AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE
ILLINOIS DEPARTMENT OF TRANSPORTATION
FOR IMPROVEMENTS AT U.S. ROUTE 20 AND MCLEAN BOULEVARD
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,that
David J. Kaptain, Mayor, and Kimberly A. Dewis, City Clerk, be and are hereby authorized and
directed to execute an agreement with the Illinois Department of Transportation on behalf of the City
of Elgin for improvements at U.S. Route 20 and McLean Boulevard, a copy of which is attached
hereto and made a part hereof by reference.

AGREEMENT
This Agreement entered into this 11th day of April, 20 12 A.D, by and between
the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION
hereinafter called the STATE, and the CITY OF ELGIN of the State of Illinois, hereinafter called
the CITY.
WITNESSETH:
WHEREAS, the STATE in order to facilitate the free flow of traffic and insure safety to
the motoring public, is desirous of an "Advance Contract" improving approximately 10,050 lineal
feet of FAP Route 345, U.S. Route 20, STATE Section 8R-HB-2-BY-1, State Job Number C-91-
615-10, Contract 60K90, as follows:
Temporary widening of U.S. Route 20 eastbound pavement and the bridge over McLean
Boulevard (S.N. 045-0003)to accommodate 4 lanes of traffic south side of the U.S. Route 20
centerline during the "Main Contract", a secondary and final phase to the "Advance Project", for
widening and reconstruction of U.S. Route 20. The project also involves the removal and
elimination of the Weld Road intersection with McLean Boulevard, removal of the Weld Road
pavement between McLean Boulevard and Shepard Drive, reconstruction of Weld Road from
Shepard Drive to 1,500 lineal feet west of Shepard Drive, resurfacing of Shepard Drive in its
entirety, reconstruction of Fleetwood Drive from 100 feet west of Shepard Drive to McLean
Boulevard in order to maintain Weld Road continuity between Randall Road and McLean
Boulevard and resulting in a shift of traffic volumes from the Weld/McLean intersection to the
Fleetwood/McLean intersection. Fleetwood Drive will be reconstructed to provide two 12 foot
wide left turn lanes, one 12 foot wide through lane, one 12 foot wide right turn for eastbound
traffic on the west leg, one 12 foot through lane and one 12-22 foot variable width lane for
westbound traffic on the east leg. In addition the intersection will be reconstructed with
concrete pavement and a concrete median from the west right of way line of McLean Boulevard
to approximately 150 feet west of the west right of way line of McLean Boulevard. From the
new concrete pavement on Fleetwood Drive to 100 feet west of Shepard Drive and on Shepard
Drive to Weld Road, the pavement will be resurfaced with HMA asphalt. The work to be
performed under this contract shall include, but not be limited to, pavement and shoulder
removal, tree removal, and removal of other miscellaneous items; temporary bridge widening
and cast-in-place retaining walls including the City approved formliner;jointed portland cement
concrete pavement, hot-mix asphalt pavement, storm sewers and appurtenances, combination
concrete curb and gutter, sidewalks, signage, culverts, water main and appurtenances, seeding
and sodding, temporary traffic signals, temporary lighting, pavement markings, traffic control,
and all incidental and collateral work necessary to complete the project as shown on the plans
identified in the contract above and as described herein; and
WHEREAS, the STATE in order to facilitate the free flow of traffic and insure safety to
the motoring public, is desirous of a "Main Contract", the secondary and final phase to the
"Advance Contract", improving approximately 9,950 lineal feet (1.88 miles)of FAP Route 345,
US Route 20„ Lake Street, STATE Section 8R-R, State Job Number: C-91-632-09, Contract
60H45 from approximately 5,750 lineal feet east of McLean Boulevard westerly to
approximately 4,200 lineal feet west of McLean Boulevard, as follows:
Reconstruction and resurfacing of US 20 (Lake Street) from a point located approximately
5,750 feet east of the existing centerline of McLean Boulevard to a point approximately 4,200
feet west of the existing centerline of McLean Boulevard into two 12 foot wide lanes into each
direction with a variable width (8`-28') barrier median,10-foot wide outside shoulders and 6-foot
wide inside shoulders, and new 2-lane auxiliary exit lanes each lane being 12 foot wide and
1,300 feet long for the westbound exit to McLean Boulevard. The existing diamond interchange
will be reconstructed in its entirety into a single point urban interchange with new ramps
configuration and a new bridge structure along US 20 over McLean Boulevard. The proposed
bridge will consist of two 12 foot wide lanes in each direction with 12-foot wide each inside and
outside shoulders (SN 045-0077). McLean Boulevard will be reconstructed from south of
Fleetwood Drive to north of Lillian Street with concrete pavement for a total distance of
approximately 2,790 feet and resurfaced for a distance of 240 feet north of Lillian Street(and
north of the new concrete) and 350 feet south of Fleetwood Drive (and south of the new
concrete). The proposed McLean Boulevard lane configuration will consist of one 12 foot wide
inner and through lane, one 14 foot wide outer and through lane in each direction with a 4'-12'
wide variable width barrier median. The outer lane is intended to be a shared use
vehicle/bicycle lane in each direction along McLean Boulevard. Right turn lanes(12-foot wide
each)will be added at the intersections of McLean Boulevard with Fleetwood Drive, US 20 and
Lillian Street to facilitate right turning movements. Dual left turn lanes will be provided at the US
20 ramps. Existing lanes will be replaced and enhanced. The existing storm sewers will be
upgraded and four detention ponds will be constructed to accommodate drainage. The existing
traffic signals at Spartan Drive, Fleetwood Drive, Lillian Street and the new US 20 interchange
will be modernized and interconnected. New underpass lighting will be provided at the US
20/McLean Boulevard intersection and some existing lighting along US 20 and Mclean
Boulevard will be upgraded. The existing intersection of Lillian Street with Mclean Boulevard will
be reconstructed and widened to accommodate traffic. This intersection will be reconstructed in
concrete to provide two 12 foot wide left turn lanes, a concrete median, one 12-foot wide
