River Rd., Elgin, IL 60123 CITY OF ELGIN, ILLINOIS Lime Residue Removal and Disposal 1 of 11 September 2014 1 Request for Proposal for Removal and Disposal of Lime Residue Section 1.0 INTRODUCTION The work to be performed under the provisions of this contract consists of the removal, hauling, and final disposal of water treatment plant lime residue from the City's South McLean Boulevard lagoon site and/or the Airlite Water Treatment Plant lagoon site. The lime residue is generated by the water treatment processes at the City's lime softening Water Treatment Plants. The City has an IEPA permit for land application of the lime residue. The City of Elgin desires to enter into a series of five one-year contracts for disposal of 35,000 dry tons of lime residue annually, with a new contract being entered into each year as the funding is approved by the City Council. It is anticipated that the selection of disposal sites will be an ongoing process also. The Contractor shall have adequate disposal sites for each year's contract. Any deviations from or exceptions taken to the requested services, conditions, or requirements must be listed on a separate sheet of paper and must be returned with your proposal. If any questions arise or further clarification of the documents is needed, please contact Jeff Luker, Chief Plant Operator, at 847/931- 6150 or 847/931-6108. The City of Elgin will receive and evaluate proposals for various methods of disposal of the lime residue including, but not limited to, the following: land application, disposal in a landfill, alternative daily cover or final cover in a landfill, soil blending operations, mixing with composted yard and/or leaf wastes, lime stabilization of biosolids, and flue-gas desulfurization of coal- fired furnaces. The project will be awarded to the contractor who demonstrates the best ability to help the City meet its goals of removal and disposal of the lime residue. The South McLean lagoons are located within the city limits of Elgin, Illinois, approximately 2,500 feet south of U.S. Highway 20 and 1,100 feet east of S. McLean Boulevard, and adjacent to The Highlands of Elgin Golf Course. The Airlite Water Treatment Plant lagoons are located at 74 N. Airlite Street, Elgin, Illinois. Section 2.0 GENERAL CONDITIONS AND INSTRUCTIONS 2.1 Materials and Equipment The contractor shall supply all equipment, materials, tools, vehicles, and labor necessary to dewater, remove, load, transport, and dispose of the two water treatment plants lime residue in an acceptable manner. In the first year of the contract, and prior to any loads being removed from either site, the contractor shall provide the city with a certified truck scale at the South McLean Lagoons that is able to produce a daily report for hauling including truck tare weight, gross weight and net weight for every load that is taken from either site. The daily report from the scale shall be sent to the city of Elgin. The scale shall be certified on the recommended schedule by the manufacturer and at any time requested by the city of Elgin. The contractor may consider the option of providing a second scale at the Airlite Water Treatment plant if this is more cost effective than the transportation expenses to the South McLean lagoons. The city is currently in the second year of operation of the improved Airlite Water Treatment plant and has been making operational changes as Lime Residue Removal and Disposal 2 of 11 Septanbcr 2014 2 efficiency improvement opportunities are observed. As such, the quantity of lime residuals from the plant has been fluctuating and substantially increased over the original plant. The contractor shall provide a lime residue handling plan for the Airlite Water Treatment Plant that includes dewatering, storage and handling of the materials. It would be acceptable to provide a plan that would be expandable, as the current well source is only half of the plant treatment capacity. The contractor shall provide a written detailed description of the proposed method of removal of lime residue from the lagoons, the method of hauling the material away, and the method of final disposal. The contractor is responsible for demonstrating the feasibility of the methods. 2.2 Special Notice Contractors shall inform themselves of the condition of the site of the lime residue lagoons, obstacles to be encountered, and all other relevant matters concerning the work to be performed, including appropriate city, state, and national codes as they may apply. The City shall not be liable in any way by reason of any matter or thing concerning which such contractor might have so informed himself prior to the award of the contract. Incidental costs resulting from the use of minor items shall be borne by the contractor. In the event that any damage occurs to the City of Elgin's equipment or facility due to any operation by the contractor, all expenses, claims, and other liability incurred shall be borne by the contractor. The contractor shall provide on the attached sheet the names of at least three (3) companies or locations where lime residue removal and disposal has been completed by the contractor. The contractor shall have sufficient resources and personnel to commit to a project of this magnitude, both from the standpoint of the amount of lime residue to be removed and from locating the appropriate disposal sites. 