RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
MARTAM CONSTRUCTION, INC.
FOR THE 2008 NEIGHBORHOOD RESURFACING-WING PARK
BOULEVARD PROJECT
WHEREAS, the City of Elgin has heretofore entered into a contract with Martam
Construction, Inc., for the 2008 Neighborhood Resurfacing-Wing Park Boulevard Project; and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Olufemi Folarin,City Manager,be and is hereby authorized and directed to
execute Change Order No. 1,a copy of which is attached hereto and made a part hereof by reference.

CHANGE ORDER No. 1
CONTRACT: 2008 Neighborhood Resurfacing—Wing Park Boulevard Project
SCOPE: This Change Order No. 1 will provide additional quantities to existing contract items in
order to complete additional street rehabilitation in conjunction with the 2008 Neighborhood
Resurfacing—Wing Park Boulevard Project.
This change order affects a contract entered into between the City of Elgin and Martam
Construction, Inc. of Elgin, IL, dated June 28, 2008 for the 2008 Neighborhood Resurfacing—
Wing Park Boulevard Project.
REASONS FOR CHANGE: This Change Order No. 1 is in the best interests of the City and is
authorized by law. The necessity for the changes was unforeseen at the time of the original
agreement, and the changes contemplated hereby are germane to the original agreement.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The amount the contract will be
revised is as follows:
Attachment A is incorporated herein and describes the additional work to be performed by the
Contractor and additional contract amounts to be paid by the City in this Change Order No. 1.
The original contract with Martam Construction, Inc. is $1,756,629.00. By reason of Change
Order No. 1,the contract for the 2008 Neighborhood Resurfacing—Wing Park Blvd. Project will
be increased in the amount of sixty eight thousand thirty and 00/100 dollars ($68,030.00). This
Change Order No. 1 will result in an increase from the original contract amount of 3.87%. The
new contract amount, inclusive of Change Order No. 1 is one million eight hundred twenty four
thousand six hundred fifty nine and 00/100 dollars ($1,824,659.00).

SUBJECT: Change Order No. 1 with Martam Construction, Inc. for the 2008 Neighborhood
Resurfacing—Channing Square Development Project
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider authorization of Change Order No. 1 for the subject project.
RECOMMENDATION
It is recommended that the City Council authorize the City Manager to execute Change Order
No. 1 to the contract with Martam Construction, Inc. for the 2008 Neighborhood Resurfacing —
Wing Park Boulevard Project in the amount of$68,030.
BACKGROUND
On March 12, 2008, the City Council awarded the subject project to Martam Construction, Inc.
The project includes, where necessary, the removal and replacement of curb and gutter,
sidewalk, drive approaches and pavement base repair. The existing pavement will be ground out
and overlayed with five inches of new bituminous concrete. The project also includes the
installation of a landscaped median and 10 foot wide bike path along Wing Park Boulevard.
Change Order No. 1 ($68,030) will add additional quantities to existing pay items to rehabilitate
Channing Street and Division Street within the limits of the Channing Square Development.
The development incentive for the old Channing YMCA site includes funding for the City to
rehabilitate Channing and Division Streets within the development limits. Martam Construction
has agreed to honor the contract unit prices from the Wing Park Boulevard Rehabilitation Project
to complete this work. The work will be completed prior to the end of this year's construction
season. A copy of Change Order No. 1 is attached as Exhibit A.

FINANCIAL IMPACT
The cost of Change Order No. 1 with Martam Construction totals $68,030. Funds for the
rehabilitation work are included within the "Channing Place Development" project (079838),
Riverboat Lease Fund, account number 276-0000-791.80-27, "Economic Development
Incentives". The revised contract amount with Martam Construction will be $1,824,659.

1. The City Council may choose to approve Change Order No. 1 with Martam Construction,
Inc. for the 2008 Neighborhood Resurfacing — Wing Park Boulevard Project in the
amount of$68,030.

Construction, Inc. for the 2008 Neighborhood Resurfacing — Wing Park Boulevard
Project in the amount of$68,030.
