RECOMMENDATION: Approve allocation to five grant recipients in the amount of$122,898. BACKGROUND As part of the American Recovery and Reinvestment Act of 2009 (commonly known as the Sti- mulus Bill), the U.S. Department of Energy awarded the city a population-based grant known as the Energy Efficiency and Conservation Block Grant (EECBG) in the amount of $1,002,600. The purpose of the EECBG program is to assist eligible communities in creating and implementing strategies towards energy efficiency, conservation and job creation. The city originally desig- nated $227,600 of the EECBG funding to provide direct matching grants to property owners in the city's downtown to make energy efficient improvements to their buildings. This amount was increased to $232,084 in order to fully fund the ninth downtown program applicant in 2010. In June of 2011, the city council appropriated an additional $120,352.74 to the commer- cial grant and expanded the eligibility to all commercial properties in established TIF districts. Staff first worked with the applicants who were "wait-listed" from the 2010 grant cycle. Of those, two projects were funded in July 2011: 231 Douglas Avenue and 18 Villa Court, for a combined total of$45,335. Remaining funds available for the 2011 cycle total $75,017.74. OPERATIONAL ANALYSIS Staff posted the application online and placed hard copies at the community development de- partment's permit counter for pickup (Attachment A). Staff held two informational meetings on July 14 and July 19, 2011 to answer any questions potential applicants may have had. Approx- imately twenty property owners attended the meetings, and twenty property owners submit- i ted applications (Attachment B), requesting approximately $402,281.07 in financial assistance. A seven person committee scored each application based upon the following criteria: • Completeness of Proposal: Was the requested information submitted with the application? • Potential Energy Savings: What is the current energy usage and projected savings? • Jobs Created: How many construction and permanent jobs would be created? • Matching Funds Provided: Is the applicant looking for other funding opportunities from other agencies such as ComEd and/or Nicor? • A Model for Future Development: Will this project provide a good example for building own- ers that want to make improvements to their structures in the future? Members of the committee included Tom Armstrong, chair of the Downtown Neighborhood Association of Elgin Design Committee; Bruce Dahlquist, principal architect at DLA Architects Ltd. and technical facilitator for the city's sustainability action plan; Aaron Cosentino, sustaina- bility and grants coordinator; Steve Bone, plans examiner; Raoul Johnston, building and devel- opment manager; Marc Mylott, community development director; and, Jennifer Fritz-Williams, historic preservation planner. For each project, all committee member independently awarded between one and five points in each of the above five categories. As such, the maximum score any one project could receive from a committee member was 25 points. The committee mem- bers reconvened to submit their individual scores and the averages were calculated. Staff announced the program through social and print media at the beginning of July. FINANCIAL ANALYSIS The city initially allocated $120,352.74 for the 2011 cycle of the Commercial Retrofit Grant Pro- gram, and $75,017.74 remains available to award to new applicants. The grant program pro- vides matching funds (50 percent of eligible costs) to assist commercial property owners with retrofitting their existing buildings for energy efficiency. Applicants are encouraged to solicit grants and matching funds from other sources. These sources include but are not limited to ComEd, Nicor and Department of Commerce and Economic Opportunity. Applicants must con- tact these companies directly for application requirements. With $75,000 to award, only the first three projects on Table 1 can receive funding. However, staff is requesting that the city council authorize the reallocation of the city's remaining "ad- ministrative funds" under the program to provide two additional grants. The "administrative funds" allocated to the city are intended to reimburse the city for the costs it incurs in administering the grant program. When the grant was written, $100,000 was the maximum amount the city could set aside to recover administrative costs. From the inception of the program through August 2011, the city has only charged $21,943.67 in administrative expenditures. Significant staff work on most projects will be concluding by the end of this year and no administrative expenditures can be reimbursed after October 2012. Staff is calculating that, at most, an additional $30,176 of administrative costs will be incurred prior to the conclu- sion of this program. To ensure that all grant monies are expended, staff is recommending that $47,879.87 be trans- ferred from the "administrative" activity to the "commercial grant" activity. Reallocating the administrative funding will increase the number of commercial retrofit grants that can be funded to five (from the current limit of three). The administrative funding for the grant program has been incorporated into the general fund budget and city council authorization of the reallocation will accordingly reduce general fund revenues by$47,879.87. If the city council authorizes the reallocation, staff will submit an amendment to the city's Ener- gy Efficiency Comprehensive Strategy to the Department of Energy for their review and approv- al on this budget transfer. ALTERNATIVES 1. The city council may choose to reject the recommended list of selected recipients of the grant program. However, the city has an obligation to encumber all funds by October 15, 2011. Rejecting all applicants and starting the selection process over would cause the city to miss this deadline. 