through/right turn lane on the east leg, one 12 left turn and one through/right turn lane (12-foot
wide) on the west leg; two 12 foot wide through lanes, one 12 left and one right turn lane in the
northbound direction on McLean Boulevard and two through lanes, one 12 foot wide left turn
lane in the southbound direction. Additional work will include pavement removal, PCC
pavement, HMA pavement, retaining wall, sidewalks, signals, signage, utility adjustments, and
by performing all other work necessary to complete project as shown on the plans identified in
the contracts above and as described herein; and
WHEREAS, the CITY is desirous of assisting the State in said improvement in that
same will be of immediate benefit to the region, including the State of Illinois, City of Elgin,
Village of South Elgin, Kane County, Elgin Community College and residents and businesses of
same, and said improvement will be permanent in nature;
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the
parties hereto agree as follows:
1. The STATE agrees to make the surveys, obtain all necessary rights of way, prepare
plans and specifications, receive bids and award the contract, furnish engineering
inspection during construction and cause the improvement to be built in accordance
with the approved plans, specifications and contract.
2. The STATE agrees to pay for all right of way, construction and engineering costs,
subject to reimbursement by the CITY as hereinafter stipulated.
3. Beginning on the date that the work begins on the Advance and the Main Contract,
respectively, the STATE agrees that the STATE's Contractor shall accept
maintenance responsibility, except snow removal and street sweeping, of McLean
Boulevard, Lillian Street, Shepard Drive and Fleetwood Drive for the limits shown in
the plans referenced in the contracts above during and until both projects referenced
in said contracts are fully complete. The contracts included herein as an Advance
and a Main contract for the U.S. Route 20 at McLean Boulevard interchange project.
Maintenance shall include all pavements, lights, traffic signals, sidewalks, curb and
gutter, islands, storm sewers, signs, parkways and other typical highway
appurtenances that fall within the limits of these two projects and contracts. The
CITY shall retain maintenance responsibility of CITY sanitary sewers and water
mains.
4. The CITY agrees to lend the STATE a traffic signal controller. Any damage to the
CITY's traffic signal controller, while under the STATE's maintenance responsibility,
shall be repaired/replaced in accordance with approved STATE standard
specifications at no expense to the CITY.
5. The STATE shall include the CITY under all contract provisions relative to insurance
coverage. The STATE shall insure that the CITY is free from liabilty due to the
implementation of the contracts noted above.
6. It is mutually agreed by and between the parties hereto that the estimated cost and
cost proration for this improvement is as shown on Exhibit A.
7. The CITY has passed a resolution appropriating sufficient funds to pay its share of
the cost for this improvement, a copy of which is attached hereto as "Exhibit B" and
made a part hereof. The CITY further agrees that upon award of the contract for this
.
improvement, the CITY will pay to the STATE in a lump sum from any funds allotted
to the CITY, an amount equal to 50% of its obligation incurred under this
AGREEMENT, and will pay to said STATE the remainder of the obligation (including
any non-participating costs on FA Projects) in a lump sum, upon completion of the
project based upon final costs. The CITY further agrees to pass a supplemental
resolution to provide necessary funds for its share of the cost of this improvement if
the amount appropriated in "Exhibit B" proves to be insufficient, to cover said cost.
8. The CITY has adopted and will put into effect an appropriate ordinance, prior to the
STATE's advertising for the proposed work to be performed hereunder, or shall
continue to enforce an existing ordinance, requiring that parking be restricted within
the limits of this improvement, a copy of which is attached hereto as "Exhibit C", and
will in the future prohibit parking at such locations on or immediately adjacent to this
improvement as may be determined necessary by the STATE from traffic capacity
studies.
9. The CITY has adopted and will put into effect an appropriate ordinance, prior to the
STATE's advertising for the proposed work to be performed hereunder, or shall
continue to enforce an existing ordinance, prohibiting the discharge of sanitary
sewage and industrial waste water into any storm sewers constructed as a part of
this improvement, a copy of which is attached hereto as "Exhibit D".
10. Prior to the STATE advertising for the work proposed hereunder, the disposition of
encroachments will be cooperatively resolved with representatives from the
CITY and the STATE.
The CITY has adopted and will put into effect an appropriate ordinance, prior to the
STATE's advertising for the proposed work to be performed hereunder, or shall
continue to enforce an existing ordinance, relative to the disposition of
encroachments and prohibiting in the future, any new encroachments within the limits
of the improvements, a copy of which is attached as "Exhibit E".
11. The CITY has adopted a resolution, will send a letter, or sign the Plan Approval page
which is part of this document, prior to the STATE advertising for the work to be
performed hereunder, approving the plans and specifications as prepared.
12. The CITY agrees not to permit driveway entrance openings to be made in the curb,
as constructed, or the construction of additional entrances, private or commercial,
along US Route 20 without the consent of the STATE.
13. The CITY shall exercise its franchise rights to cause private utilities located in CITY
right-of-way to be relocated, if required, at no expense to the STATE.
14. The CITY agrees to cause its utilities installed on right of way after said right of way
was acquired by the STATE or installed within the limits of a roadway after the said
roadway's jurisdiction was assumed by the STATE, to be relocated and/or adjusted,
if required, at no expense to the STATE.
15. All CITY owned utilities, on STATE right of way within the limits of this improvement,
which are to be relocated/adjusted under the terms of this Agreement, will be
relocated/adjusted in accordance with the applicable portions of the

