05-147 Resolution No. 05-147 RESOLUTION REGARDING THE EFFORTS BY THE VILLAGES OF BARTLETT, WAYNE AND CAROL STREAM TO DISCONNECT FROM SCHOOL DISTRICT U-46 WHEREAS, the boundaries of School District U-46 include parts of the City of Elgin, Village of Hoffman Estates, Village of Schaumburg, Village of South Elgin, City of St. Charles, Village of Carol Stream, Village of Wayne, Village of Hanover Park, DuPage County (unincorporated West Chicago), Village of Streamwood, and the entire Village of Bartlett; and WHEREAS, on July 12, 2004 the Bartlett Village President sent a letter to other municipalities located within School District U-46 asking each municipality to place the following advisory public question on the November 2, 2004 ballot: "Do you support creating a new unit school district separate from School District U-46 if it is in the best financial and educational interests of the community;"and WHEREAS,the Villages of Bartlett,Wayne and Carol Stream placed such question on the ballot in their communities and the question was approved in those communities; and WHEREAS,the Village of Bartlett President and Board of Trustees have now expressed their intent to propose legislation in the Illinois General Assembly to amend the Illinois School Code in order to facilitate the disconnection of Bartlett and parts of Wayne, Carol Stream, unincorporated West Chicago and Hanover Park from School District U-46 and to create a new unit school district in the southeast quadrant of School District U-46; and WHEREAS, School District U-46 is opposing such disconnection efforts and considers them not to be in the financial or educational best interests of the entire School District U-46 including the residents, taxpayers and students of the other communities in School District U-46; and WHEREAS, on January 24, 2004 the Board of Education for School District U-46 unanimously passed a resolution opposing the disconnection efforts by the Villages of Bartlett, Wayne and Carol Stream and requesting these communities cease and desist with their disconnection efforts and asking the other School District U-46 communities for their support in opposing disconnection. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, as follows: Section 1. That the City Council of the City of Elgin supports School District U-46 in its continued efforts to provide the best educational environment for all School District U-46 students. Section 2. That the proposed disconnection of the Villages of Bartlett,Wayne and Carol Stream would not be in the best interest of the City of Elgin and that a prolonged attempt by these communities to disconnect from School District U-46 will cause resources, both financial and human,to be expended,and that the City of Elgin believes these resources could be better utilized in the education of students throughout the U-46 community, Section 3. That the City Clerk is hereby directed to forward a copy of this resolution to School District U-46 and to each municipality in School District U-46 including the Villages of Bartlett, Wayne and Carol Stream. Section 4. Cogley, Corporation ounsel SUBJECT: Resolution Regarding the Efforts by the Villages of Bartlett, Wayne and Carol Stream to Disconnect from School District U-46 PURPOSE The purpose of this memorandum is to submit to the Mayor and members of the City Council a draft resolution regarding disconnection efforts from School District U-46. RECOMMENDATION elow The draft resolution is being submitted to the Mayor and members of the City Council at the request of the City Council. BACKGROUND The Villages of Bartlett, Wayne and Carol Stream are pursuing a proposed disconnection from School District U-46. The Village of Bartlett has expressed its intent to propose legislation in the Illinois General Assembly to amend the Illinois School Code in order to facilitate the disconnection of Bartlett and parts of Wayne, Carol Stream, unincorporated West Chicago and Hanover Park from School District U-46 and to create a new unit school district in the southeast quadrant of School District U-46. School District U-46 is opposing such disconnection efforts. The parties are in disagreement whether such disconnection efforts are in the financial or educational best interests of the entire School District U-46. The Board of Education for School District U-46 unanimously passed a resolution opposing the disconnection efforts by the Villages of Bartlett, Wayne and Carol Stream and has asked other School District U-46 communities for their support in opposing disconnection. Pursuant to the request of the City Council attached is a draft resolution regarding the efforts by the Villages of Bartlett, Wayne and Carol Stream to disconnect from School District U-46. The resolution provides in part that the City Council of the City of Elgin supports School District Resolution Regarding the Efforts by the Villages of Bartlett, Wayne and Carol Stream to Disconnect from School District U-46 April 8, 2005 Page 2 U-46 in its continued efforts to provide the best educational environment for all School District U-46 students. The resolution also provides that an independent comprehensive study or analysis should be completed regarding the proposed disconnection to determine whether such disconnection would result in the best financial and educational interests of all School District U-46 communities and that legislation in support of disconnection should not be adopted by the Illinois General Assembly until such a comprehensive study or analysis is completed.
