11-0201 State of Emergency Proclamation COVERSHEET Agreement/Document Attached Document Name in Laserfiche: 11-0201 State of Emergency Proclamation MAYORAL PROCLAMATION DECLARING A STATE OF EMERGENCY WHEREAS, Chapter 2.76 of the Elgin Municipal Code, 1976, as amended, authorizes the mayor to declare a state of emergency by written proclamation when conditions constituting a disaster or emergency exist; and WHEREAS, Section 2.76.020 of the Elgin Municipal Code, 1976, as amended, defines a disaster as "an occurrence or imminent threat of widespread or severe damage, injury, or loss of life or property resulting from any natural, technological or human-made cause including fire, flood, earthquake, windstorm, wave action, oil spill or other contamination, radioactive incident, epidemic, air contamination, blight, drought, infestation, explosion, riot, hostile or paramilitary action, or structure failure of a dam, building or infrastructure, or other public calamity requiring emergency action;" and WHEREAS, Section 2.76.020 of the Elgin Municipal Code, 1976, as amended, defines an emergency as "any human-made, technological or natural event or circumstance causing or threatening loss of life, injury to persons or property, human suffering or financial loss including but not limited to fire, explosion, flood, severe weather, drought, earthquake, volcanic activity, spills or releases of petroleum products or other hazardous material, contamination, utility or transportation emergencies, disease, blight, infestation, civil disturbance, riot, sabotage and war;" and WHEREAS, Section 2.76.020 of the Elgin Municipal Code, 1976, as amended, defines a state of emergency as "a situation which involves an emergency or a disaster;" and WHEREAS, weather forecasts as of February 1, 2011, are predicting a hazardous blizzard for February 1 and February 2, 2011, with forecasts of up to twenty inches of snow and wind gusts of up to sixty miles per hour creating whiteout conditions and potentially making vehicular travel nearly impossible in the City of Elgin; and WHEREAS, the mayor has determined that such blizzard conditions constitute an emergency in the City of Elgin and represent an imminent threat to the public health, safety and welfare; and WHEREAS, the mayor has determined that conditions constituting an emergency or disaster are presently existing in the city. NOW, THEREFORE BE IT RESOLVED BY THE MAYOR OF THE CITY OF ELGIN, ILLINOIS that a state of emergency within the City of Elgin, Illinois, is hereby declared, effective February 1, 2011, at 1:00 p.m. The nature of the emergency or the disaster and the findings of fact substantiating the existence and nature of the emergency or disaster are that current weather forecasts predict a hazardous blizzard for February 1 and February 2, 2011, with forecasts of up to twenty inches of snow and wind gusts of up to sixty miles per hour creating whiteout conditions and potentially making vehicular travel nearly impossible in the City of Elgin. The amount and rate of the predicted snowfall along with the associated high winds are expected to create dangerous conditions endangering the public health, safety and welfare including, but not limited to: (1) preventing vehicular travel for the general public; (2)potentially limiting vehicular operations of public safety personnel; (3) creating the possibility of downed trees; and (4) creating the possibility of downed power lines interrupting electrical service in the city. In response to the emergency or disaster, the mayor has determined that it is necessary to exercise the following powers conferred upon him pursuant to Section 2.76.040 of the Elgin Municipal Code, 1976, as amended: 1. The city manager or the city manager's designee is hereby authorized pursuant to Elgin Municipal Code Section 2.76.120 to procure by purchase or lease, such goods, services and equipment as are deemed necessary for the city's emergency response effort to the declared emergency. 2. The city manager, or the city manager's designee is authorized and empowered to barricade streets and prohibit vehicular or pedestrian traffic, or regulate the same on any public street leading to an area designated as an emergency area for such distance as may deem necessary under the circumstances. THIS PROCLAMATION shall remain in full force and effect until withdrawn by the mayor. He is the duly elected Mayor of the City of Elgin, Illinois. 2. He has reviewed the attached proclamation declaring a state of emergency and its attendant description of the nature of the emergency and the findings of fact relating to the emergency. 3. The nature of the emergency and the findings of fact regarding that emergency as set forth in the attached proclamation declaring a state of emergency constitute an emergency or disaster within the meaning of Chapter 2.76 of the Elgin Municipal Code, 1976, as amended. 4. The powers being invoked in the attached proclamation declaring a state of emergency are being exercised in the interest of the health, safety and welfare of the City of Elgin and its residents in response to the emergency at hand.