"Accommodation of Utilities of Right of Way of the Illinois State Highway System."
(92 III. Adm. Code 530). The STATE shall provide a list of all CITY owned utilities
that will have to comply with this provision prior to awarding the Main Project.
16. The CITY agrees to obtain from the STATE an approved permit for relocation of
CITY utilities or CITY infrastructure within STATE right-of-way as it existed prior to
the Advance Project, and to abide by all conditions set forth therein.
17. Upon final field inspection of the improvement and so long as U.S. Route 20 is used
as a STATE Highway, the STATE agrees to maintain or cause to be maintained U.S.
Route 20, the ramps to and from McLean Boulevard, Weld Road from Randall Road
to Shepard Drive, the proposed curve at Shepard Drive up to the right of way line
extended, in its entirety, all lighting within STATE right-of-way, including the
underpass lighting, in its entirety except as noted hereinafter. The STATE shall also
be responsible for the structurai integrity of all retaining walls constructed as part of
this IMPROVEMENT in their entireties as well as routine maintenance of the front
side of the retaining walls facing U.S. Route 20, except as noted hereinafter. In
addition, the STATE agrees to maintain or cause to be maintained the median
inbetween the east and west bound lanes of US 20, stabilized shoulders and ditches
adjacent to those traffic lanes..
18. Upon final inspection of the improvement, the CITY agrees to maintain, or will
caused to be maintained, those portions of the improvement located within existing
CITY right-of-way and within STATE right-of-way as specifically agreed to and define
herein, which shall include the formliner façade of all retaining walls constructed as

