WHEREAS, the CITY desires to engage the ENGINEER to furnish certain professional services in connection with Highland Avenue Widening and Reconstruction Project(Phase 1) (hereinafter referred to as the "PROJECT"); and WHEREAS, the ENGINEER represents that he is in compliance with Illinois Statutes relating to professional registration of individuals and has the necessary expertise and experience to furnish such services upon the terms and conditions set forth herein below. NOW, THEREFORE, for and in consideration of the mutual promises and covenants contained herein,the sufficiency of which is hereby mutually acknowledged, the CITY and ENGINEER hereby agree that the CITY hereby retains ENGINEER to act for and represent CITY in the engineering matters involved in the Project as set forth herein, subject to the following terms, conditions and stipulations: I. SCOPE OF SERVICES A. All work hereunder shall be performed under the direction of the Director of Public Works of the CITY, herein after referred to as the "DIRECTOR". B. Engineer will perform a Phase 1 Study for Highland Avenue that will include, but not limited to, Geometric Studies, Traffic Studies, Environmental Studies and Hydraulic Studies. The final deliverable will be a Project Development Report (PDR) that includes signoffs by Illinois Department of Transportation and Federal Highway Administration. C. Engineer shall provide and comply with the detailed Scope of Services attached hereto and incorporated herein as Attachment A. , - 2 - II. PROGRESS REPORTS A. Engineer shall comply with the outline project milestone schedule attached hereto as Attachment B. B. A detailed project schedule for the Project is included as Attachment B, attached hereto. Progress will be recorded on the project schedule and submitted monthly as a component of the Status Report described in C below. C. The Engineer will submit on a monthly basis to the Director a Status Report keyed to the Project Schedule. A brief narrative will be provided identifying progress, findings and outstanding issues. III. WORK PRODUCTS All work products prepared by the ENGINEER pursuant hereto including,but not limited to, reports, designs, calculations, work drawings, studies,photographs,models and recommendations shall be the property of the CITY and shall be delivered to the CITY upon request of the"DIRECTOR; provided,however"that the ENGINEER may retain copies of such work products for its records. Such work products are not intended or represented to be suitable for reuse by the CITY on any extension to the PROJECT or on any other project, and such reuse shall be at the sole risk of the CITY without liability to the ENGINEER. IV. PAYMENTS TO THE ENGINEER(Not To Exceed Method) A. For services provided the ENGINEER shall be paid at the rate of 3.0 times the direct hourly rate of personnel employed on this PROJECT, with the total fee not to exceed $226,581.68 regardless of the actual costs incurred by the ENGINEER unless substantial modifications to the scope of the work are authorized in writing by the CITY. B. For outside services provided by other firms or subconsultants, the CITY shall pay the ENGINEER the invoiced fee to the ENGINEER,plus 5% . Any such invoiced fees to ENGINEER shall be included with and construed as part of the above-referenced amount of $226,581.68. C. The CITY shall make periodic payments to the ENGINEER based upon actual - 3 - progress within 30 days after receipt and approval of invoice. Said periodic payments to the ENGINEER shall not exceed the amounts shown in the following schedule, and full payments for each task shall not be made until the task is completed and accepted by the DIRECTOR. V. INVOICES A. The ENGINEER shall submit invoices in a format approved by the CITY. Progress reports (IIC above) will be included with all payment requests. B. The ENGINEER shall maintain records showing actual time devoted and cost incurred. The ENGINEER shall permit the authorized representative of the CITY to inspect and audit all data and records of the ENGINEER for work done under this Agreement. The ENGINEER shall make these records available at reasonable times during the Agreement period, and for a year after termination of this Agreement. VI. TERMINATION OF AGREEMENT Notwithstanding any other provision hereof,the CITY may terminate this Agreement at any time upon fifteen(15) days prior written notice to the ENGINEER. In the event that this Agreement is so terminated, the ENGINEER shall be paid for services actually performed and reimbursable expenses actually incurred prior to termination, provided,however,that such payment shall not exceed the task amounts or total fee amount set forth under Paragraph W above. VII. TERM Unless terminated for cause or pursuant to Articles VI or IX, this Agreement shall be deemed concluded on the date the CITY determines that all of the ENGINEER's work under this agreement is completed and accepted by CITY. A determination of completion shall not constitute a waiver of any rights or claims which the CITY may have or thereafter acquire with respect to any term or provision of the Agreement. VIII. NOTICE OF CLAIM If the ENGINEER wishes to make a claim for additional compensation as a result of action taken by the CITY,the ENGINEER shall give written notice of his . T - 4 - claim within 15 days after occurrence of such action. No claim for additional compensation shall be valid unless so