2. The city council may choose to revise the recommended list of selected recipients of the grant program. 3. The city council may choose to reallocate all funding for the 2011 Commercial Retrofit Grant Program to another project that meets the requirements of the EECBG program. NEXT STEPS 1. Staff will have each grant recipient sign a legal agreement before starting work. 2. Upon completing work, recipients will be required to submit updated energy usage data and work hours of the contractors completing the project. 3. Staff will report back to the city council the total energy savings and jobs created by this program. 4. The purpose of the EECBG program is to assist eligible entities in creating and implementing the following strategies: • Reduce fossil fuel emissions in a manner that is environmentally sustainable and, to the maximum extent practicable, maximizes the benefits for local and regional communities; • Reduce the total energy use of the eligible entities;and • Improve energy efficiency in the building sector, the transportation sector, and other appropriate sectors. The City of Elgin has established the Commercial Retrofit Grant program with funding from the EECBG. This grant program provides matching funds (50% of cost up to but not to exceed $40,000) to assist commercial property owners with retrofitting their existing buildings for energy efficiency. 1.2 Eligible Persons & Buildings To be eligible to receive EECBG funding, a project must improve the energy efficiency of a commercial building located within the Center City (specifically, within a CC1 or CC2 Center City zoning district) or within a designated TIE district of Elgin. A Zoning Map and a TIF District Map are available within the Community Development Map folder at the following website: http://www.cityofelgin.org/documentcenterii.aspx. Only those persons owning, or having a controlling interest in, such buildings may apply for and shall be eligible to receive an EECBG grant. 1.3 Eligible Activities More so, EECBG funds can only be used for eligible activities as defined by DOE regulations. Types of projects that may be eligible for funding under the EECBG Program are described below. 1. Energy efficiency retrofits including but not limited to the following: a. Heating: Replacing boilers, central heat pumps,etc. b. Cooling: Condensers,window units, etc. c. Lighting: Replacing lamp ballasts, replacing fixtures, reduction in units, passive solar, occupancy sensors, etc. d. Refrigeration: Air curtains, fan control, snack machine controls, beverage machine controls, LED case lighting, etc. e. Water Reduction: Low flow faucets, dual-flush toilets, etc. f. Windows: Repair and Replacement g. Insulation: Adding insulation to roofs and walls to lower heating and cooling losses. This includes painting rooftops white. 3 1.4 Program Implementation and Project Monitoring All EECBG fund recipients are required to enter into a sub-recipient agreement with the City of Elgin to ensure compliance with federal requirements and regulations. The project scope of work, responsibilities of each party, documentation and reporting requirements, frequency, and method of on-site monitoring visits are outlined within the context of the agreement. For reporting purposes, each recipient must maintain records of the hours worked on the job as well as energy saved. The implementation of projects funded through the EECBG Program must be timely. Projects must be started within 6 months following the execution of the sub-recipient agreement. The City will monitor recipient activities through internal controls, project progress reports, clientele records/reports, and/or on-site monitoring visits. On-site monitoring visits are conducted at the completion of projects. Compliance with sub- recipient agreements and DOE regulations is confirmed during these visits. City staff works with recipients to ensure compliance with City, State, and Federal regulations as they relate to project documentation, the bidding process, purchase of equipment/materials, and the disbursement of funds. The performance of each EECBG project is measured by analyzing project goals and achievements. Each recipient identifies and quantifies the anticipated benefits that will result from their project. The reporting process assists in gauging the actual productivity and effectiveness of each EECBG project. 