AUTHORIZING TERMINATION OF A PROFESSIONAL SERVICES AGREEMENT
WITH KEITH FOSTER GOLF COURSE DESIGN FOR THE HIGHLANDS GOLF COURSE
PHASE II ARCHITECTURAL SERVICES
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that
Olufemi Folarin, City Manager, be and is hereby authorized and directed to execute a notice of
termination to Keith Foster Golf Course Design which states that the City of Elgin terminates it
professional services agreement with Keith Foster Golf Course Design entered into on October 22,
2003,pursuant to Paragraph 6 of said agreement.

SUBJECT: Termination of Contract with Mr. Keith Foster for Highlands Golf Course
Phase II Architectural Services
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to approve the termination of the contract with Mr. Keith Foster for Highlands Golf
Course Phase II architectural services.
RECOMMENDATION
It is recommended the City Council terminate the architectural services contract with Mr. Keith
Foster.
BACKGROUND
The architectural firm of Mr. Keith Foster designed and oversaw the construction of Phase I of
the Highlands Golf Course. On October 22, 2003, the City of Elgin entered into an agreement
with Mr. Foster for architectural services related to the design and development of Phase II.
Since that time, a number of site issues have delayed moving forward with the design and
construction.
The City has received a letter from Mr. Foster indicating that, due to his work load and the delay
in the construction of Phase II of the Highlands, he could not remain involved with the project.
As a result the City will need to seek the services of a new architect, but first must cancel the
contract with Mr. Foster.

NANCIAL IMPACT
The terminated contract with Mr. Keith Foster totaled $239,000. Funding for this contract is
located in the River Boat Fund, account number 275-0000-791.92-36 project number 509637
(Highlands Phase 2) where$2,981,067 is budgeted and $2,442,461 is available.
