The city, in its sole dis- cretion, may at any time and for any reason, choose to expand or reduce the number of qualified firms selected for the towing rotation program; modify the conditions and pro- cedures for participating in the towing rotation program; extend, shorten or otherwise change the duration of any rotation; add or remove a qualified firm from the towing rota- tion program; or, discontinue the towing rotation program. Because a towing firm may be added to or removed from the towing rotation program without any limitation at the city's sole discretion, a towing firm accepted into the city's towing rotation program shall not be conferred with any property interest, vested right, or other continuing protectible interest in participating in the towing rotation program. A towing firm participating in the city's towing rotation program will not receive a contract for services from the city, and that towing firm may choose to discontinue its participation in the city's towing rotation program for any reason at any time. The towing rotation program shall begin on April 1, 2009 at 12:01 a.m. Rotations be- tween any designated towing firms will initially be made every two (2) weeks, but the duration of any rotation may be shortened, extended or discontinued at the city's sole discretion. A primary and secondary towing firm may be designated for each rotation. Following the deadline for submitting an application for participation in the in the city's towing rotation program, the city will conduct an investigation to determine the truth and accuracy of the information contained in each timely submitted application. Upon com- pleting an investigation of the facts submitted on an application for participation in the city's towing rotation program, the city will designate those towing firm applicants that are qualified and have been selected for participation in the city's towing rotation pro- gram. The number of towing firms selected for participation in towing rotation program shall be subject to the sole discretion of the city; there is no guarantee that every towing firm meeting the minimum qualifications for participation in the towing rotation program will be selected for participation by the city. The city's towing rotation program is intended to ensure that tow trucks or other similar vehicles operated by designated towing firms approved in conjunction with this request for application process are called to the scene of an accident or called to impound vehi- cles on a rotating basis. The city, however, retains the sole discretion to call a towing firm out of sequence from the rotation program for any reason it deems appropriate in order to properly respond to a demand for service. MAXIMUM FEES FOR TOWING SERVICES No towing firm participating in the city's towing rotation program may charge rates for services rendered that are greater than the fees set forth in the list below. The maxi- mum fees set forth below shall be in effect until further notice from the city. Maximum Fees for Public Safety and Ordinance Offense Police Tows Maximum charges to the vehicle owner for the following towing services performed at the direction of the city shall be as follows: Passenger cars and trucks less than 12,000 Ibs /GVW (motorist assist): $75.00 Passenger cars and trucks less than 12,000 Ibs /GVW involved in a collision: $125.00 Passenger cars and trucks less than 12,000 Ibs /GVW towed pursuant to arrest $100.00 Or impoundment Medium -duty vehicle (12,000- 33,000 Ibs /GVW) tow: Medium -duty vehicle (12,000 - 33,000 Ibs /GVW) recovery: Trucks over 15,000 Ibs. GVW factory rated capacity, to include van and pick -ups: 8100.00 Trucks over 15,000 lbs. GVW, but less than 45,000 lbs. GVW: $95.00 per hour (1.5 hour minimum charge) The city will issue a certificate of purchase for unclaimed, abandoned vehicles that have been held in the lawful place for the time period prescribed by law. The towing firm shall accept a valid certificate of purchase from the city at no cost in exchange for the towing and storage charges that have accrued on the unclaimed, abandoned ve- hicle for which the certificate of purchase has been issued. Unless otherwise provided herein, a towing firm participating in the city's towing rotation program shall not seek to recover any costs from the city for any service provided under the city's towing rotation program. 3. A towing firm participating in the city's towing rotation program shall store at no cost to the city any vehicle that has seized by the city's police department and towed to the towing firm's vehicle storage area. A towing firm seeking to participate in the city's towing rotation program shall provide the following information in its application: a. Name, address, legal status (e.g., corporation, partnership) and owners, partners or stockholders. Years in business providing towing - related services. C. A minimum of three references, including organization name, con- tact person, phone number and time frame of contract. Page 4 of 12 d. Certificates of insurance, naming the "City of Elgin, Illinois" as an additional insured, as follows: Worker's Compensation: Statutory limits ii. Garage Liability: $500,000 per occurrence/ $1 million aggre- gate iii. Garage On -Hook Liability: $225,000 iv. Automobile Liability: Bodily Injury: $500,000 Property Liability: $100,000 e. Name and addresses of all full -time and part-time employees. The principal location and any additional location of the towing firm, including all storage sites to be used (collectively, the "towing facili- ties"), and the maximum capacity in number of cars for each vehicle storage site. The towing firm must state whether the towing facilities are owned by the towing firm or are being leased. The towing firm must provide the city with proof of ownership of the towing facilities it will be using in conjunction with the city's towing rotation program. If the towing facilities are being leased by the towing firm, a copy of the most recent lease for the towing facility shall be provided to the city. g. Provide documentation that the towing facilities are lawfully operat- ing in the municipality or county in which the vehicle storage site is .located. h. A statement describing any additional towing agreements or obliga- tions the towing firm may have that require the use of the towing firm's towing fleet or the vehicle storage site(s) that will be used during participation in the city's towing rotation program. A copy of the towing firm's most recent financial statement. 5. The towing firm shall allow the city to inspect its equipment, the business prem- ises and records and shall furnish any additional information deemed necessary by the city in order to evaluate the application for participation in the city's towing rotation program. Page 5 of 12 SPECIFICATIONS AND QUALIFICATIONS The city, in its sole discretion, may choose to expand or reduce the number of qualified firms selected for the towing rotation program, may modify the condi- tions and procedures for participating in the towing rotation program and may add or remove a qualified firm from the towing rotation program at any time for any reason. A towing firm participating in the city's towing rotation program will not be receive a contract for services from the city, and that towing firm may choose to discontinue its participation in the city's towing rotation program for any reason at any time. 2. Any towing firm seeking to participate in the city's towing rotation program shall satisfy each of the following qualifications: The towing firm must be actively engaged in the provision of towing serv- ices for motor vehicles and must have been actively engaged in the provi- sion of towing services for motor vehicles for a period of at least six con- secutive months prior to the date of this application for participation in the city's towing rotation program. The towing firm must have in full force and effect policies of insurance naming the city "an additional insured" as follows: Worker's Compensation: Statutory Limits ii. Garage Liability: $500,000 per occurrence/ $1 million ag- gregate iii. On -Hook Liability: $40,000 iv. Automobile Liability: Bodily Injury: $500,000; Property Liability: $100,000 C. The towing firm must own or lease a location for the lawful storage of towed vehicles that is located within the city or within one -half mile of the city's corporate boundaries. The vehicle storage site must include a paved surface of not less than one acre which is capable of storing three hun- dred (300) vehicles. The vehicle storage site must be completely enclosed with solid fencing of not less than (6) feet in height that includes a locking gate. The vehicle storage site must be fully illuminated by artificial light from dusk until dawn. The vehicle storage site must also include a fully enclosed and secure area capable of storing vehicles designated with a "police hold" while police investigations relating to the vehicle are pending. Page 6 of 12 Vehicles on police hold may be stored for extended periods at time within the fully enclosed and secure area on the towing firm's property at shall be stored for such time at no cost to the city. d. The vehicle storage area must fully comply with all applicable ordinances and statutes. Any vehicle storage area located within the city must addi- tionally comply with all current provisions of the Elgin Zoning Ordinance (Title 19 of the Elgin Municipal Code, 1976, as amended). A vehicle storage area (referred to as "motor vehicle impoundment yard" under the Elgin Zoning Ordinance) located within the city that constitutes a lawful nonconforming use shall not be eligible for participation in the city's towing rotation program. e. All vehicle storage areas shall be inspected by the city prior to the towing firm being selected for participation in the city's towing rotation program. The towing firm's owner any of his or her staff shall not have been con- victed of any offense dealing with the possession or sale of stolen vehicles or parts thereof within the five (5) years immediately preceding the date of this application. g. The towing firm shall be in compliance with all city, state and federal laws regulating the conduct, qualifications, and operation of towing companies and their employees. h. The towing firm must have, at a minimum, the following hours of opera- tion: Monday — Friday: 8:00 a.m. — 6:00 p.m. Saturday: 8:00 a.m. —12:00 p.m. Sunday and Holidays: 10:00 a.m. —1:00 p.m. The towing firm must own or lease and fully