RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
SCHAEFGES BROTHERS, INC. FOR FESTIVAL PARK PHASE II PROJECT
WHEREAS,the City of Elgin has heretofore entered into a contract with Schaefges Brothers,
Inc. for Festival Park Phase II Project; and
WHEREAS, it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Olufemi Folarin,City Manager,be and is hereby authorized and directed to
execute Change Order No. 1,a copy of which is attached hereto and made a part hereof by reference.

"ORIGINAL CONTRACT: The original contract with Schaefges Brothers, Inc., dated May 10,
2006, for the construction of Festival Park Phase IV'
"SCOPE: This Change Order No.I will compensate Schaefges Brothers, Inc., for work related to
performance improvements and additional issues unforeseen at the time the original contract was
signed. The additional issues are as follows:
Additional electrical work that was necessary for the project. $ 75,376
Under ground storage tank removal. $ 17,757
Landscaping $ 15,313
Building modifications $ 4,055
Playground surfacing ($ 3,200)
Total Requested Change Order. $109,301"
"REASONS FOR CHANGE: This Change Order No. 1 is in the best interests of the City of
Elgin and is authorized by law. The necessity for the changes was unforeseen at the time of the
original agreement, and the changes contemplated hereby are germane to the original agreement."
SUMMARY OF CHANGES in CONTRACT AMOUNT: The Schaefges Brothers, Inc. Contract
Amount will be revised as follows:
Original Contract: $4,351,520
Change Order#1 $ 109,301
New Total Contract Amount $4,460,821
OTHER CONTRACT PROVISIONS:All other contract provisions shall remain the same.

SUBJECT: Change Order No. 1 for Festival Park Phase II Project
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider a change order with Schaefges Brothers Inc. for construction of the
Festival Park Phase II Project.
RECOMMENDATION
It is recommended that the City Council approve Change Order No. 1 with Schaefges Brothers
Inc. in the amount of$109,301 for the Festival Park Phase II Project
BACKGROUND
On May 10, 2005, Schaefges Brothers was awarded the contract in the amount of$4,351,520 to
construct Phase II of Festival Park. During the construction of Festival Park Phase II,
performance improvements and additional unforeseen issues were encountered necessitating
changes to the original contract. These issues concerned under ground tank removal, electrical
system changes, building modifications and additional site work to complete the project. Details
of the additional work can be found in the attached change order document.
Hitchcock Design Group designed and provided project management for Festival Park Phase II.
Some of the electrical work items in the change order were related to design issues with the
original construction documents. An amendment to Hitchcock Design Group's agreement will
be coming to Council at a future date deducting $26,016.47 from their final payment.
The total cost for Change Order No. 1 is $109,301. The new contract amount for Schaefges
Brothers Inc. is $4,460,821.

FINANCIAL IMPACT
The original contract amount for Schaefges Brothers Inc. is $4,351,520. The cost of Change
Order No. 1 is $109,301. The total project budget is $10,343,433. Funds for this payment are
available in the Riverboat Fund, account number 275-0000-791.92-35, "Riverfront/ Center City
Improvements," project number 039520 "Festival Park" ($5,893,584 budgeted and $254,963
available).
LEGAL IMPACT
None
ALTERNATIVES
1. The City Council may choose to award the Change Order No. 1 to Schaefges Brothers
Inc. in the amount of$109,301.
2. The City Council may choose not to award the Change Order Number 1 to Schaefges
Brothers Inc. in the amount of$109,301.