made. Any changes in the ENGINEER's fee shall be valid only to the extent that such changes are included in writing signed by the CITY and the ENGINEER. Regardless of the decision of the DIRECTOR relative to a claim submitted by the ENGINEER, all work required under this Agreement as determined by the DIRECTOR shall proceed without interruption. IX. BREACH OF CONTRACT If either party violates or breaches any term of this Agreement, such violation or breach shall be deemed to constitute a default, and the other party has the right to seek such administrative, contractual or legal remedies as may be suitable to the violation or breach; and, in addition, if either party, by reason of any default, fails within fifteen(15) days after notice thereof by the other party to comply with the conditions of the Agreement, the other party may terminate this Agreement. X. INDEMNIFICATION To the fullest extent permitted by law, ENGINEER agrees to and shall indemnify, defend and hold harmless the CITY, its officers, employees, agents,boards and commissions from and against any and all claims, suits,judgments, costs, attorney's fees, damages or other relief, including but not limited to workers' compensation claims, in any way resulting from or arising out of negligent actions or omissions of the ENGINEER in connection herewith, including negligence or omissions of employees or agents of the ENGINEER arising out of the performance of this Agreement. In the event of any such action against the CITY, its officers, employees, agents,boards or commissions, covered by the foregoing duty to indemnify, defend and hold harmless such action shall be defended by legal counsel of the CITY's choosing. XI. NO PERSONAL LIABILITY No official, director, officer, agent or employee of the CITY shall be charged personally or held contractually liable under any term or provision of this Agreement or because of their execution, approval or attempted execution of this Agreement. XII. INSURANCE A. Comprehensive Liability. The ENGINEER shall provide,pay for and maintain in effect, during the term of this Agreement, a policy of comprehensive - 5 - general liability insurance written in occurrence form with limits of at least $1,000,000 aggregate for bodily injury and$1,000,000 aggregate for property damage. The ENGINEER shall deliver to the DIRECTOR a Certification of Insurance naming the CITY AS ADDITIONAL INSURED. The policy shall not be modified or terminated without thirty(30) days prior written notice to the DIRECTOR. Such Certificate of Insurance shall include,but not be limited to, coverage for the obligations assumed by ENGINEER pursuant to Article X herein entitled "Indemnification". Such above-referenced insurance shall apply as primary insurance with respect to any other insurance or self-insurance programs afforded to the CITY. There shall be no endorsement or modification of this insurance to make it excess over other available insurance, alternatively, if the insurance states that it is excess or prorated, it shall be endorsed to be primary with respect to the CITY. B. Comprehensive Automobile Liability. Comprehensive Automobile Liability Insurance written in occurrence form covering all owned,non-owned and hired motor vehicles with limits of not less than $500,000 per occurrence for damage to property. C. Combined Single Limit Policy. The requirements for insurance coverage for the general liability and auto exposures may be met with a combined single limit of$1,000,000 per occurrence subject to a $1,000,000 aggregate. D. Professional Liability. The ENGINEER shall carry Engineer's Professional Liability Insurance covering claims resulting from error, omissions or negligent acts with a combined single limit of not less than $1,000,000 per occurrence. A Certificate of Insurance shall be submitted to the DIRECTOR as evidence of insurance protection. The policy shall not be modified or terminated without thirty (30) days prior written notice to the DIRECTOR. XIII. CONSTRUCTION MEANS, METHODS, TECHNIQUES, SEQUENCES, PROCEDURES AND SAFETY The ENGINEER shall not have control over or charge of and shall not be responsible for construction means, methods, techniques, sequences or procedures, or - 6 - for safety precautions and programs in connection with the construction,unless specifically identified in the Scope of Services. XIV. NONDISCRIMINATION In all hiring or employment made possible or resulting from this Agreement, there shall be no discrimination against any employee or applicant for employment because of sex, age,race, color, creed, national origin, marital status, of the presence of any sensory, mental or physical handicap, unless based upon a bona fide occupational qualification, and this requirement shall apply to,but not be limited to, the following: employment advertising, layoff or termination,rates of pay or other forms of compensation and selection for training, including apprenticeship. No person shall be denied or subjected to discrimination in receipt of the benefit of any services or activities made possible by or resulting from this Agreement on the grounds of sex,race, color, creed, national origin, age except minimum age and retirement provisions, marital status or the presence of any sensory, mental or physical handicap. Any violation of this provision shall be considered a violation of a material provision of this Agreement and shall be grounds for cancellation, termination