LETTER OF UNDERSTANDING
The State of Illinois, through its Division of Highways, hereinafter referred to as the
STATE, is desirous of improving Various State Routes within the CITY OF ELGIN
hereinafter referred to as the CITY, in the County of Kane, Illinois, State Section: 2015-
064I by making the following improvements:
Sidewalk removal, combination concrete curb and gutter removal and replacement,
installation of concrete sidewalks and detectable warnings to conform with Americans
with Disabilities Act (ADA), drainage structure and handhole adjustments, placement of
pavement markings and by performing all other work necessary to complete the
improvement in accordance with the approved plans and specifications.
In order that the STATE and the CITY may benefit by this proposed improvement, we
are requesting concurrence with the following:
1. The STATE agrees to make the surveys, obtain all necessary rights of way, prepare
plans and specifications, receive bids and award the contract, furnish engineering
inspection during construction and cause the improvement to be built in accordance
with the approved plans, specifications, and contract.
2. We ask the CITY to sign the plan approval page which is part of this document
provide us with a letter approving the plans and specifications as prepared.
3. We ask the CITY not to permit driveway entrance openings to be made in the
curb, as constructed, of STATE maintained highways improved as part of our
project, without first obtaining our consent.
4. The STATE will cause private utilities to be relocated at no expense to the
STATE or CITY.
5. Upon completion of the improvement, the CITY agrees to maintain, or caused to
be maintained, all existing sidewalks and all sidewalks constructed as part of this
improvement, within the CITY'S municipal limits.
Approval of this Letter of Understanding shall be considered as concurrence with and
acceptance of all terms contained herein, and shall be binding upon and inure to the
benefit of the parties hereto, their successors and assigns.