2.3 Protection of Property and Public Liability The contractor shall be liable for any damage resulting from his operations. He shall be fully and solely liable for the protection of all persons, including members of the public, employees of the Owner, and employees of other contractors or subcontractors, and all public and private property, including structures, sewers, and utilities, above and below ground. The contractor shall furnish and maintain all necessary safety equipment, such as barriers, signs, warning lights, and guards, to provide adequate protection for persons and property. The contractor shall be responsible for control of dust at the lagoon site and on the access roads to the site. The contractor shall have and maintain equipment at the site to control the dust, silt, dirt, or runoff of any kinds, and complaints of excessive dust shall be immediately and appropriately addressed. Liquidated damages in an amount of not more than $1,000.00/day may be assessed to the contractor if compliance with this provision is not demonstrated. The contractor shall give reasonable notice to the owners of public or private property and utilities when such property and utilities are potentially subject to injury or damage through the performance of the work and shall make all necessary arrangements with such owners relative to the removal and replacement or protection of such property or utilities. Lime ResidueRemoval and Disposal 3 of 1 1 september 2014 3 2.4 Permits and Insurance Before commencing work the contractor shall obtain the required Illinois Environmental Protection Agency and Illinois Emergency Management Association permits, and any and all other permits necessary for the proposed work as required by law and shall secure and maintain throughout the duration of the work Commercial General Liability Insurance. The policy shall also include protection against claims insured by using personal injury liability coverage, a "protective liability" endorsement to insure the contractual liability assumed by contractor under the indemnification provisions in General Conditions, and "Completed Operations and Products Liability" coverage (to remain in force during the correction period) . The contractor shall furnish a Certificate of Insurance indemnifying and naming as an "additional insured" the City of Elgin. The insurance coverages shall not be less than the amounts stipulated below: Worker's Compensation Statutory Commercial General Liability, including Automobile (Bodily Injury & Property Damage) $ 2,000,000 Aggregate $ 1,000,000 per Occurrence Pollution Liability Insurance $10,000,000 Automotive-for all owned, non-owned, hired and leased vehicles Combined single limit $1,000,000 or Bodily injury, $ 500,000 per person $1,000,000 per accident Property damage-each occurrence Umbrella Combined single limit $2,000,000 General Aggregate $2,000,000 Work's Compensation Statutory $1,000,000 Employer's Liability $ 100,000 2.5 Proposal Security Each proposal must be accompanied by a bond, certified check, cashier's check, or cash in the amount of 5% (five percent) of the total value of the contract for the removal and disposal of the first year's 35,000 dry tons of lime residue payable to the City of Elgin as a guarantee that the accepted firm who submitted the proposal shall enter into a contract and provide bonds and insurance within 15 days after contract award. The current permit is for quantities of lime up to 35,000 dry tons; therefore, any field application over this amount will require additional coordination with the IEPA and shall be considered incidental by the contractor. For purpose of comparative evaluations, the proposals should be based on the removal of 27,000 dry tons of lime residue from the lagoons near South McLean Boulevard and 8,000 dry tons of lime from the Airlite Water Treatment Plant. The City of Elgin shall be entitled, in its sole discretion, to require lime residue removal from any of the six cells and/or the temporary cell within the South McLean lagoons and/or the two cells within the Airlite lagoons. 3.3 Calculation of Payment Payment shall be made according to the following formula: (actual weight of materials removed) X (typical solids content) X (unit price in dollars per ton lime residue solids) • "# of loads" shall be a documented count of each vehicle used per time period. The contractor shall notify the City of Elgin in ample time prior to hauling so this count can be verified. • "Weight of load" shall be the actual weight of each truckload. Successful company will provide a certified scale to be located at the South McLean facility. ALL trucks will be tared daily and then actual weights will be obtained after filling. The actual weight will be used in the calculation. • "Typical solids content" is an average solids content of the material removed; it is expressed in terms of weight per volume, such as (LB dry solids/CY) or (LB dry solids/GAL) . It is to be determined by taking a sample from the haul truck and performing the "Total Residue Dried at 103-105°C" test described in the "Standard Methods for the Examination of Water and Wastewater", most recent edition. This test will be performed at the start of the contract by the City of Elgin to establish typical dry solids content for the removal method used. The contractor may, at this expense, submit the results of more frequent sampling from an accepted laboratory to demonstrate higher dry solids content of material removed. All sampling must be done in the presence of a City of Elgin representative. The City of Elgin reserves the right to require additional sampling at its discretion. The solids content established by the most recent test will be valid for billing purposes until the next test is performed to establish new solids content. • "Unit price in dollars per dry ton lime residue solids" shall be the price submitted in the proposal. McLean Blvd. in 1982 (permit#1981-27-OP). Each of the original four cells at the site is approximately 500 feet wide by 600 feet long by 11 feet deep. Two additional cells were added to the site in 1999(Permit#1998-SC-0674). This increased the storage capacity by 170,000 cubic yards to a total of approximately 550,000 cubic yards. The cells decant to a common detention pond, which then overflows to a drainage ditch and eventually to the Fox River(NPDES Permit#IL0062251). The South McLean