Kaptain, Mayor Presented: May 27, 2015 Adopted: May 27, 2015 Omnibus Vote: Yeas: 9 Nays: 0 Attest: s/Kimberly Dewis Kimberly Dewis, City Clerk FIRST AMENDMENT TO ANNEXATION AGREEMENT (Stonebrook Development-Cedar Grove Subdivision) THIS FIRST AMENDMENT TO ANNEXATION AGREEMENT ("Amendment") is made and entered into this 27th day of May, 2015 by and between the City of Elgin, Illinois, a municipal corporation (hereinafter referred to as the "City"), of the counties of Cook and Kane, in the State of Illinois, and The Ryland Group, Inc., a Maryland corporation (hereinafter referred to as "Developer" and"Owner"). WITNESSETH Whereas, Owner's predecessor in title and the City entered into an Annexation Agreement dated April 13, 2005 (hereinafter referred to as the "Agreement"), regarding the property commonly known as Stonebrook Development; and Whereas, Owner owns that portion of Cedar Grove Subdivision, being a neighborhood in the Stonebrook Development, legally described in Exhibit "A" attached hereto and made a part hereof(hereinafter referred to as the "Subject Property"); and Whereas, Owner desires to amend the Agreement to modify the permitted use for the Subject Property, from 46 townhomes on 8 townhome lots with 2 open space lots to 25 single family lots and 1 open space lot, pursuant to a zoning modification and plat of resubdivision as hereinafter described, following the same architectural standards that exist today, but with additional building elevations and floor plans as depicted in Exhibit B attached hereto and made a part hereof; and Whereas, Owner desires to amend the zoning map attached as Exhibit "C-1" to the Agreement, as it relates to the Subject Property; and Whereas, the City desires to accommodate Owner's desire to so amend such Exhibit "C- 1" and approve a Final Plat of Resubdivision and PUD Plan ("Final Plat") and Final Engineering Plans for 25 single-family residential lots and 1 open space lot on the Subject Property; and Whereas, the Plan Commission and City Council have held all required public hearings pursuant to due and proper notice on the proposed amendment to the Agreement, the proposed amended zoning map and related PSFR2 and PMFR zoning ordinances, the Final Plat and Final Engineering Plans, as required by law. Now Therefore, for and inconsideration of the premises and the mutual promises and agreements herein contained and pursuant to the authority and conditions given and contained in the statutes of the State of Illinois, the parties hereby agree as follows: A. This Amendment is made pursuant to and in accordance with the provisions of Section 11 of the Illinois Municipal Code (65 ILCS 5/11-15.1.1 et seq.), and in the exercise of the home rule power of the City. B. The "Zoning Map" exhibit attached as Exhibit C-1 to the Annexation Agreement is hereby amended with respect to the Subject Property to convert the Subject Property from the existing PMFR Planned Multiple Family Residence District to the PSFR2 Planned Single Family Residence District to provide for the conversion of 46 townhomes on 8 townhome lots with 2 open space lots into 25 single-family residential lots and 1 open space lot, pursuant to Exhibit C- 2 of this Amendment. C. In furtherance of the aforesaid zoning modification to the Subject Property, the Subject Property and the development contemplated thereon shall be developed in accordance with the Final Plat of Subdivision titled "Resubdivision of Cedar Grove", prepared by Mackie Consultants, LLC, dated March 6, 2015 with a latest revision date of April 15, 2015, and the Final Engineering Plans entitled Cedar Grove East Redevelopment prepared by Mackie Consultants, LLC, dated March 6, 2015 with a latest revision date of April 14, 2015, attached hereto as Exhibit D and E, respectively, with such further revisions of said Final Plat of Subdivision and Final Engineering Plans as required by the City Engineer. D. The "Building Elevations and Design Guidelines" attached as Exhibit H to the Agreement is hereby expanded to permit the building elevations and floor plans as depicted in Exhibit B of this Amendment on the Subject Property. E. Immediately after the entry into this Amendment, the City shall pass or adopt an ordinance amending the PMFR Planned Multiple Family Residence District ordinance with respect to the Subject Property in the form attached hereto as Exhibit F and an ordinance amending the PSFR2 Planned Single Family Residence District ordinance with respect to the Subject Property in the form as set forth in Exhibit G attached hereto. F. In the event of any conflict between the terms of the Agreement and the terms of this Amendment, the terms of this Amendment shall supersede, govern and control. In all other respects, the Agreement shall remain in full force and effect as originally written and as amended. Substantial conformance to the final engineering plans for Cedar Grove East redevelopment entitled "Cedar Grove East Redevelopment", prepared by Mackie Consultants, LLC, dated March 6, 2015, with a last revision date of April 14, 2015, subject to further revisions required by the Community Development, Engineering, Water, Fire and Legal Departments. 9. Conformance with applicable codes and ordinances. Section 6. That except as amended herein; the use and development of the Subject Property shall be controlled pursuant to the provisions of Ordinance No. G48-06. In the event of any conflict between this ordinance, which expressly includes those documents detailed within Section 2 and the allowances and departures described and provided thereon, and Ordinance No G48-06, this ordinance and associated documents shall control and prevail.