1.5 Davis-Bacon Act and other various regulations The EECBG Program requires that all work completed on buildings owned by"non-individuals"comply with the Davis-Bacon Act, Buy American Clause, and Waste Management Plan of ARRA. Grant recipients and their contractors will be required to submit certified payroll (Form WH-347)to confirm prevailing wage is paid for all work completed under the grant program. ARRA also requires that all equipment installed must be made in the USA. Documentation must be provided by the contractors during the bid process. All waste material removed from the site must be disposed of in accordance with all applicable local, state, and federal laws, regulations, and statutes. Contractors awarded work will be required to sign a waiver at the end of the job that they have complied with this waste disposal requirement. 1.6 Selection Process All applications submitted by August 19, 2011 will be reviewed and ranked by a committee of city staff and residents in accordance with the section 1.7 below. This committee will forward this list of ranked applications to the Elgin City Council,which will make the final decision regarding the award of grants. . 1.7 Criteria for Selection Applications will be awarded between one and five points within each of the following criteria: 1. Energy Saved. Applicants are asked to provide 12 consecutive months of past utility usage and project the reduction in utility usage after the scope of work is completed. 2. Jobs Created. Applicants are asked to identify the proposed hours necessary to complete the scope of work funded through this program. 4 3. Matching Funds. Applicants are highly encouraged to solicit grants and matching funds from other sources, including but are not limited to ComEd, Nicor, and the Illinois Department of Commerce and Economic Opportunity (DCEO). Applicants must contact these companies and/or agencies directly for their application requirements. 4. Application Completeness. Applications that are incomplete or missing required information will not be scored as highly in this category as those that are complete and provide all requested information. 5. Example/Case Study of Future Projects. Applicants are asked to describe the extent to which their project could be used for educational purposes and/or as a case study for other persons considering similar scopes of work. 1.8 Technical Assistance The Community Development Department staff is available to assist any person or organization interested in developing a project proposal to be considered for EECBG funding. Staff will answer questions, review proposed projects, and provide other technical assistance to help with the submittal of a proposed project. Project Scope and Purpose: Prepare a detailed written statement describing the project being proposed, how EECBG funds would be spent, and the need for the proposed project. 2. Energy Saved: Submit at least 12 consecutive months of all utility bills. Identify projected reduction in utility usage and explain how the energy saved will be measured or quantified. 3. Jobs Created: Bids submitted by contractors should identify proposed hours to complete the work. 4. Project Cost Estimate. Submit at least two contractor-prepared cost estimates for each phase of the proposed project. Complete the project cost estimate table attached to the application form. 5. Davis-Bacon/Buy American: Submit documentation that prevailing wage will be paid for all work completed on buildings, and that all equipment proposed to be installed is made in America (if applicable). 6. Other Project Funding Sources and Amounts: Identify any additional funding sources for this project. Specify the amount of funds from these sources and when the funds will be available. Complete the funding sources table attached to the application form. 7. Time-line for Project Implementation: Prepare a time-line showing when activities that are funded by the grant will be conducted along with their proposed completion dates. 8. Plans and specifications. Attach plans and specifications for construction, rehabilitation, and equipment needed to conduct the project. 9. COMPLETENESS OF PROPOSAL The applicant submitted most of the required documentation except for one cost estimate for the lighting and a few utility bills were missing. PROJECT SUMMARY The new owners of the building are proposing to rehabilitate the interior and exterior of the structure. The building is two floors,approximately 1368 sq.ft, and is currently occupied by Studio 39. Window and Door Replacement:The window scope of work includes removing the six windows on the first floor only at both entrances, installing new double-paned insulated custom windows to fit the original openings,caulking,and installing brick molding as necessary. The three exterior doors will be replaced. HVAC:All existing equipment, ductwork, and mercury thermostat will be removed. The new furnace will be 92%AFUE with zone control. New ductwork, new programmable thermostat, and a 16 SEER 2 stage A/C unit will also be installed. Plumbing:One restroom will be retrofitted with dual flush toilet and low flow faucet.A new energy star 4111)rated water heater will be installed. Insulation:There is currently no effective roof or wall insulation. The exterior walls of the building will be demolished to expose the structure, remove deteriorated wall insulation, and reinstall new wall and roof insulation to meet or exceed 2006 International Energy Conservation Code requirements.