Blvd. Lagoons receive lime sludge from Elgin's Riverside Water Treatment Plant only. This facility is supplied with raw water from the Fox River(96%)and deep wells(4%) on a yearly average. The cells contain approximately 350,000 cubic yards of wet lime sludge, and the yearly production rate at the Riverside Plant is about 18,000 dry tons. The lime sludge is pumped to the lagoons from the Riverside Plant at about 3.5%solids,and the lagoons contain material of about 40%solids. Airlite Street Lagoons The City of Elgin's Airlite St.Water Treatment Plant is supplied by water from five deep wells. About 5% of the City's water is provided by this plant, and about 8,000 dry tons of lime sludge are generated annually. The plant has two lagoon cells on site, constructed and put in service in 1998(Permit#0792- FY1997). The total capacity of the two cells is about 6,400 cubic yards. Each cell was constructed with a double liner consisting of non-woven geotextile fabric over PVC, and a leachate collection system, over a geosynthetic clay liner. A top protective layer consists of six inches of reinforced concrete over twelve inches of soil. Leachate collection pumps were installed in each cell, along with groundwater monitoring wells nearby. An exception to the water well setback zone requirements was granted by the Illinois Pollution Control Board in 1995 (PCB 94-371)for this work since the lagoons are near the deep wells. The lagoons currently contain about 1,500 cubic yards of material at about 60%solids. The ferric sulfate used as the primary coagulant at the Airlite St.WTP makes the lime sludge thicker and more concentrated. City of Elgin Lime Residue Characteristics The sludge from Elgin's Riverside Plant, stored at the S. McLean Blvd. lagoons, consists primarily of lime residue from the softening basins. A small amount of alum sludge and powdered activated carbon from the pretreatment basins is added to these lagoons also. The Airlite Plant lagoons contain sludge consisting entirely of lime residue from the softening processes. Nothing is ever added to the lagoons except the waste from the water treatment plants. The water softening processes at both plants include the addition of calcium oxide to reduce the hardness and a small amount of ferric sulfate as a coagulant. The softening by-product of calcium carbonate is the main component of the sludge, making it a good substitute for agricultural lime products because it reacts the same way in the soil. It enhances the effectiveness of fertilizer and supports better plant growth by raising the pH of normally acidic soils. LimeResidueRemoval and Disposal 11 of 11 September 2014 11 Beneficial Reuse Management Policy Manual Performance Based Compensation and Performance Reviews Beneficial Reuse Management utilizes a Performance Based Compensation System, which was adopted with the beginning of the 2008 compensation year. Compensation Components-Compensation for each employee covered by the system consists of a base salary paid semi-monthly and a target bonus paid once per year. The percentage of total compensation that is paid in bonus will vary by individual and by position but, in general, higher paid employees will have a greater portion of their compensation earned from their target bonus. Compensation Determination -Each employee's compensation is reviewed in January and salary level and target bonus level for that calendar year is determined and communicated to the employee by the employee's manager. Employees joining the company after January 1 of each year will have their target bonus amount prorated for the portion of the year that they are employed by the company. Bonus Criteria—Full time employees will have a target bonus. The target bonus is not an entitlement and is paid only if earned based upon evaluation of factors including individual performance against bonus criteria and the performance of the company against its financial plan. Personal goals and objectives for each compensation year are established for each employee by their manager and committed to writing in the employee's annual Performance Plan. Managers will discuss performance against the written goals at the end of the year. Goals can be both quantitative and qualitative and will be unique to each job within the company. Bonus Payments-Bonus payments are made in February of each year, based on personal performance appraisals and performance of the company in the prior calendar year. Bonuses are not earned until they are paid. Should an employee leave the company for any reason before the bonus is paid, no pro-rated portion of the bonus will be due or paid. Beneficial Reuse Management LLC,372 W.Ontario,Suite 501,Chicago,IL 60654 5 Beneficial Reuse Management Policy Manual Equal Opportunity Equal Opportunity is Beneficial Reuse Management's policy. It is our policy to select the best-qualified person for each position in the organization. No employee of the company will discriminate against an applicant for employment or a fellow employee because of race, creed, color, religion, sex, national origin, ancestry, age, sexual orientation, marital status, or other physical or mental disability. No employee of the company will discriminate against any applicant or fellow employee because of the person's veteran status or any other characteristic protected by law. This policy applies to all employment practices and personnel actions including advertising, recruitment, testing, screening, hiring, selection for training, upgrading, promotion, transfer, demotion, layoff, termination, rates of pay, and other forms of compensation or overtime. Employee Status and Records Employment Classifications There are three classifications of employees: Regular Full-time-An employee who works a normal 40-hour workweek on a regularly scheduled basis. Regular Part-time-An employee who works less than a normal workweek, on