RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
SINNETT BUILDERS, INC. FOR ELGIN SHORES FOREST PRESERVE
PARK IMPROVEMENT PROJECT
WHEREAS, the Citycof Elgin has heretofore entered into a contract with Sinnett Builders,
Inc. for Elgin Shores Forest Preserve Park Improvement Project; and
WHEREAS, it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Olufemi Folarin,City Manager,be and is hereby authorized and directed to
execute Change Order No. 1,a copy of which is attached hereto and made a part hereof by reference.

SUBJECT: Elgin Shores Change Order No. 1 with Sinnett Builders Inc.
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider authorization of Change Order No. 1 with Sinnett Builders, Inc. for the
Elgin Shores Forest Preserve park improvement project.
RECOMMENDATION
It is recommended that the City Council approve the execution of Change Order No. 1 with
Sinnett Builders, Inc. for the Elgin Shores Forest Preserve park improvement project for a total
of$75,260.
BACKGROUND
In September of 2007, the City entered into a contract for $569,000 with Sinnett Builders to
construct phase I of the Elgin Shores Forest Preserve park improvements, which included site
grading, roadway and parking lot improvements, wetland restoration, natural landscaping and the
installation of a boat launch.
During the course of the construction, which is 90% complete, a number of issues surfaced that
required change orders. The project is partially funded through an Open Space Land Acquisition
and Development Grant and these outlined change orders have been approved and accepted by
the Illinois Department of Natural Resources.
The first item listed in the change order is related to unsuitable soils present in the area that the
boat ramp was to be constructed. Although the original contract did include an allowance for the
removal and fill of unsuitable soils,the actual quantity turned out to be larger then the allowance.
The cost for the additional undercut and fill is $3,500.
The second item listed in the change order is infrastructure work related to phase II of the
project, which will include the playground, shelter, batting cages and boat dock. It includes
under drainage and concrete work for the playground, paving for the batting cages and a paved
drive. The cost for these improvements is $27,000.

The third item listed in the change order is related to the excavated material that was hauled to
the Highlands phase II site. Based on the recommendation from the Highlands site engineer, a
bull dozer and operator were brought onto the site to spread the soil hauled from Elgin Shores,
after it was dumped on the golf course site. The cost for the operator and equipment to spread
the excavated material was $19,800.
The last item in the change order is for additional soil erosion blankets for the detention areas
and was required by Kane Dupage Soil and Water Conservation Service. The total cost for the
erosion control blankets is $24,960.
The net increase for Change Order# 1 is $75,260. A copy of the change order is attached.

FINANCIAL IMPACT
The total cost for Change Order No. 1 with Sinnett Builders, Inc is $75,260. There are sufficient
funds budgeted ($880,000) and available ($85,631) in the Riverboat Fund, account number 275-
0000-791.92-37, "Park Development and Acquisition," project number 509670, "Elgin Shores"
to fund this change order.
LEGAL IMPACT
None
ALTERNATIVES
1. The Council may choose to approve Change Order No. I with Sinnett Builders for
$75,260 as recommended.
2. The Council may choose to not approve Change Order No. 1 with Sinnett Builders for
$75,260 as recommended.