or suspension, in whole or in part, of the Agreement by the CITY. XV. ASSIGNMENT AND SUCCESSORS This Agreement and each and every portion thereof shall be binding upon the successors and the assigns of the parties hereto; provided,however,that no assignment shall be made without the prior written consent of the CITY. XVI. DELEGATIONS AND SUBCONTRACTORS Any assignment, delegation or subcontracting shall be subject to all the terms, conditions and other provisions of this Agreement and the ENGINEER shall remain liable to the CITY with respect to each and every item, condition and other provision hereof to the same extent that the ENGINEER would have been obligated if it had done the work itself and no assignment, delegation or subcontract had been made. Any proposed subcontractor shall require the CITY's advanced written approval. XVII. NO CO-PARTNERSHIP OR AGENCY This agreement shall not be construed so as to create a partnership,joint venture, - 7 - employment or other agency relationship between the parties hereto, except to such extent as may be specifically provided for herein. XVIII. SEVERABILITY The parties intend and agreed that, if any paragraph, sub-paragraph,phrase, clause or other provision of this Agreement, or any portion thereof, shall be held to be void or otherwise unenforceable, all other portions of this Agreement shall remain in full force and effect. XIX. HEADINGS The headings of the several paragraphs of this Agreement are inserted only as a matter of convenience and for reference and in no way are they intended to define, limit or describe the scope of intent of any provision of this Agreement,nor shall they be construed to affect in any manner the terms and provisions hereof or the interpretation or construction thereof. XX. MODIFICATION OR AMENDMENT This Agreement and its attachments constitutes the entire Agreement of the parties on the subject matter hereof and may not be changed, modified, discharged or extended except by written amendment duly executed by the parties. Each party agrees that no representations or warranties shall be binding upon the other party unless expressed in writing herein or in a duly executed amendment hereof, or change order as herein provided. XXI. APPLICABLE LAW This Agreement shall be deemed to have been made in, and shall be construed in accordance with the laws of the State of Illinois. Venue for the resolution of any disputes or the enforcement of any rights pursuant to this agreement shall be in the Circuit Court of Kane County, Illinois. A - 8 - XXII. NEWS RELEASES The ENGINEER may not issue any news releases without prior approval from the DIRECTOR, nor will the ENGINEER make public proposals developed under this Agreement without prior written approval from the DIRECTOR prior to said documentation becoming matters of public record. XXIII. COOPERATION WITH OTHER CONSULTANTS The ENGINEER shall cooperate with any other consultants in the CITY's employ or any work associated with the PROJECT. XXIV. INTERFERENCE WITH PUBLIC CONTRACTING The ENGINEER certifies hereby that it is not barred from bidding on this contract as a result of a violation of 720 ILCS 5133E et seq. Or any similar state or federal statute regarding bid rigging. XXV. SEXUAL HARASSMENT As a condition of this contract,the ENGINEER shall have written sexual harassment policies that include, at a minimum,the following information: A. the illegality of sexual harassment; B. the definition of sexual harassment under state law; C. a description of sexual harassment, utilizing examples; D. the vendor's internal complaint process including penalties; E. the legal recourse, investigative and complaint process available through the Illinois Department of Human Rights, and the Illinois Human Rights Commission; F. directions on how to contact the department and commission; G. protection against retaliation as provided by Section 6-101 of the Human Rights Act. - 9 - A copy of the policies must be provided to the Department of Human Rights upon request 775 ILCS 5/2-105. XXVI. WRITTEN COMMUNICATIONS All recommendations and other communications by the ENGINEER to the DIRECTOR and to other participants which may affect cost or time of completion, shall be made or confirmed in writing. The DIRECTOR may also require other recommendations and communications by the ENGINEER be made or confirmed in writing. XXVII. NOTICES All notices, reports and documents required under this Agreement shall be in writing and shall be mailed by First Class Mail, postage prepaid, addressed as follows: A. Firm Qualifications Christopher B. Burke Engineering West, Ltd. (CBBEWL), is a member of The Burke Group (TBG) of companies and is located in St. Charles, Illinois. The current staff in St. Charles includes 22 professionals and technicians, and our specialties include stormwater management, site design, and a full range of municipal and county services. The firm is dedicated to providing high quality professional services to clients, primarily in the western portions of Northeastern Illinois, such as Kane, McHenry, Kendall, and DuPage counties. We have and continue to work extensively with county transportation divisions as a consultant on stormwater management and environmental resources, as well as providing more traditional civil engineering transportation plans, specifications, and estimates. As leading experts in stormwater management, CBBEWL joins forces with