either a regularly scheduled basis or on an irregular basis. Temporary-An employee hired for a period not exceeding three months and who is not entitled to regular benefits. An extension of a temporary work classification for an additional three-month period, or less, may be granted, if upon review by management, the assignment is clearly found to be necessary.A temporary employee may be full-time or part-time. In addition to the use of this classification for clerical positions, it applies to students working part-time and those who work during the summer. All employees are classified as exempt and non-exempt according to these definitions: Salaried Exempt-Positions of a managerial, administrative, or professional nature or for outside sales, as prescribed by federal and state labor statutes, which are exempt from mandatory, overtime payments. Salaried Non-Exempt-Positions of a clerical, technical, or service nature, as defined by statute, which are covered by provisions for overtime payments. 4 Beneficial Reuse Management LLC,372 W.Ontario,Suite 501,Chicago,IL 60654 Beneficial Reuse Management Policy Manual Performance Improvement Performance improvement may be suggested whenever company management believes that an employee's performance is less than satisfactory and can be resolved through adequate counseling. Corrective counseling is completely at the discretion of company management. The company desires to protect its investment of time and expense devoted to employee orientation and training whenever that goal is in the company's best interests. The company expressly reserves the right to discharge"at will". Even if corrective counseling is implemented, it may be terminated at any step at the discretion of management. Management, in its sole discretion, may warn, reassign, suspend, or discharge any employee at will, whichever it chooses and at any time. Termination Employment with the company is normally terminated through one of the following actions: Resignation—Voluntary termination by the employee; Dismissal- Involuntary termination for substandard performance or misconduct; Layoff-Termination due to reduction of the work force or elimination of a position; Resignation: An employee who wants to terminate employment, regardless of employee classification, is expected to give as much advance notice as possible. Two weeks or ten working days is generally considered to be sufficient notice time. If an employee resigns to join a competitor, if there is any other conflict of interest, or if the employee refuses to reveal the circumstances of his or her resignation and the future employer, the manager may require the employee to leave the company immediately rather than work during the notice period. This is not to be construed as a reflection upon the employee's integrity but an action in the best interests of business practice. When immediate voluntary termination occurs for the above reasons, the employee will receive pay"in lieu of notice,"the maximum being two weeks of pay based upon a 40-hour workweek at the employee's straight-time rate or salary. Dismissal: Substandard Performance-An employee may be discharged if his or her performance is found unacceptable by a supervisor/manager. The supervisor/manager may, at his or her discretion, counsel the employee concerning performance deficiencies, provide direction for improvement, and warn the employee of possible termination if performance does not improve within a defined period of time. 6 Beneficial Reuse Management LLC,372 W.Ontario,Suite 501,Chicago,IL 60654 Beneficial Reuse Management Policy Manual Misconduct-An employee found to be engaged in activities such as, but not limited to, theft of company property, insubordination, conflict of interest, or any other activities showing willful disregard of company interests or policies, may be disciplined, up to and including possible termination. Termination is at the discretion of the supervisor/manager and depends upon the seriousness of the offense. If an employee is terminated, the employee shall be provided with a written summary of the reason for termination. No salary continuance or severance pay will be allowed. Layoff-When a reduction in force is necessary or if one or more positions are eliminated, employees will be identified for layoff after evaluating the following factors: • Company work requirements; • Employee's abilities, experience, and skill; • Employee's potential for reassignment within the organization; • Length of service. The employee will receive at least two weeks advance notice of termination date and will receive one week of pay for each year of employment with the company up to a maximum of four weeks. The payment will be based on a 40-hour workweek at the employee's straight time rate or salary. All outstanding advances charged to the terminating employee will be deducted from the final paycheck by the payroll department. On the final day of employment, the employee's manager must receive all keys, ID cards, and company property from the employee. Harassment & Discrimination Policy Prohibition on Harassment & Discrimination It is the policy of Beneficial Reuse Management to maintain a working environment free from all forms of illegal harassment or intimidation such as harassment and intimidation based on race, color, creed, sex, national origin, age, sexual orientation, marital status, physical or mental impairment or veteran status. This concept is summarized in the table below. Reduction in Program Reduction in Cost of Year Dry Tons Sold Cost to Elgin (per ton) Program to Elgin ($) 1 35,000 $ 2.00 $ 70,000 2 35,000 $ 5.00 $ 175,000 3 35,000 $ 8.00 $ 280,000 4 35,000 $ 11.00 $ 385,000 5 35,000 $ 14.00 $ 490,000 8 Subcontractor Qualifications Contractor will utilize subcontractors, including hauling companies that meet all requirements of the bid specifications. All subcontractors