RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
SINNETT BUILDERS, INC. FOR THE BOWES ROAD SALT STORAGE
FACILITY SITE WORK PROJECT
WHEREAS, the City of Elgin has heretofore entered into a contract with Sinnett Builders,
Inc. for the Bowes Road Salt Storage Facility Site Work Project; and
WHEREAS, it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that Sean R, Stegall, City Manager, be and is hereby authorized and directed to
execute Change Order No. 1,a copy of which is attached hereto and made a part hereof by reference.

CHANGE ORDER No. 1 AND FINAL
CONTRACT: Bowes Road Salt Storage Facility Site Work(Bid No. 08-079)
SCOPE: This change order will provide for the funding to decrease contract quatities and will add sev-
eral line items and quantities to address conditions discovered during construction. The project re-
quired minor work not originally included in the contract such as removal of a construction entrance,
adjustment of a storm inlet and water usage for landscaping. Additional items of significant nature in-
cluded stabilizing the site to support the new building and the parking lot as well as pavement patching
between the new building and the completed parking lot. The additional work was unforeseen at the
time the contract was originally awarded.
This change order affects a contract between the City and Sinnett Builders, Inc. dated June 24, 2008 for
the Bowes Road Salt Storage Facility Site Work Project.
REASONS FOR CHANGE: Change Order No. 1 is in the best interest of and requested by the City
and is authorized by law. The necessity for the change was not foreseeable at the time the contract was
originally executed. The changes contemplated in Change Order No. 1 are germane to the original
agreement as signed.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The original contract will be amended as
to scope and costs to address poor soil conditions, provide additional pavement and make minor adjust-
ments.

The original amount of the contract with Sinnett Builders, Inc. is $310,400.00. Change Order No. 1 will
increase the original contract amount by a total of $10,031.70, that sum representing three percent
(3.0%) of the original contract amount. The new contract amount, inclusive of all change orders is
$320,431.70.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.

PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider Change Order No. 1 and Final for the Bowes Road Salt Storage Facility
Site Work Project.
RECOMMENDATION
It is recommended that the City Council approve Change Order No. 1 and Final with Sinnett
Builders, Inc., for the Bowes Road Salt Storage Facility Site Work Project in the amount of
$10,031.70,with a final contract value of$320,431.70.
BACKGROUND
On September 24, 2008, the City Council awarded the subject project to Sinnett Builders, Inc.
for the site improvements related to the salt storage facility on Bowes Road. The salt storage
building was constructed by another contractor. The building is a barn style structure with a site
designed to make the finished facility blend in with the surrounding areas as much as possible.
The attached change order includes contract deductions, several minor additions and one major
addition. The major addition involved the stabilization of the site prior to constructing the
parking lot and the building due to poor soil conditions. The stabilization was completed with a
fly-ash compound which is sometimes found in concrete designs. The attached change order
includes further explanation of added items. The change order represents a three percent
increase in the total contract amount from the original and awarded amount.

this change order is available in the Riverboat Fund, account number 275-0000-791.92-36,
"Capital Additions-Buildings and Structures," project number 339896, "Salt Storage Facility",
with$970,060 budgeted and$62,454 available.