our clients to develop efficient and cost-effective designs that are customized to achieve their project goals on time and within budget. Of particular note, with respect to this project, is the fact that our staff was also retained to prepare the Stormwater Ordinances for both Kane and DuPage Counties, and work extensively with the City of Elgin in plan reviews in relation to Kane County Stormwater Ordinance. It is with this knowledge base, that we are confident that our project team will provide the technical expertise and requirements of IDOT and the Kane County Stormwater Ordinance as it relates to the Highland Avenue LDS. Specifically, the Rosemont office has approximately 140 professionals with expertise in a variety of disciplines, including survey, civil, structural, mechanical, environmental, traffic, construction management, transportation, landscape architecture, water resources, wetlands, and forestry. By combining the expertise and experience from the two offices, we bring together our technical and management strengths to cost-effectively provide the services required to complete the LDS for Highland Avenue. We have attached several relevant project abstracts representing our team's experience for your review. Project Understanding We understand that we will be working with Crawford, Murphy & Tilley, Inc. (CMT) to assist in preparing the IDOT Phase 1 Engineering Services, specifically, preparing a location drainage study, for the proposed widening and reconstruction of Highland Avenue between Randall Road and McLean Boulevard. The project limits extend from Randall Road to McLean Boulevard along the existing Highland Avenue alignment resulting in 1.6 miles of roadway widening and reconstruction. It is our understanding that the proposed improvements include widening the existing 2 lane section to three lanes and constructing curb and gutter and storm sewer. In general, we envision the following major tasks will be required to complete the work. • Field review and data collection • Preparation of an existing drainage plan including: Major drainage features Floodplain • Preparation of a proposed drainage plan including: Stormwater detention analysis Floodplain encroachment • Preparation of the Location Drainage Study In addition, we envision that several project meetings will be required as part of this scope to ensure overall project coordination and agency coordination. Project Team As noted previously, we have combined our expertise and experience from the St. Charles and Rosemont offices, to bring what we believe, to be a strong project team to complete the LDS for Highland Avenue. He will lead the technical tasks under the guidance of Mr. Wang. Chinliang R. Wang's role on this project will be to provide senior QA/QC of the LDS to ensure that the work is completed in accordance with our internal QA/QC program as well as that required by IDOT. Estimate of Man-hours As discussed, we have attached a Location Drainage Study Drainage Engineering Work Hour Summary, as well as a CECS cost worksheet that summarize our estimated man- hours and costs to complete the anticipated LDS tasks for the reconstruction of Highland Avenue in Kane County. Please note, we have made the following assumptions as a basis for the man-hour estimate and costs provided. • The project limits extend from Randall Road to McLean Boulevard along the existing Highland Avenue alignment resulting in 1.6 miles of roadway widening and reconstruction. It is our understanding that the proposed improvements include widening the existing 2 lane section to three lanes and constructing curb and gutter and storm sewer. • Base data, such as project area topography, typical existing and proposed cross sections, templated cross sections at 100-ft intervals, and plans and profiles will be provided by CMT. • A total of three outlets will be evaluated. • Kane County Stormwater Ordinance requirements will need to be satisfied including, but not limited to detention and compensatory storage. • The box culvert providing conveyance for the Branch of Tyler Creek will not be modified, therefore a detailed Hydraulic Report will not be required for the LDS. The required Waterway Information Table for the box culvert will be obtained from the Hydraulic Report for the existing structure. • Pump station design, if needed, is not included. • A total of up to 7 coordination meetings with local agencies by 2 of our project team staff will be required with 2 of these meetings dedicated to the extension of N. Airlite Street to the south of Highland Avenue. • Any additional stream or drainage pick up survey will be performed by others. • The drainage plans will be prepared at a scale of 1-inch equals 50-feet. • It is anticipated that a total of 10 copies of the report will be required throughout the design process (3 drafts, 3 pre-finals and 4 finals). APRIL 25, 2005 SCOPE-OF-WORK FOR ENVIRONMENTAL SERVICES Highland Avenue Reconstruction Project Elgin,Illinois 1. INTRODUCTION A Phase I and Phase II study is proposed for the improvement of Highland Avenue between McLean Boulevard and Randall Road. The existing road is a two lane rural cross-section that will be improved to a three lane urban cross-section with sidewalk on at least one side. The adjacent land uses include residential, open fields, and open space associated with Tyler Creek. There are four churches within the project limits plus on additional