used by Contractor will be experienced in performing removal and delivery of lime solids * _ to land application sites and understand the environmentally "° sensitive nature of the program. Pricing and Term Contractor proposes the following pricing for the services outlined above and stated in the City of Elgin RFP Dated November 10, 2014. All loads leaving the McLean and Airlite sites will be weighed with an onsite scale provided by Contractor. A daily report will be generated and provided to the City upon request and for billing purposes. Lime samples will be taken and analyzed for percent solids information and be used for billing purposes. The City of Elgin would pay Contractor$56.00 per dry ton (the"Operating Fee")for lime residue removed from the McLean and Airlite lagoons. Payment will be based on the following calculation: Net Weight (Tons) per load x Total Solids (%divided by 100) =Dry Ton Weight Dry Ton Weight(Ton)x Unit price($)= Payment($) Weight—daily Net Weight of individual trucks Total Solids—Results from solids analysis The Operating Fee will be adjusted annually on the anniversary of the contract for any increases in the published Consumer Price Index. Contractor estimates the value of the lime residue to be approximately$28.00 per dry ton when compared to similar liming products in northern Illinois. Contractor's goal will be to increase the value in the marketplace to this level over the length of the 5 year contract. To get to this level, Contractor will attempt to collect$4 per ton from growers on average in year 1 of the contract and increase this value by$6 each year until we are collecting$28 per ton by year 5. As Contractor is able to increase the value of the material and are able to receive such revenue from the growers in the area, BRM will split 7 dewatering and handling issues in comparison to the current methods and provide additional efficiencies. The Airlite site has limited available space, which a plate and frame press will provide benefits to allow the plant to run more efficiently and allow for more timely removal of residuals from the plant. A review of the entire discharge and operation of the Airlite plant will be undertaken to see if a more efficient and cost effective way of managing the lime residue is possible. Land Application of Lime Residue—Beneficial Use of Lime Residuals Contractor intends to beneficially reuse 100%of the lime residue excavated from the lagoons for agricultural use. However, alternative disposal has been negotiated with two landfills in the area to dispose of the material if necessary. Based on an annual quantity of 35,000 dry tons and an estimated 2—3 dry ton per acre average application rate, approximately 15,000 acres per year will be required to operate this program. Contractor has an established network of growers, crop consultants, and distributors in and around the Elgin area currently using Gypsoil Brand Gypsum and therefore establishing 15,000 acres,or more if needed, for this program will be achieved. Contractor has already spoken with many of these customers and contacts, some of which are already using the lime residue material from the City of Elgin and plan to continue using it as well as other land owners who have legitimate interest in using the material. Contractor has the ability to provide additional value added services that few other companies can offer. These additional services include our proven ability to maximize the value of the byproducts to local farmers through agronomy based education stressing the value of the byproducts to the grower. Through grower education and marketing efforts, BRM Contractor intends to shift past management efforts to create economic value from the byproduct lime for the benefit of the City of Elgin. As outlined in more detail below,Contractor is proposing to share with the City of Elgin the economic benefits of this potential increase in market value of the material. As the value is able to be increased by Contractor the benefits likewise will increase to the City. Regulatory Reporting and Grower Reports Contractor will be responsible for all regulatory compliance, oversight, and reporting in operating this program. In addition,Contractor will provide growers participating in the program with a Grower Report to show them the amount of lime residuals applied and the agronomic benefits associated with the application. To ensure the correct amount of lime is applied to a field, the project technical specialist will calculate the total amount to be applied to a field using current analyses. The field manager, using truck weight tickets or truck volumes, maintains a cumulative subtotal of tonnage entering the field. The reports and documents will be made available to the City of Elgin upon request and the regulatory agency. 6 Continued Dewatering and Removal of Residuals from the Lagoons South McLean Blvd Lagoons Lime residual material will be moved to the sides by a drag line. Lime residuals will be stacked on the sides of the lagoons to facilitate drying. Material that has sufficient time to dewater/dry will then be loaded into end dump tractor trailers by a tracked excavator and then transported to end users. In order to limit disturbance of the lagoon floor,Contractor will implement quality controls/quality assurances to ensure the clay liner is not damaged. Contractor will be hiring a subcontractor to perform this work and will receive bids from multiple subcontractors and review with City of Elgin personnel to ensure a competent subcontractor is selected. Contractor sludge removal equipment includes, but is not limited to: • Drag line excavator • Tracked excavator • Tractor/Trailer end dumps Airlite Street Lagoons Upon an issuance of Notice-to-Proceed the exact method for removal will need to be evaluated based on the time of year. Freezing conditions will require a different