RESOLUTION
APPROVING CHANGE ORDER NO. 1 AND FINAL FOR THE CONTRACT
WITH EARTHWERKS LAND IMPROVEMENT& DEVELOPMENT CORP. FOR
THE CONSTRUCTION OF JACK E. COOK PARK AND FOREST PRESERVE
WHEREAS, the City of Elgin has heretofore entered into a contract with Earthwerks
Land Improvement & Development Corp. for the construction of Jack E. Cook Park and Forest
Preserve; and
WHEREAS, it is necessary and desirable to modify the terms of the contract as is
described in Change Order No. 1 and Final, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS, that Sean R, Stegall, City Manager, be and is hereby authorized and
directed to execute Change Order No. 1 and Final, a copy of which is attached hereto and made a
part hereof by reference.

CONTRACT: General Construction Jack E. Cook Park Bid No. 13-031
SCOPE: Amendments to the Construction Document for permit required changes identified in
Construction Bulletin #001, dated 07/25/2013, issued to Earth Werks Land/Development Corp. on

REASONS FOR CHANGE:
• The circumstances said to necessitate the change in performance were not reasonably foreseeable
at the time the contract was signed.
• The change is germane to the original contract as signed.
• The change order is in the best interests of the City of Elgin and authorized by law.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The Contract is being amended to increase
the contract amount. The changes will not result in a change to the contract provisions or contract time
for work to be completed.
ORIGINAL CONTRACT AMOUNT: $889,000.00
BASIS FOR THIS CHANGE ORDER NO. 1 AND FINAL:
The changes are required to install box culverts and construct drainage swales allow surface run-
off from the parcel to the east to flow through the park site to the creek west of the park site; to
provide additional survey work; and to provide additional topsoil and grading.
TOTAL FOR CHANGE ORDER NO. 1 AND FINAL: $74,869.18

The original amount of the contract with Earth Werks Land Development Corp. is $889,000.00. Change
Order No. 1 and Final will increase the original contract amount by a total of$74,869.18, that sum rep-
resenting 8.42% of the original contract amount. The new contract amount, inclusive of all change or-
ders is$963,869.18.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