operate not less than ten (10) tow vehicles designed and equipped for the towing of motor vehicles. Not less than two (2) of the towing firm's ten (10) tow vehicles shall be capable of towing a vehicle with a minimum gross vehicle weight rated capacity of 32,000 thousand pounds. Not less than six (6) of the towing firm's ten (10) tow vehicles shall be flatbed trucks with wheel lifts. Not less than one (1) of the towing firm's ten (10) tow vehicles shall be a low- clearance, light - duty wheel lift with dollies. Each tow vehicle shall also meet the following specifications: Page 7 of 12 The towing firm's business name, address or telephone number shall be prominently and permanently disp ayed on both sides of each tow vehicle. ii. The towing firm's tow vehicles shall be maintained to compliance with city ordinance the laws of the State of Illinois and any other applicable statutes or regulations. iii. The towing firm's tow vehicles shall be equ pped with the following supplies: red flares, lanterns or reflectors, Icrowbar, rope, broom, shovel, dustpan, oil dry or similar material f r absorbing fluids such as oil and gas. The towing firm shall be qualified under Illinois law used parts dealer or scrap processor. CONDUCT AND PERFORMANCE REQUIREMENTS All towing firms in the city's towing rotation program shall cond diligent, ethical, careful and courteous manner and consisten quirements: a rebuilder, repairer, :t their operations in a with the following re- 1. Towing services for vehicles towed pursuant to an emergency tow shall be available on a twenty -four (24) hour basis including Sundays and holidays. Towing services for vehicles towed for other than an emergency tow shall be available during normal weekday working hours. 2. The towing firm shall indemnify any and all persons, firms, or corporations, including the city, for any loss sustained by any unlawful or unauthorized damage to any vehicle which is removed or stored pursuant to the terms of the city's towing rotation program. 3. The towing firm shall post and maintain in good rpair, signs depicting the rates and charges set by the city in a conspicu us place to the towing firm's principal office and the towing firm's vehicle storage area. 4. The towing firm shall provide qualified drivers, fuel, maintenance, repairs, permits, insurance, and any other items of exper{lse or equipment neces- sary to render towing service. The towing firm called to provide towing services shall assist in cleanup work at the scene of the occurrence under the direction of the city's police department. Such cleanup shall include broom - sweeping the street of bro- ken glass and removal of loose debris. Page 8 of 12 6. Upon notification by the city's police department of the need for towing services, the towing firm so notified shall immediately dispatch a tow truck to the designated location. After receiving notification from the city's police department, the towing firm's maximum response time shall be as follows: a. Emergency Tows 20 minutes — between 7:00 a.m. and 11:00 p.m. 30 minutes — between 11:00 p.m. and 7:00 a.m. b. Abandoned Vehicles and Other Tows Twenty-four (24) hours, however, the towing firm shall contact the city's police department prior to dispatch in order that police de- partment personnel may be present at the time of removal. Unless otherwise authorized, no abandoned vehicle may be re- moved without the city police department personnel being present at the scene. 7. The towing firm shall bear the sole responsibility for the safekeeping of all personal property and vehicle accessories contained in or upon any vehi- cle that is towed at the request of city's police department. The towing firm shall be responsible for damage to vehicles while in its possession. 8. The towing firm shall maintain complete logbooks and records of all tows and such book shall be open at all times to inspection of the city's police department. 9. No vehicle shall be released without the express authorization of the city's police department. When a vehicle is claimed by its owner, the towing firm shall provide an itemized statement of all charges made for towing and storage of the vehicle and, upon release, the towing firm shall obtain from the vehicle's owner a complete receipt for the vehicle and all personal property and shall promptly provide the city's police department with a copy of the same. 10. The towing firm may dispose of unclaimed vehicles only in the manner provided by the Illinois Motor Vehicle Act. The towing firm shall periodi- cally conduct public auctions and cause vehicles in its possession to be sold. 11. Stored motor vehicles shall be available for inspection from Monday through Friday (excluding holidays) during the hours of 8:00 a.m. to 6:00 p.m., and on Saturdays (excluding holidays) from 8:00 a.m. to 12 p.m. 12. All city vehicles, with the exception of fire trucks, shall be towed by the towing firm at no cost to the city. Page 9 of 12 11 The towing firm shall provide the city on or before the tenth day of each month, an inventory listing all vehicles that are currently being stored in its vehicle storage facility as of the ending date of the immediately preceding month. 