part of this improvement. The STATE shall allow and the CITY shall maintain
landscaping of the interior non-pavement areas of the islands located at the
intersection of each US 20 Ramp with McLean. The CITY shall provide routine
maintenance of the area from the Right of Way line up to and including the facade
side of the retaining walls facing away from U.S. Route 20. Routine maintenance
shall be limited to, the removal of any graffiti and/or undesirable vegetation. The
CITY shall maintain the retaining wall located east of McLean Boulevard and south
of U.S. Route 20 (McLean Boulevard station 68+25 to Station 68+99), Structure
Number 045-W012, in its entirety.
All existing sidewalk and new sidewalk constructed as part of this improvement shall
be maintained by the CITY. The maintenance, repair and/or reconstruction of storm
sewers constructed as part of this improvement and located outside the right-of-way
for US 20 and Weld Road and outside the limits of McLean Boulevard describe above
shall be that of the CITY. The maintenance, repair and/or reconstruction of storm
sewers constructed as part of this improvement and located within the right-of-way for
US 20 and Weld Road and within the limits of McLean Boulevard describe above
shall be that of the STATE.
The CITY shall also be responsible for providing routine maintenance of all CITY
requested aesthetic treatment on bridge structures, retaining walls. Routine
maintenance should include but not limited to graffiti removal but shall not include
structural maintenance or replacement. The CITY further agrees to maintain the area
from the facade side (facing out towards CITY residental and commercial property) of
all retaining walls to the right of way line. Said maintenance shall include removal of
{
unwanted vegetation and debris/litter removal. The STATE shall insure unabated
access to these areas the CITY will maintain.
The CITY shall continue to be responsible for maintaining and providing the electrical
energy thereof, all roadway lighting located along McLean Boulevard except as noted
herein. The CITY further agrees to continue its existing jurisdiction and maintenance
responsibilities on Mclean Boulevard, Fleetwood Drive, Shepard Drive and all CITY
owned roads included as part of this IMPROVEMENT. Drainage facilities, if any, at
the aforementioned limits or located just within the STATE right-of-way of US 20 and
Weld Road, unless there is an agreement specifying different responsibilities, shall
be the responsibility of the STATE. The CITY shall be responsible for new and
existing storm sewer located outside the aforemention limits.
19. Upon acceptance by the STATE of the traffic signal work included herein, the
financial responsibility for the maintenance and electrical energy charges for the
operation of the traffic signals shall be proportioned as follows:

The STATE shall be responsible for performing the maintenance on the traffic signals
and master controller at U.S. Route 20 at McLean Boulevard. The CITY shall be
responsible the performing the maintenance at McLean Boulevard at Spartan Drive,
Fleetwood Drive and Lillian Street.
The STATE agrees to make arrangements with the local power company to furnish
the electrical energy for the operation of the traffic signals. The CITY agrees to pay
their proportionate share of this cost as billed by the local power company.
The STATE retains the right to control the sequence and timing of the above traffic
signals with the exception of Spartan Drive. Payment by the STATE of any or all of
its share of maintenance and energy costs is contingent upon the STATE receiving

20. The STATE's Electrical Maintenance Contractor shall maintain the 'Emergency
Vehicle Pre-Emption System" equipment located at U.S. Route.20 at McLean
Boulevard. The STATE'S Electrical Maintenance Contractor shall invoice the CITY
for the maintenance costs related to the maintenance of the"Emergency Vehicle
Pre-Emption System" equipment. The CITY shall maintain the "Emergency Vehicle
Pre-Emption System" equipment at McLean Boulevard at Fleetwood Drive, Lilian
Street and at Spartan Drive. The CITY shall maintain the emitters and associated
appurtenances at its own expense. The emitters shall be maintained and tested by
the CITY in accordance with the recommendations of the manufacturer.
21. It is mutually agreed, if, in the future, the STATE or the CITY adopts a roadway or
traffic signal improvement passing through the traffic signals included herein which
requires modernization or reconstruction to said traffic signals, then the STATE and
CITY agree to be financially responsible for their appropriate share, as noted above,
of the traffic signals and all costs to relocate or reconstruct the emergency vehicle
pre-emption equipment in conjunction with a STATE or a CITY proposed
improvement.
The parties hereto agree that the traffic signal maintenance and energy provisions of
this Agreement shall remain in full force and effect for a period of twenty(20) years
from the date of its execution, or so long as the traffic signals covered by the terms
of this Agreement or any amendment hereto remain in place either in their current or
some modified configuration, whichever is the shorter period of time. Such an
effective term shall apply unless otherwise agreed in writing by the parties hereto.
Obligations of the STATE and CITY will cease immediately without penalty or further
payment being required if, in any fiscal year, the Illinois General Assembly or
Federal funding source fails to appropriate or otherwise make available funds for this
contract. If the contract fails to go forward, Weld Road shall be reinstated between
Shepard Drive and McLean Boulevard at STATE expense.
This AGREEMENT and the covenants contained herein shall be null and void in the
event the contract covering the construction work contemplated herein is not awarded within
three years subsequent to execution of the agreement. This Agreement shall be binding upon
and to the benefit of the parties hereto, their successors and assigns.