management technique for removal and land application. IEPA and IEMA rules and regulation will also dictate what can and cannot be done in a short period of time and the time of year the material needs to be removed. As we progress through the contract the exact approach can be communicated and planned for accordingly based on normal and requested operation parameters. Material that has sufficient time to dewater/dry will then be loaded into end dump tractor trailers or quad dump trucks by a tracked excavator and then transported to the end user. Contractor sludge removal equipment includes, but is not limited to: • Tracked excavator • Tractor/Trailer end dumps or quad dump trucks In addition to the methods of dewatering proposed above, Contractor will also evaluate a long term alternative for managing and handling lime residue at the Airlite site. Contractor will evaluate the use of a plate and frame press and/or vacuum press technology to manage lime residuals that are currently disposed of in the onsite lagoon system. We believe a plate and frame press will help reduce 5 Contractor dewatering equipment includes, but is not limited to: • Suction/Discharge Hose • Trash/effluent pumps 4 Management of Lagoons and Lime Residue Removal Initial Lagoon Dewatering South McLean Blvd Lagoons Initial dewatering of the lagoon at this location will be accomplished by City of Elgin staff prior to solids removal. Decant water will be discharged to outlet structure and adjacent overflow lagoon. Airlite Street Lagoons The City of Elgin has informed BRM the South Airlite Street Lagoon will be completely full by the end of March 2015. BRM will need to make every effort possible to find a solution to this issue before the end of March in order to ensure the continued operation of the Airlite Water Treatment Plant is uninterrupted. Extremely cold weather has resulted in the freezing of the South Airlite Lagoon and therefore made the removal of this material challenging. Some possible solutions to this issue have been discussed with City of Elgin staff and additional solutions will be reviewed with City of Elgin staff during the week of January 12, 2015. Below are some of the possible solutions BRM is considering: - Transport lime residue material from the South Airlite Lagoon to the North Airlite Lagoon to allow for additional capacity in the south lagoon. Additional efforts would be required to allow for the north lagoon to increase capacity including blocking the decant structure. - Transport lime residue material from the South Airlite Lagoon to the South McLean Lagoon. This would require permission from IEPA and IEMA in order to do this but could be feasible if permission is granted. BRM to pursue this option with IEPA and IEMA. - The lime residue material will not have the ability to dewater due to the extremely cold temperatures so BRM will be considering hauling the lime residue material in liquid form in tanker trucks to farm fields for a liquid application to the fields. - Additional options will be considered and discussed with City of Elgin staff. After the South Airlite Lagoon issue is resolved in the near term BRM will operate both Airlite Lagoons in the long term as follows: BRM dewatering will be accomplished by Contractor staff and it's subcontractors in conjunction with and coordination with City of Elgin staff. Sumps will be installed to help facilitate drying of the material in place. BRM staff will work with the City of Elgin to install a system similar to the one shown in the picture below prior to the lagoon being put back into service. Decant water will be discharged to the outlet structure. Pumping will stop when the effluent is removed and sludge is encountered. 3 The Work under this Contract consists of REMOVAL AND DISPOSAL OF LIME RESIDUE Services for the City of Elgin,IL. ELGIN, IL 60120 SUBJECT: NOTICE OF REGISTRATION REQUIREMENT 32 Illinois Administrative Code 330.40(d),Regulations Pertaining To The Generation,Handling,And Disposal Of Water Treatment Residuals Containing Radium. The Illinois Emergency Management Agency, Division of Nuclear Safety (herein referred to as IEMA)is issuing this notification to the regulated persons involved in the generation, handling, and disposal of treatment residuals resulting from the treatment of groundwater containing radium-226 and radium-228. Radium-226 and radium-228 are naturally occurring radioactive materials found in certain deep well aquifers. Illinois community water supplies (CWS), in an effort to reach compliance with the United States Environmental Protection Agency's drinking water standard of 5 picoCuries/liter, have installed treatment technologies that remove radium-226 and radium-228 from the groundwater. The radium is removed from the drinking water and concentrated in either a residual at the drinking water treatment facility or in the sludge at a wastewater treatment plant. As a direct result of treating the groundwater for compliance with federal standards, the concentrations of radium in the spent media and sludge have created TENORM (technologically enhanced naturally occurring radioactive material). Proper management and disposal 01 the resulting treatment residuals ensures worker safety and minimizes environmental impact. IEMA regulates the possession and use of radioactive material.Certain uses of radioactive material require a specific license to be issued by the Agency pursuant to 32 Illinois Administrative Code 330. In an effort to minimize the regulatory burden and financial costs imparted to Illinois communities, while affording worker and environmental protection, IEMA has promulgated an exemption from these licensing requirements. On February 28, 2011, 32 III. Adm. Code 330,40(d)was promulgated which provides an exemption for facilities producing treatment residuals containing radium from the treatment of groundwater. Provided the