elgin, abutting on a public street, upon which sidewalks meeting City specifications are not already constructed. Section 2. That in the event that such sidewalks are not constructed on or before September 1, 1965, by the adjacent property owners, the City shall immediately thereafter institute special assessment or special taxa- tion districts, as provided by statute, for the purpose of enforcing the con- struction of all such sidewalks, which have not as of said date been installed on a voluntary basis. Section 3. That the Council shall determine the priority of estab- lishing the'said sidewalk improvement districts based upon the dictates of the public health, and safety with special emphasis upon those areas surrounding public schools. Section 4. That there shall be no exemptions from this requirement for the construction of sidewalks, other than those instances where the City Engineer determines that it is physically impossible to construct such a pow sidewalk because of the general terrain and engineering problems in- volved in the specific instance. Section 5. That this ordinance shall be in full force and effect from and after its passage as provided by law and shall be published in pamphlet form by authority of the City Council. Clyde L.
