COUNTY KANE JOB NO. R-91-002-03 RECORDING: RECORDING ON: f 1 :+ • t S r 1\1 January 18, 2008 TO: Mayor and Members of the City Council FROM: Olufemi Folarin, City Manager Joseph Evers, P.E., City Engineer SUBJECT: Public Road At-Grade Crossing Agreement with Union Pacific Railroad for the Wing Street and State Street Intersection Project PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to approve the execution of an agreement with Union Pacific Railroad in conjunction with the Wing and State Street Intersection Improvement Project. RECOMMENDATION It is recommended that the City Council approve the agreement with Union Pacific Railroad. BACKGROUND The City has been pursuing the widening of State Street (Illinois Route 31) at Wing Street to accommodate a left turn lane since the early 1990's when it was decided that the north end bridge would no longer be pursued. This project, along with Kimball Street improvements completed in 1996 and the proposed improvements to Dundee and Summit, is intended to offset the loss of the North End Bridge corridor. The Wing and State Street Intersection Project is close to having all permits and designs completed and the attached agreement represents several years' worth of negotiations with the railroad to acquire their permit. The City will pay the railroad to extend the pavement crossing within the limits of the tracks, replace the existing signal system to accommodate the wider crossing and the new traffic signal interconnect, to provide flagman during construction and to permanently utilize an area of right-of-way owned by the railroad. The City will pay the railroad $65,172 for the right to permanently utilize additional railroad right-of-way and will pay $165,629 (estimated) for extension of the crossing, new ties and rails, and new signals. The agreement includes the conditions for insurance and for "right of entry" to the railroad right-of-way which the contractor will pay and to be reimbursed in accordance with the bid documents. Union Pacific Railroad Crossing License Agreement January 18, 2008 Page 2 According to the agreement and the railroad regulations, flagging is required whenever the City's contractor is within twenty-five feet of the rails. According to IDOT regulations, flagging costs cannot be included as a pay item within the bid documents, therefore, the City will have to pay for flagging services on a time and material basis. An order of magnitude cost for flagging is $20,000. Actual costs will depend upon the contractor's ability to complete any work within the limits in a timely manner. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None FINANCIAL IMPACT The agreement with the Union Pacific Railroad will require payment in the amount of$65,172 for the additional right-of-way required for the intersection improvement. Additionally the City will reimburse the railroad for improvements made to the crossing in the amount totaling $165,629 (estimated). Finally, flagging costs, estimated to be $20,000 will be paid by the City, during the course of the construction project. Total railroad related costs for the intersection improvement are estimated to be $251,000. Sufficient funds are budgeted ($2,000,000) and available ($2,000,000) in the Riverboat Fund, account number 275-0000-71.93-80, "Public Ways-Street Improvements," project number 339683 - Wing Street/Rt. 31 Intersection-to pay the associated costs. LEGAL IMPACT None ALTERNATIVES 1. The City Council may approve the agreement with Union Pacific Railroad. 2. The City Council may not approve the agreement with Union Pacific Railroad. Respectfully submitted for Council consideration. (do) Attachment