14. The towing firm shall obey all city, state and federal laws relating to the towing business, including the operation and equipment of towing vehi- cles, the storage and disposal of towed vehicles and the licensing of em- ployees. 15. The towing firm shall store all vehicles that have been towed in a secure lot meeting the requirements of this request for application and all other city ordinances (subject to the exceptions noted above), and shall make reasonable efforts to safeguard such vehicles and their contents. Pro- vided, however, that vehicles impounded by the city's police department for special investigations ( "police hold ") shall be securely held in a fully enclosed, interior area on the towing firm's property and such vehicles and their contents shall not be removed until cleared by the city's police de- partment. 16. The towing firm shall observe and obey such rules and regulations as are hereafter established by the city and shall follow all reasonable city police department orders or instructions at incident scenes. 17. Only tow vehicles owned and operated by the towing firm shall be dis- patched to the scene of need. 18. The towing firm shall be responsible for the acts of its employees while on duty. 19. All vehicles stored or impounded as a result of a tow ordered by the city's police department shall be made available to the city's police department, the owner of the vehicle or his representative, any insurance agent, insur- ance adjuster, or any body shop or car dealer, for the purpose of estimat- ing or appraising damages, with the exception of vehicles designated with a "police hold." Vehicles with a "police hold" shall be accessible and avail- able only to city police department personnel. 20. The towing firm shall not make any repairs or alterations to a vehicle, ex- cept as necessary to permit the vehicle to be towed and /or stored, without first being authorized by the owner of the vehicle, or the vehicle owner's employee or agent. 21. At no time shall the towing firm's vehicle storage lot be filled to more than ninety percent capacity. Should the towing firm's vehicle storage area ex- Page 10 of 12 ceed ninety percent of its capacity, the city may choose to suspend towing services to that towing firm until such time as the number of said vehicles in said lot is reduced to within the required maximum capacity. 22. The towing firm shall tow and release vehicles in accordance with section 11.40.095 of the Elgin Municipal Code, 1976, as amended (Vehicle Sei- zure and Impoundment). 23. The towing firm shall change flat tires on police vehicles located with in the city's corporate boundaries at no cost to the city during the following dates and times: Monday through Friday, between 3:00 p.m. to 10:00 p.m.; Sat- urdays, Sundays and holidays, between 7:00 a.m. to 10:00 p.m. (Flat tire repairs are infrequently requested.) The towing firm may charge not more than $50.00 to change flat tires on police vehicles located within the city's corporate boundaries outside of the "no cost" designated dates and hours. 24. Each towing firm shall relocate vehicles for special events conducted by the city, including but not limited to the 4th of July Parade, an annual bicy- cle road race and an annual foot race. 25. The towing firm must be listed in the local telephone book and have a sign in front of its place of business that comports with the city's sign ordi- nances. NO CONTINUING INTEREST IN PARTICIPATING IN TOWING ROTATION PRO- GRAM The city, in its sole discretion, may choose to expand or reduce the number of qualified firms selected for the towing rotation program; modify the conditions and procedures for participating in the towing rotation program; extend, shorten or otherwise change the duration of any rotation; add or remove a qualified firm from the towing rotation program at any time for any reason; or, discontinue the towing rotation program. It is a large 2.5 acre plot with a 7500 square foot building. Our lot is secured with an electric gate and 6 foot privacy fencing, which can hold 500 vehicles. There is ample room inside the heated building to store vehicles out of the elements for investigations. Our Facility is manned 24/7 by no less than 2 employees and a K9 patrol dog. Closed circuit cameras cover all areas all the time. This tragic crash resulted in multiple injuries and one fatality. The entire intersection for both roadways had to be closed down for several .hours in extremely cold temperatures to secure the scene and to allow fire rescue personnel access to the crash, investigators to gather evidence, to speak with witnesses and for the eventual clean up to begin. To assure the safety of those involved in the crash, as well as that of all the first responders, we asked for and received the assistance from several agencies. I would like to formally acknowledge that the assistance provided by your agency was very much appreciated by our officers on scene and I would like to take this opportunity to thank you and members of your agency for rendering that assistance. Although it is unfortunate that this tragic incident occurred, it is reassuring to know that we are here for each other when such times arise and when assistance is requested to provide the excellent public safety services that our communities not only deserve, but have grown to expect.