treatment residuals remain at a concentration 01 200 picoCuries/gram or less(on a dry weight basis), licensure and reporting in compliance with 32 III. Adm. Code 330 is not required. Additionally, the disposal costs and fees associated with low-level radioactive waste management are not applicable. Your facility has received this notification due to the fact IEMA believes that the treatment technology installed at your facility, in combination with the aquifer(s) from which the facility draws source water, have the capability to concentrate radium. Furthermore, the disposal of this media and/or any resulting backwash or reject water may concentrate radium in the resulting sludge. This may impact the disposal options available to the end users of the treatment residuals and mandates specific monitoring and reporting requirements. In accordance with 32 III.Adm. Code 330.40(d)2, your facility must register with the Illinois Emergency Management Agency. The first step in registration is verifying and completing the attached contact and inventory information. Community water supplies are asked to verify (as applicable) well inventory, any treatment installed, and any wastewater treatment plant that receives a resulting waste stream. Gather the required information by May 2, 2011. IL 532-0016 WPC 156 76 NARRATIVE CITY OF ELGIN, ILLINOIS,WATER DEPARTMENT LIME SLUDGE MANAGEMENT PLAN 1.0 Compliance with 35 IL Adm Code Section 391.202(a)(5) 1.1 South McLean Boulevard Lagoons The City of Elgin was permitted to operate a lime sludge waste facility near S. McLean Blvd. in 1982(permit#1981-27-OP). Each of the original four cells at the site is approximately 500 feet wide by 600 feet long by 11 feet deep. Two additional cells were added to the site in 1999 (Permit #1998-SC-0674). This increased the storage capacity by 170,000 cubic yards to a total of approximately 550,000 cubic yards. The cells decant to a common detention pond, which then overflows to a drainage ditch and eventually to the Fox River(NPDES Permit#ILG640231). The South McLean Blvd. Lagoons receive lime sludge from Elgin's Riverside Water Treatment Plant only. This facility is supplied with raw water from the Fox River(96%) and deep wells(4%)on a yearly average. The cells contain approximately 350,000 cubic yards of wet lime sludge, and the yearly production rate at the Riverside Plant is about 18,000 dry tons. The lime sludge is pumped to the lagoons from the Riverside Plant at about 3.5% solids, and the lagoons contain material of about 40% solids. 1.2 Airlite St. Lagoons The City of Elgin's Airlite St. Water Treatment Plant is supplied by water from five deep wells. About 5% of the City's water is provided by this plant, and about 1,000 dry tons of lime sludge are generated annually. The plant has two lagoon cells on site, constructed and put in service in 1998 (Permit#0792-FY1997). An exception to the water well setback zone requirements was granted by the Illinois Pollution Control Board in 1995 (PCB 94-371) for this work since the lagoons are near the deep wells. The lagoons currently contain about 1,500 cubic yards of material at about 60% solids. 77 2 The ferric sulfate used as the primary coagulant at the Airlite St. WTP makes the lime sludge thicker and more concentrated. 1.3 Water Treatment Plant Waste Characteristics The sludge from Elgin's Riverside Plant, stored at the S. The softening by- product of calcium carbonate is the main component of the sludge, making it a good substitute for agricultural lime products because it reacts the same way in the soil. It enhances the effectiveness of fertilizer and supports better plant growth by raising the pH of normally acidic soils. 1.4 Farmland Application of Lime Sludge Over the past 5 years, and under Permit # 2006-SC-0769, the Contractor employed by the City of Elgin has removed and land applied lime sludge according to the following table. City of Elgin Land Application of Lime Sludge Dry Tons Contractor's Year Applied Contractor Permit# 2006 17,698 Synagro Midwest 2001-SC-3167,2006-SC-1467 2007 30,781 Synagro Midwest 2006-SC-1467 2008 23,494 Synagro Midwest 2006-SC-1467 2009 23,122 Synagro Central 2009-SC-1988 2010 24,531 Synagro Central 2009-SC-1988 Land application has taken place in the counties of Kane, DeKalb, McHenry, Ogle, Winnebago, Boone, Kendall, Lee, LaSalle and 78 3 Stephenson. The method of land application has been in the form of solid material. At about 40 to 50% solids, the lime sludge is removed from the lagoon cells with a large backhoe, hauled to the fields in watertight semi- trailer dump trucks and then spread with self-propelled open top slinger type spreaders. A crane with a dragline has been used to move the lime sludge to the edges of the lagoon cells so the backhoes can load it onto the trucks. Moving the material around in this manner increases the percent solids since it allows it to dry out somewhat, and also lessens the chance of damage to the lagoon cell liners since no heavy equipment actually enters the lagoon cells. The above permits are very specific with regard to spreading the lime sludge, and the limitations listed in Special Condition 2 have been complied with by the contractor. Spreading has not occurred within the prescribed distances from streams, wells, surface waters, dwellings, and roads. Spreading of the lime sludge is extremely weather dependent, but the lagoon cells have enough remaining capacity to provide storage between periods of land application. The City's Contractor, Synagro Central, has lists of over 30,000 acres of farmland committed to the land application program, and either owns or hires enough trucks, spreaders and other equipment to reach a capability of hauling and spreading as much as 2,000 dry tons per day. The current contract between the City of Elgin and Synagro Central is authorized to be extended on a yearly basis through calendar year 2014. 