church located west of Randall Road. One of the churches includes a private school, apparently elementary. Right-of- way may be required to provide the proposed improvements to the roadway. The City of Elgin intends to use local funds for the Phase I and Phase II studies, but will utilize federal funds for construction. As a result, the project must meet certain environmental guidelines in order to be eligible for the federal funds. To accurately assess and report on the environmental studies, it is recommended that the environmental evaluation be summarized in an Environmental Class of Determination(ECAD). This Scope-of-Work submitted by Huff& Huff pertains to the environmental processing for the Highland Avenue corridor as an ECAD. Jim Novak will function as the project manager and will be responsible for overseeing all aspects of the environmental documentation. The following sections of this scope-of-work describe the tasks to be completed as needed. Key environmental issues that will be encountered during this study are anticipated to be noise analysis, wetlands, water quality, floodplains (associated with Tyler Creek), and socio-economic concerns. While processing the project as an ECAD is not required during Phase I if federal funds are not used, this process is valuable in documenting the environmental issues and impact resolution. 2. SCOPE-OF-WORK TASKS Task 4 Environmental Data Collection 4.1 Information Requests The environmental data collection process includes site visits as well as queries of resources and organizations for project specific information. Due to the use of federal funds for construction, it is recommended that the Environmental Survey Request Form(ESRF) be submitted to IDOT for ease in their future tracking of the pertinent environmental issues in-house. While the ESR typically triggers studies to be undertaken by state agencies, H&H will prepare the necessary C:\Documents and Settings\kfarley\Local Settings\Temporary Internet Files\OLK6C8\Highland Ave Elgin.doc 1 1. I environmental studies such as wetlands, special waste screening and natural resource data gathering. 4.2 Historic Photo Log A photo log will be prepared and submitted for evaluation of potential historic sites. This documentation will be submitted to the Illinois Historic Preservation Agency (IHPA) to determine if there are potentially historic structures in the project area. IHPA will provide an indication if historic or potentially historic homes occur, and this information would be used to avoid impacts to these structures. Based on a cursory review of the corridor, most of the structures do not appear to be either historically or architecturally significant. 4.3 Vegetation and Tree Survey/Tabulation Huff&Huff will prepare a tree survey in accordance with IDOT procedures for the project. All trees six inches diameter breast high (dbh) and any landscaped trees within the proposed ROW will be surveyed and identified. CMT will locate the trees during the project survey. Huff& Huff will then use survey data including station and offset to identify type, size and condition of the trees within the existing and proposed right-of-way. Scrub vegetation along the right-of-way can be qualitatively assessed. After all trees are evaluated, a tabulation of trees which summarizes potential impacts will be compiled. A summary tree report will be prepared which documents tree impacts. This will include all trees six inches dbh or greater and smaller individuals when planted for landscape purposes. It is anticipated the tree survey will be conducted in the growing season. 4.4 Site Visits Huff & Huff would first use one field trip to screen the corridor, identify areas requiring discussion, and to familiarize project personnel with the area. The photo log would be completed during this field trip. 4.5 Existing and Future Land Use Information concerning land use would be gathered from the City of Elgin. Only one commercial establishment was observed within the project corridor, with most of the corridor surrounded by single and multi-family residences. As previously mentioned, four churches and one parochial school are located along the roadway. The last remaining agricultural field is currently being developed. 4.6 Define and Analyze Social and Economic Factors Information will be collected regarding current and proposed public facility locations, service areas, and business locations. There are limited public facilities along the route. C:\Documents and Settings\kfarley\Local Settings\Temporary Internet Files\OLK6C8\Highland Ave Elgin.doc 2 4.7 Water Resource Data Collection of resource data for water resources and water quality will be obtained from the following sources: > U.S. Geological Survey/IEPA water quality reports (2002) D Illinois State Water Survey 7-day, 10-year low flow data, well logs, and reports > Northeastern Illinois Planning Commission reports These reports will be used to describe the stream in the project area. Other information needed to assess water quality includes size of drainage area, land uses in the watershed, impervious area, and rainfall information. 