FUNDING RESOLUTION
WHEREAS, the CITY OF ELGIN has entered into an AGREEMENT with the STATE OF
ILLINOIS for the improving approximately 9,950 lineal feet(1.88 miles)of US Route 20, (FAP
Route 345), Lake Street, STATE Section 8R-R, State Job Number: C-91-632-09, from
approximately 5,700 lineal feet east or McLean Boulevard westerly to approximately 4,200 lineal
feet west of McLean Boulevard; and
WHEREAS; in compliance with the aforementioned AGREEMENT, it is necessary for
the CITY to appropriate sufficient funds to pay its share of the cost of said improvement.
NOW THEREFORE, BE IT RESOLVED, that there is hereby appropriated the sum of
TWO HUNDRED SIXTY THOUSAND TWO HUNDRED SIXTY DOLLARS ($ 260,260), or so
much thereof as may be necessary, from any money now or hereinafter allotted to the CITY to
pay its share of the cost of this improvement as provided in the AGREEMENT; and
BE IT FURTHER RESOLVED, that upon award of the contract for this improvement, the
CITY pay to the STATE in a lump sum from any funds allotted to the CITY, an amount equal to
50% of its obligation incurred under this AGREEMENT, and will pay to said STATE the

WHEREAS,the State of Illinois acting by and through its Department of Transportation
is desirous of improving approximately 9,950 lineal feet (1.88 miles)of US Route 20, (FAP
Route 345),Roosevelt Road, STATE Section 8R-R, State Job Number: C-91-632-09, from
approximately 5,700 lineal feet east or McLean Boulevard westerly to approximately 4,200 lineal
feet west of McLean Boulevard,a portion of which lies within the CITY OF ELGIN; and
WHEREAS, a portion of this project runs through the CITY OF ELGIN;and
WHEREAS, in order to facilitate the free flow of traffic and ensure safety to the
motoring public, the CITY OF ELGIN determines that the parking along US Route 20 shall be
prohibited.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,COUNTY
OF KANE, STATE OF ILLINOIS,as follows:
Section 1. That parking shall be prohibited along of US Route 20,(FAP Route 345)
Lake Street, State Section 8R-R), State Job Number: C-91-632-09,within the City limits
of the CITY OF ELGIN;
Section 2. That the CITY COUNCIL of the CITY OF ELGIN will prohibit future
parking at such locations on or immediately adjacent to US Route 20 as may be determined and
directed by the State of Illinois to be necessary to ensure the free flow of traffic and safety to the
motoring public.
Section 3. The CITY CLERK is hereby authorized and directed to attach a copy of this
Ordinance to the agreement dated ,20 by and between the State of Illinois
and the CITY OF ELGIN.
Section 4. This Ordinance shall be in full force and effect from and after its passage and
approval according to law.

WHEREAS,the State of Illinois acting by and through its Department of Transportation,
is desirous of improving approximately 9,950 lineal feet(1.88 miles) of US Route 20, (FAP
Route 345), Lake Street, STATE Section 8R-R, State Job Number: C-91-632-09, from
approximately 5,700 lineal feet east or McLean Boulevard westerly to approximately 4,200 lineal
feet west of McLean Boulevard within the City limits of the CITY OF ELGIN;and
WHEREAS,said project includes the installation of storm sewers, sanitary sewers, and
drainage facilities; and
WHEREAS,a portion of the project runs through the CITY OF ELGIN including the
installation of storm drains and drainage facilities;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, COUNTY
OF KANE, STATE OF ILLINOIS,as follows:
Section 1. No person, firm,corporation or other entity shall discharge any sanitary waste
or industrial waste water into any storm sewer or drainage facility constructed as part of the US
Route 20, (FAP Route 345),Lake Street, STATE Section 8R-R, State Job Number: C-91-632-09,
highway improvement, said limits of improvement which passes through the CITY OF ELGIN.
Section 2. The CITY CLERK of the CITY OF ELGIN is authorized and directed to
attach a copy of this Ordinance to the agreement dated ,20 ,by and
between the State of Illinois and the CITY OF ELGIN relative to the improvement.
Section 3. This Ordinance shall be in full force and effect from and after its passage and
approval according to law.

Section 2. The CITY CLERK of the CITY OF ELGIN hereby authorized and directed to
attach a copy of this Ordinance to the agreement dated , 20 ,by and
between the State of Illinois and the CITY OF ELGIN relative to the improvement of US Route
