RESOLUTION
APPROVING CHANGE ORDER NO. 3 IN THE CONTRACT WITH
CYBERDINE MASONRY CORP. FOR CONSTRUCTION ACTIVITIES
AT FIRE STATION 7
WHEREAS,the City of Elgin has heretofore entered into a contract with Cyberdine Masonry
Corp. for additional masonry services at Fire Station 7; and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 2, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Olufemi Folarin,City Manager,be and is hereby authorized and directed to
execute Change Order No.3,a copy of which is attached hereto and made a part hereof by reference.

CHANGE ORDER No. 3
CONTRACT: Construction of Fire Station 7(Bid No. 07-053)
SCOPE: Cyberdine Masonry Corp. was awarded the Masonry Trade Package bid for the construction of
Fire Station 7 in the amount of$637,257. A change order in the amount of$12,122.63 was submitted
by Cyberdine Masonry Corp. for increased costs associated with additional masonry services associated
with preparing the building for cold weather construction.
REASONS FOR CHANGE: Change Order No. 3 is in the best interest of the city and is authorized by
law. The necessity for the change was unforeseen at the time the contract was originally executed The
changes contemplated in Change Order No. 3 are germane to the original agreement.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The original contract will be amended as
to scope and costs to include the additional masonry services associated with preparing the building for
cold weather construction.

The original amount of the contract with Cyberdine Masonry,Corp. is$637,257 Change Order No. 3
totaling$12,122.63 will increase the original contract amount by a total of$12,122.63,that sum repre-
senting one and nine tenths percent(1.9%)of the original contract amount. The new contract amount,
inclusive of all change orders is$649,379.63.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.

SUBJECT: Change Order No. 3 for the Construction of Fire Station 7
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider authorizing Change Order No. 3 to the contract with Cyberdine Masonry
Corp. for the masonry services for the construction of Fire Station 7.
RECOMMENDATION
It is recommended that the City Council authorize the execution of Change Order No. 3 in the
amount of$12,122.63 to the contract with Cyberdine Masonry Corp. for the increase in masonry
services for the construction of Fire Station 7.
BACKGROUND
Cyberdine Masonry Corp. was awarded the Masonry Trade Package bid for the construction of
Fire Station 7 in the amount of $637,257. A change order in the amount of $12,122.63 was
submitted by Cyberdine Masonry Corp. for increased costs associated with additional masonry
services associated with preparing the building for cold weather construction.

FINANCIAL IMPACT
The total price of the change order with Cyberdine Masonry Corp. is $12,122.63. The total
budget for this project is $5.4 million with approximately $5 million spent and encumbered to
date. There are sufficient funds budgeted ($4,918,600) and available ($378,971) in the Riverboat
Lease Fund, account number 276-0000-791.92-36, project number 289506 (Fire Station 7)to pay
for the change order.