4.8 Preliminary Environmental Site Assessment(PESA) H&H will conduct a Preliminary Environmental Site Assessment (PESA) for the corridor. This will include a site inspection as well as completing a records search and identifying any possible special waste sites within the corridor. Based on a review of the corridor, there are no gasoline stations or other high risk facilities that are potential sources of special waste. Task 7 Noise Analysis Noise analysis may be required if the project could impact receptors. Current noise levels in the community are affected by traffic volumes, traffic mix (cars, medium trucks, and heavy trucks), receptor proximity, and the topographic variation in roadway placement. The noise analysis will be completed following IDOT policies and procedures and FHWA guidance, including 23 CFR 772. Noise analysis is a requirement of any Type I projects, where Type I is considered for highway on new location or physical changes in horizontal or vertical alignment, or increments in the number if through-traffic lanes. (See BDE 26-6.05 (a) and(b)). Data collection for the noise analysis includes information on land uses, traffic volume data, existing roadway design features (i.e. speed limits, ADT, and ROW limits, and sensitive receptor locations). Potential receptor locations for the existing and future conditions will be based on identifying sensitive receptors. No more than four(4) receptor locations are anticipated. During the site visit,photo-documentation will be completed. These photos are used for presentations in the technical memos. The peak hourly traffic data will be used to select potential receptor locations. Approval of these locations and methods will be sought prior to initiating further work. A memorandum will be prepared discussing the selection of receptor locations and noise measurement methods. APRIL 25, 2005 SCOPE-OF-WORK FOR ENVIRONMENTAL SERVICES Highland Avenue Reconstruction Project Elgin,Illinois 1. INTRODUCTION A Phase I and Phase II study is proposed for the improvement of Highland Avenue between McLean Boulevard and Randall Road. The existing road is a two lane rural cross-section that will be improved to a three lane urban cross-section with sidewalk on at least one side. The adjacent land uses include residential, open fields, and open space associated with Tyler Creek. There are four churches within the project limits plus on additional church located west of Randall Road. One of the churches includes a private school, apparently elementary. Right-of- way may be required to provide the proposed improvements to the roadway. The City of Elgin intends to use local funds for the Phase I and Phase II studies, but will utilize federal funds for construction. As a result, the project must meet certain environmental guidelines in order to be eligible for the federal funds. To accurately assess and report on the environmental studies, it is recommended that the environmental evaluation be summarized in an Environmental Class of Determination(ECAD). This Scope-of-Work submitted by Huff& Huff pertains to the environmental processing for the Highland Avenue corridor as an ECAD. Jim Novak will function as the project manager and will be responsible for overseeing all aspects of the environmental documentation. The following sections of this scope-of-work describe the tasks to be completed as needed. Key environmental issues that will be encountered during this study are anticipated to be noise analysis, wetlands, water quality, floodplains (associated with Tyler Creek), and socio-economic concerns. While processing the project as an ECAD is not required during Phase I if federal funds are not used, this process is valuable in documenting the environmental issues and impact resolution. 2. SCOPE-OF-WORK TASKS Task 4 Environmental Data Collection 4.1 Information Requests The environmental data collection process includes site visits as well as queries of resources and organizations for project specific information. Due to the use of federal funds for construction, it is recommended that the Environmental Survey Request Form(ESRF)be submitted to IDOT for ease in their future tracking of the pertinent environmental issues in-house. While the ESR typically triggers studies to be undertaken by state agencies, H&H will prepare the necessary L:\Elgin\0526501\!ProjMan\Agreement\SubConsultant\Huff Highland Ave Elgin.doc 1 I environmental studies such as wetlands, special waste screening and natural resource data gathering. 4.2 Historic Photo Log A photo log will be prepared and submitted for evaluation of potential historic sites. This documentation will be submitted to the Illinois Historic Preservation Agency (IHPA) to determine if there are potentially historic structures in the project area. IHPA will provide an indication if historic or potentially historic homes occur, and this information would be used to avoid impacts to these structures. Based on a cursory review of the corridor, most of the structures do not appear to be either historically or architecturally significant. 4.3 Vegetation and Tree Survey/Tabulation Huff& Huff will prepare a tree survey in accordance with IDOT procedures for the project. All trees six inches diameter breast high (dbh) and any landscaped trees within the proposed ROW will be surveyed and identified. CMT will locate the trees during the project survey. Huff& Huff will then use survey data including station and offset to identify type, size and condition of the trees within the existing and proposed right-of-way. Scrub vegetation along the right-of-way can be qualitatively assessed. After all trees are evaluated, a tabulation of trees which summarizes potential impacts will be compiled. A summary tree report will be prepared which documents tree impacts. This will include all trees six inches dbh or greater and smaller individuals when planted for landscape purposes. It is anticipated the tree survey will be conducted in the growing season. 