Dewis,City Clerk,be and are hereby authorized and directed to execute an extension agreement on behalf of the City of Elgin with Service Employees International Union Local 73 Clerical Technical Group,a copy of which is attached hereto and made a part hereof by reference. s/David J. Kaptain, Mayor Presented: November 14, 2012 Adopted: November 14, 2012 Omnibus Vote: Yeas: 6 Nays: 0 Attest: s/Kimberly Dewis Kimberly Dewis, City Clerk EXTENSION AGREEMENT This Extension Agreement ("Extension Agreement") is entered into as of the 14 T day of November, 2012, by and between the City of Elgin (hereinafter referred as the "City") and Service Employees International Union Local 73 Clerical Technical Group (hereinafter referred as the "Union") (collectively, hereinafter referred to as the "Parties"). WHEREAS, the City and the Union are parties to a Collective Bargaining Agreement effective April 29, 2010 through December 18, 2010 (such Collective Bargaining Agreement, as previously amended from time to time, is hereinafter referred to as the "Collective Bargaining Agreement"); and WHEREAS, the Parties have agreed to extend the termination date of the Collective Bargaining Agreement for one year, from December 18, 2010 to December 18, 2011. NOW, THEREFORE, the Parties hereto agree as follows: 1. The Preamble in the Collective Bargaining Agreement is hereby amended to provide that the term of the Collective Bargaining Agreement is extended through December 18, 2011. 2. Article XXX of the Collective Bargaining Agreement providing for the term of the Collective Bargaining Agreement is hereby amended by amending the termination date of December 18, 2010, to December 18, 2011. 3. Article IX, Wages, of the Collective Bargaining Agreement is hereby amended by adding to the end of the first paragraph thereof: "There shall be no hourly wage increase for the period commencing December 18, 2010 through December 18, 2011." 4. Article XXVIII, Life Insurance, is hereby amended to provide for an increase in the specified life insurance from $35,000 to $45,000. Such amendment shall be effective as of the entry into this Extension Agreement and shall not be retroactive. 5. Upon the entry into this Extension Agreement Clerk Typist Sandra Kolba shall be upgraded from pay grade 506 to the new position of Clerk Typist II at pay grade 511, non-retroactively. Ms. Kolba will be reclassified to pay grade 511 Step 5, non-retroactively. 6. Upon the entry into this Extension Agreement the position of Bi-lingual Clerk Typist shall be upgraded from pay grade 506 to pay grade 509, non-retroactively. Bi-lingual Clerk Typist Alva Ravadan will be reclassified to pay grade 509 Step 6, non-retroactively. The other bi-lingual clerk typist position which is currently vacant, when refilled, will be classified at pay grade 509. • 7. A one-time allotment, on a non-precedential basis, of 16 hours of personal time is hereby provided to each current bargaining unit employee. Such personal time must be used between the entry into this Extension Agreement and December 31, 2013. The use of such personal time shall be subject to advance approval by the City and must be utilized by an employee when it will not occasion a hire back or overtime liability for the City. Unused time as of December 31, 2013, will be forfeited without compensation to the employee. For the purpose of clarification, the additional personal time provided for in this section shall not be eligible for personal day conversion into cash payment as provided for in Article XI Section 6 of the Collective Bargaining Agreement. The provisions of this section are non- precedential and cannot be relied upon by the City or the Union in any manner except for the sole purpose of implementing the provisions of this section. 8. That each of the Parties represents that it has reviewed the terms of this Extension Agreement, and by executing this Extension Agreement, agrees to its terms. Each of the Parties whose signature appears below represent that he/she has the authority to enter into this Extension Agreement. 9. All of the terms and provisions of the Collective Bargaining Agreement are hereby adopted and ratified by the Parties hereto and are extended for the term of this Extension Agreement except as may be specifically provided for herein. 10. The Parties agree to begin bargaining for a successive collective bargaining agreement upon written request from either the Union or the City.
