RESOLUTION
APPROVING REIMBURSEMENT TO WYNDHAM DEERPOINT HOMES
FOR THE COST OF OVERSIZING THE WATER MAIN
IN THE TALL OAKS SUBDIVISION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that it
hereby approves the reimbursement in the amount of$100,979.90 to Wyndham Deerpoint Homes for
the cost of oversizing the water main in the Tall Oaks Subdivision from a 12-inch to 1,085 linear feet
of 16-inch diameter and 1,196 linear feet of 24-inch diameter.

OBJECTIVE:
Install oversized water main for planned water distribution system reinforcement and growth.
RECOMMENDATION:
Approve payment to Wyndham Deerpoint for water main oversizing in the Tall Oaks subdivision
in the amount of$100,980.
BACKGROUND

The Water Department Master Plan utilizes a hydraulic modeling program that identifies the
most efficient means to move water through the water distribution system to ensure adequate
flow and pressure. Using the information from this model, the city can identify areas where
there is a need for transmission mains larger than twelve inches in diameter. When a develop-
ment is proposed within the city, staff works with the developer to ensure that appropriately
sized pipe is utilized in accordance with the Master Plan. When it is determined to be necessary
to increase the diameter of a distribution main to a size larger than what is required for distri-
bution to the subject development, the city ordinances require the city to pay the cost for over-
sizing the water main. The developer's amount of reimbursement is determined by the water
director, subject to city council approval.
OPERATIONAL ANALYSIS
The developer, Wyndham Deerpoint, completed the oversized water main in the Tall Oaks Sub-
division in 2007. The oversized water main is comprised of 1,085 linear feet of 16-inch water
main and 1,196 linear feet of 24-inch water main. Attachment A depicts the location of this wa-
ter main. These improvements are presented for council consideration and acceptance under a
separate agenda item for the November 16, 2011 Committee of the Whole meeting.
On August 18, 2011, the developer submitted a request for Reimbursement for Water Main
rok Oversizing—Tall Oaks. The request letter is Attachment B.

FINANCIAL ANALYSIS
Water department staff has thoroughly reviewed the request for reimbursement. That review
included the verification of the costs associated with the oversizing. The cost of the reimburse-
ment to Wyndham Deerpoint totals $100,979.90.

The city council may choose not to authorize staff to reimburse Wyndham Deerpoint for the
water main oversizing as part of the Tall Oaks development.

Re: Reimbursement for Water Main Oversizing—Tall Oaks
Dear Ms.Jacobsen,
This letter is an application for reimbursement by the City of Elgin to Wyndham Deerpoint Homes
in the amount of ,$100,979.90for water main oversizin, in the Tall Oaks Subdivision. You
forwarded an email outlining certain requirements for the reimbursement, a copy of which is
enclosed.
1. The Annexation Agreement does not refer to the reimbursement for oversizing. Our
attorney, Bud Heimberg, confirmed the reason with the City attorney, Bill Cogley. The
requirements for reimbursement are based on a city policy which requires Elgin to reimburse any
watermain oversizing over 12 inches. This can be verified with a call to Mr. Cogley. Please advise
if you require anything additional.
2.The requisite record drawings and electronic copies are enclosed.
3. The water main was increased to 24". Enclosed are bids from Louis Ruffolo & Son
Construction Company.
4. The payment applications, invoices and waivers have been previously submitted to the
City when a reduction was approved for the Letter of Credit.
5. We request that this letter be treated as the pay application for reimbursement. If another
form is required please let us know as soon as possible.
6. Enclosed is a location map for the Water Main extension.
We believe this letter satisfies all of the requirements and request that the reimbursement of these
expenses is included in your budget for the year 2010.November 4, 2011