4.4 Site Visits Huff & Huff would first use one field trip to screen the corridor, identify areas requiring discussion, and to familiarize project personnel with the area. The photo log would be completed during this field trip. 4.5 Existing and Future Land Use Information concerning land use would be gathered from the City of Elgin. Only one commercial establishment was observed within the project corridor, with most of the corridor surrounded by single and multi-family residences. As previously mentioned, four churches and one parochial school are located along the roadway. The last remaining agricultural field is currently being developed. 4.6 Define and Analyze Social and Economic Factors Information will be collected regarding current and proposed public facility locations, service areas, and business locations. There are limited public facilities along the route. Other information needed to assess water quality includes size of drainage area, land uses in the watershed, impervious area, and rainfall information. 4.8 Preliminary Environmental Site Assessment(PESA) H&H will conduct a Preliminary Environmental Site Assessment (PESA) for the corridor. This will include a site inspection as well as completing a records search and identifying any possible special waste sites within the corridor. Based on a review of the corridor, there are no gasoline stations or other high risk facilities that are potential sources of special waste. Task 7 Noise Analysis Noise analysis may be required if the project could impact receptors. Current noise levels in the community are affected by traffic volumes, traffic mix (cars, medium trucks, and heavy trucks), receptor proximity, and the topographic variation in roadway placement. The noise analysis will be completed following IDOT policies and procedures and FHWA guidance, including 23 CFR 772. Noise analysis is a requirement of any Type I projects, where Type I is considered for highway on new location or physical changes in horizontal or vertical alignment, or increments in the number if through-traffic lanes. (See BDE 26-6.05 (a) and(b)). Data collection for the noise analysis includes information on land uses, traffic volume data, existing roadway design features (i.e. speed limits, ADT, and ROW limits, and sensitive receptor locations). Project Description and Scope of Work The project consists of the reconstruction and widening of approximately 1.65 miles of the existing roadway. For these improvements we propose thirty (30) subgrade soil borings and ten (10) pavement cores. Method of Performance-Field Work Soil Exploration The soil exploration will be accomplished by performing soil profile borings for the roadway improvements. a) The soil survey borings will be extended to a minimum depth of six (6) feet and will incorporate standard penetration tests and split-spoon sampling at with sampling at one to three feet and from four to six feet below the surface. b) Laboratory testing will include moisture content determinations, consistency (penetrometer value) determination on cohesive soil samples. Soil classification testing and one IBR test will be performed on major subgrade soil type. c) The pavement cores will be made with a 4-inch diameter core barrel and hand augering equipment extended to sample all pavement components and into the underlying subgrade soil. The pavement section information at the core location will be presented on a data sheet in tabular form. t '' • In our proposal, we have included provisions for rough layout of the borings and have assumed that the final locations and elevations will be determined by the design engineer or will be referenced to centerline stationing provided by the Engineer. Method of Performance-Analysis and Report The boring information including the soil types and test data will be presented on plan and profile drawings, if required. The base reproducible plan and profile drawing would be provided by the design engineer. The results of this field exploration and laboratory testing would be used in an analysis and formulation of our recommendations. Major subject areas for our analysis, recommendations and report would consist of stating the existing subsurface soil and ground water conditions, the existing pavement section components,and subgrade soil conditions. A written report summarizing and presenting the data and recommendations will be prepared by a Registered Professional Engineer. The roadway soil exploration will be performed in compliance with the current IDOT Geotechnical Manual. Timing and Fees We will begin on work after notice to proceed. We plan on mobilizing and doing all the borings concurrently. The final report will be coordinated with the DSE as their design is completed. We propose to provide this work at the unit rates quoted on the attached Schedule of Services and Fees, Attachments 1.1 through 1.2. These estimated quantities and unit rates are based on information as outlined in this proposal and experience on past projects. On the basis of the above information, we estimate that these services can be provided for a fee of $ 14,590.00. ■ " r General For this project, we will assign Mr. William J.
