15-0101 Hampton Lenzini South Street Extension AMENDMENT AGREEMENT No. 1 THIS AMENDMENT AGREEMENT is hereby made and entered into this day of , 2015, by and between the City of Elgin, Illinois, a municipal corporation (hereinafter referred to as the "City"), and Hampton Lenzini and Renwick, Inc., a Delaware corporation and an Illinois Licensed Professional corporation (hereinafter referred to as "Engineer"). WHEREAS, the City and Engineer hereto have previously entered into an agreement dated May 24, 2006 wherein the City engaged the Engineer to furnish certain professional services in connection with the South Street Extension (hereinafter referred to as "Subject Agreement" and the "Project"); and WHEREAS, the parties hereto have determined it to be in their best interest to amend Original Agreement; and WHEREAS, the City has determined that the proposed scope of the PROJECT should be modified to include additional design services. NOW, THEREFORE, for and in consideration of the mutual undertakings as set forth in the Subject Agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows: 1. Section IB of the Subject Agreement is hereby amended by adding the following to the end thereof: 3. Additional design services for the following items: a. Waterford Londonderry Drive Extension b. Waterford Unit 2 portion of South Street c. Waterford Utility locating d. Additional wetland evaluation Additional explanation of each item included in Attachment A-1. 2. Section IVA of the Subject Agreement is hereby amended by adding the following to the end thereof, "For supplemental services provided under this amendment, the ENGINEER shall be paid at the hourly rate for the classifications of the personnel employed on this PROJECT, with the total fee not to exceed $16,710 regardless of the actual costs incurred by the ENGINEER unless substantial modifications to the scope of work are authorized in writing by the DIRECTOR 3. The changes provided to the Subject Agreement as provided in this Amendment Agreement are germane to the original contract as signed and this Amendment Agreement is in the best interests of the City of Elgin and is authorized by law. 4. That except as amended in this Amendment Agreement the Subject Agreement shall remain in full force and effect. 5. That in the event of any conflict between the terms of the Subject Agreement, and the provisions in this Amendment Agreement, the provisions of this Amendment Agreement shall control. In order to provide a logical terminus for South Street and in consideration of emergency services and overall traffic circulation,HLR was asked by the City to design a roadway connection from the South Street Extension to existing Londonderry Drive. This work was done between September 2009 and January 2010,and included the man-hours and costs summarized on the attached spreadsheet. Project administration;consultation&coordination;QC/QA 4_ 4 8581 TOTALS 4 20 17 1 35 $4,056 • ROADWAY DESIGN South Half of South Street Sta.20+85 to 31+60 Under the original scope of the South Street Extension project,the City was to design and construct the north half of the roadway from approximately Station 20+85 to Station 31+60,with the south half being designed and constructed as part of Waterford Neighborhood 1. In December of 2007, HLR was instructed by the City to complete the design of the south half of the roadway,which would be built as part of the City's construction contract. Survey. To this point,HLR had no survey data south of the proposed centerline of South Street other than cross sections provided by the development engineer showing existing conditions. At several locations,the existing cross sections did not extend to the proposed right-of-way line. In order to complete the design of the south half of the roadway,including the required embankment and proposed sidewalk,and to quantify the work to be included in the City's construction contract,an HLR survey crew performed a topographic survey to supplement our information to the south of the proposed centerline in this area. This survey work was performed on February 15 and 18,2008. Design. The supplemental survey data was then imported into the existing point data,a revised TIN (triangular irregular network)was run,and new existing conditions cross sections were generated. After updating existing conditions,HLR completed the design of the south half of the roadway. The geometric requirements had previously been set,but the cross sections required extensive revisions to include the proposed sidewalk,embankment and excavation and undercut for unsuitable materials. Revisions to the plan and profile sheets were also required,as well as recalculation of roadway and earthwork quantities and updating of summary of quantities,schedules of quantities and engineer's estimate. The design work was performed during March through June of 2008. The man-hours and costs associated with the work described herein is detailed in the accompanying spreadsheet. Since this information was sketchy at best and appeared to be incomplete,and since the design of the south side of South Street had become the City's responsibility in this area,HLR performed the field work necessary to complete the provided information and to update existing conditions. This work was done in March of 2009 and included the man-hours and costs summarized on the attached spreadsheet. This screening was outside the original scope of the project and was performed by Huff and Huff between June 28 and July 11,2009. The screening was negative. The cost of the screening was$3,963.64. A copy of Huff and Huff's invoice is attached.