1.5 Metals Loading Rate Calculations A total of 119,626 dry tons of lime sludge has been land applied during the last 5 years to various farm fields. The cation exchange capacities of these sites have remained constant over the years, in the range of 12 to 20 milli-equivalents per 100 grams of soil. The pH levels of these sites were mostly from 4.8 to 6.6. Lime sludge land application rates are normally between 1.3 and 2.2 dry tons/acre, with a low of 0.5 and a high of 4.5 dry tons/acre. The Contractor currently employed by the City of Elgin has demonstrated that the CEC's do not change much over the years. Normally, the Contractor's application rates are kept below the maximum allowable amount, so the land is built up with increased pH over a few years. This method has worked well within the fanning community. The City of Elgin has been granted a reduced monitoring program for metals, as described in Part 391, Subpart E, Section 391.501 (d)(4). However, we realize that we must comply with the requirements of Part 391, Subpart B, Section 391.202 (a)(5)(E), and also the requirements of Part 391, Subpart D, Section 391.420 (a) through (h), both of which 79 4 require calculations for heavy metal loading. We shall therefore use the highest levels seen in past test results to calculate the site life as required. The heavy metals loading rates and projected life of the sites are shown in the following table. Using the highest test result seen in the past analyses, and a maximum application rate of 10 dry tons/acre,the metal loading rate calculations are as follows: Sludge Annual Maximum Analysis Loading Metal Loading Metal Loading Site Life Metal mg/kg Factor lbs/acre/year lbs/acre Years Arsenic 3.9 0.02 0.078 100 1282 Cadmium <2.9 0.02 0.058 10 >172 Chromium 7.6 0.02 0.152 3500 23,026 (Total) Chromium <21.0 0.02 0.420 440 >1048 (Hexavalent) Copper 7.6 0.02 0.152 250 1645 Mercury 0.85 0.02 0.017 7(annual) ---- Nickel 2.8 0.02 0.056 100 1786 Selenium 0.16 0.02 0.032 8 250 Silver 6.8 0.02 0.136 178 1309 Zinc 16.0 0.02 0.320 500 1563 2.0 Compliance with 35 IL Adm Code Section 391.202 (b) The City of Elgin's current contractor, Synagro Central, LLC., normally land applies lime residue to sites larger than 300 acres and uses more than 1,500 dry tons per year. Synagro is permitted(Permit#2009-SC-1988) to do the work, and the Appendix I Sludge User Information Sheets are generated and kept by them. Following is a listing of the 10 largest sludge users over the past two years, including calculations of dry tons per acre application rates. 80 5 2009 and User Name, 2009 2010 Total 2010 Total Dry Tons Address Acres Acres Acres Dry Tons Acre Pfab Farms 974 474 1421 3318 2.34 7571 Highway 251 Davis Junction, IL 61020 Wayne Hayenga 760 710 1470 2718 1.85 12506 Lindenwood Rd Kings, IL 61068 Jeff Nes ler 368 606 974 1914 1.97 18097 Meims Rd Genoa,IL 60135 Tom Hansen --- 913 913 1836 2.01 5119 N.Rt. 47 Woodstock, IL 60098 Pierce Farms --- 979 979 1752 1.79 24917 River Rd Marengo, IL 60152 Gale Walk 266 400 666 1514 2.27 13176 E. The cation exchange capacities range from 12 to 20 meq/100g. The most common crop is corn, and the normal yield averages over 118 bushels/acre according to Appendix C of Part 391. Some soybean and wheat ground is used also, and these crops average 37 and 49 bushels/acre, respectively. According to Chart I of Appendix E of Part 391, suggested normal limestone application rates would range from 3 to 8 tons per acre, depending on soil pH. Since water treatment plant lime sludge is much more efficient in raising soil pH than agricultural limestone, the Effective Neutralizing Value [ENV] must be calculated. From the formulae in Appendix E of Part 391, and using an averaged calcium carbonate equivalency from the recent analyses, the ENV is calculated as follows: ENV = Total fineness efficiency x %calcium carbonate equivalent 100 ENV = 100 x 87.4[averaged calcium carbonate equiv.] or 87.4 100 Knowing that the ENV of agricultural lime is 46.35, a correction factor must be calculated as follows: Correction Factor = ENV of Ag Lime = 46.35 = 0.5303 ENV of WTP Sludge 87.4 Therefore, 0.53 dry tons of the City of Elgin's lime sludge is equivalent to each ton of ag lime. This means that the normal application rates for Elgin's lime sludge should be about 1.6 to 4.2 dry tons per acre. The previous Permit, 2001-SC-3550, contained a maximum application rate of 10 dry tons/acre, but as shown above the normal application rates are within the recommended ranges. 4.0 Compliance with Memorandum of Agreement between IEPA and IDNS Analyses of the City of Elgin's lime residue show the total radium to be from 0.1 to 2.9 pCi/gram at the South McLean Blvd. lagoons, and from 27.5 to 49.5 pCi/gram at the Airlite lagoons. This enables us to land 82 • 7 apply the lime residue as long as the incremental increase of the radium concentration in the soil does not exceed 0.4 pCi/gram. Using an estimated soil weight of 75 lbs/cubic foot, the top six inches of one acre of soil would weigh 1,633,500 lbs. If land application at up to 4 dry tons/acre of the Airlite Plant lime sludge is done, the concentrations in the soil would be as follows: 8000 lbs. sludge/acre= 0.0049 1,633,500 lbs. soil/acre Using the lowest total radium level seen in the Airlite lime sludge of 27.5 pCi/gram,and multiplied by 0.0049,this yields a level of 0.1347 pCi/gram in the soil, which is below the increase allowed in the Memorandum. If land application of the Riverside Plant lime residue material, at up to 10 dry tons per acre, is done; the concentrations in the soils would be as follows: 20.000 lbs. sludge/acre = 0.0122 1,633,500 lbs. soil/acre Using the highest total radium level seen in the Riverside lime sludge of 2.9 pCi/gram, and multiplied by 0.0122, this yields a level of 0.03538 pCi/gram in the soil, which is below the increase allowed in the Memorandum.
