BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that
the City of Elgin,Illinois hereby accepts the Illinois Department of Transportation Highway Safety
Project Grant in the amount of$8,736 for seatbelt enforcement.
BE IT FURTHER RESOLVED that Olufemi Folarin,City Manager,is hereby authorized and
directed to execute all documents necessary in conjunction with the subject grant program.

SUBJECT: Illinois Department of Transportation Highway Safety Project Grant
AgreementlSeatbelt Enforcement
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider accepting a $8,736 Highway Safety Project Grant with the Illinois
Department of Transportation for the City of Elgin Police Department.
RECOMMENDATION
It is recommended that the City Council approve the acceptance of this grant with IDOT and
authorize the City Manager to sign the grant agreement for$8,736.
BACKGROUND
Motor vehicle crashes are the leading cause of death for Americans between the ages of 4 and
34. In Illinois during 2003, 1,454 persons were killed and 131,279 persons were injured in
crashes. 517 were not wearing seatbelt restraints or 36%. The cost per death in 2003 was
$1,120,000 and the cost per nonfatal disabling injury was $55,500. In the year 2004, the Elgin
Police Department investigated 3,553 traffic crashes, this being an increase of 16% more than
2003. Of those crashes, 387 were injury crashes and 1 was a fatality.
Many lives could be saved by changing public attitudes regarding the non-use of safety belts and
child seats. It has been shown that visible enforcement programs focusing on these violations
offer the greatest potential for changing these behaviors.
Educational and prevention efforts conducted by the Elgin Police Department during 2004
included participation in Child Passenger Safety Month (February), Alcohol Awareness Month
(April), Buckle Up America (May), 3-D Month (December), Click It or Ticket (year long), and
Operation Safe Passage (year long).

enforcement efforts of Click It or Ticket.

Enforcement efforts will include seatbelt enforcements everyday from May 23, 2005, through
June 5, 2005, for 2 hours per day on an overtime basis. The grant will reimburse the City for 168
hours of police overtime pay.

FINANCIAL IMPACT
The IDOT grant will total $8,736. There are sufficient 2005 budgeted funds in the General
Fund, Police Department, account number 010-2308-731.01-02, Patrol Division, Overtime to up
front the costs and participate in the grant program. No additional personnel will be required as a
result of the grant.

1. The City may choose to not accept this grant and not conduct any additional seatbelt
enforcement efforts.
2. The City may choose to not accept the grant and conduct all seatbelt enforcement, with
full costs borne by the City.

DESCRIPTION OF OCCUPANT PROTECTION ENFORCEMENT ZONE PROGRAM
Problem Statement
Motor vehicle crashes are the leading cause of death for Americans between the ages of 5
through 24. In Illinois,during 2003, 1,454 persons were killed and 131,279 persons were

violations offer the greatest potential for changing these behaviors.

Project Objectives
The purpose of the enforcement zone program is to reduce the incidence of motor vehicle
crashes, and the resulting injuries and fatalities,through increased highly visible
enforcement of occupant restraint laws during the national and state mobilizations.
In order to achieve this purpose,the following goals have been defined:
1. To reduce the number of severe A injury and fatal traffic crashes.
2_ To increase enforcement of occupant restraint laws.
3. To achieve a higher use of safety belts and child safety seats.
Methods of Procedure
1. Rural Initiative:Conduct safety belt enforcement zones during the month of May.
2. Click It or Ticket(CIOT): Conduct safety belt enforcement zones during the mobilization
period of May 23-June 5,2005.
Locations are those that have a high number of crashes and low occupant restraint use.
3. Participation in public information activities_aimed at informing potential violators of the
hazards of non belt use, and the likelihood of being detected if they violate the law.
Reporting Requirements
Reporting of enforcement activity is to be completed and submitted to DTS no later than July 1,
2005. The report shall include a completed Post Mobilization Reporting Form. The report shall
also include copies of any press or media coverage associated with the activity.
Reimbursement
A completed Highway Safety Project Claim for Reimbursement form and Overtime Hire-Back
Cost Documentation forms must be submitted to DTS by July 1,2005.

POLICE
SEATBELT ENFORCEMENT ZONE PROCEDURES
•
PURPOSE •
Establishes operational guidelines fpr conducting a seatbett enforcement zone and related reporting procedures.
11. POLICY
It shall be the policy of the department to utilize seatbelt enforcement zones as an effective enforcement
procedure in efforts to reduce traffic related fatalities.The overall purpose for conducting a seatbelt enforcement
zone is to achieve the highest possible compliance rate for occupant protection. The seatbelt enforcement zone
is not a checkpoint. A vehicle may be detained in a seatbelt enforcement zone only after a violation has been
observed. The Department has a zero tolerance policy for violations of occupant protection statutes. No
warnings shall be written for violations of occupant protection statutes.
111. PROCEDURE •
A. Supervisory Responsibilities
1. 'Department commanders(insert rank or title)shall be responsible for planning and implementing
seatbelt enforcement zones in conjunction with the department's comprehensive traffic safety
program.
2. Department commanders shall assign supervisors as officers in charge (OIC)of seatbelt enforcement
zones to manage the sites and enforcement activities.
•
a. A seatbelt enforcement zone supervisor shall be responsible for the selection of an
enforcement site and for completing a post detail incident report to document enforcement
activities. A diagram of the seatbelt enforcement zone site shall be submitted with the
incident report. (optional)
b. A seatbelt enforcement zone shall be staffed by a sufficient number of uniformed personnel
to assure safe and efficient operation. Officers on regular duty may be used for seatbelt
enforcement zones. Officers from other law enforcement agencies may be used for staffing
with the permission from the other law enforcement agencies. A list of participating officers
shall be submitted with each site's incident report.
c. Prior to conducting a seatbelt enforcement zone,the supervisor shall discuss and thoroughly
• explain to all officers who are participating in the Seatbelt Enforcement Zone their individual
responsibilities. As part of the briefing,the supervisor shall:
i. Assign officer(s)to function as a spotter(s). The spotter(s)will be
positioned ahead of the enforcement zone and will notify officers in the
enforcement zone of violator vehicles.
ii. Assign officer(s)to stop violators and issue citations. A zero tolerance
policy will be in effect when conducting a seatbelt enforcement zone. No
warnings shall be written for violations of occupant protection statutes.
iii. Assign officer(s)to count the total vehicles passing through the seatbelt •
enforcement zones and the total vehicles detained. (optional)
•
B. Site Selection
1. The safety of the officers and public shall be the primary consideration for selecting a seatbelt
enforcement site.
2. Seatbelt enforcement zones shall be conducted during daylight hours only.
3. Seatbelt enforcement zones may be conducted at locations where there is a natural stop in traffic as -
at two-way stops,four-way stops, exit ramps with a stop required at the bottom of the ramp, etc.
4. Site selection for seatbelt enforcement zones shall also include the following factors:
a. Volume of Traffic
b. Designed area for office parking
c. Designated area to direct violators for enforcement action without burdening the flow of traffic
d. Terrain of the roadway
e. Visibility to affected traffic,and
- f. The presence of private drives, i.e.,whether or not private drives would be blocked by
enforcement activities at the site.
5. Sites shall be conducted so that no lanes of traffic are restricted and the flow of traffic is not
burdened:
C. Advance Warning
1. Portable traffic signs shall be utilized at all enforcement zones to warn the public of the zone ahead. .
2. The portable signs shall be placed in an area that is visible to the public prior to the seatbelt
enforcement zone.
3. The portable signs may be erected at the spotter(s) location(s).
D. Responsibilities of the Spotter(s)
1. The spotter(s)shall occupy a location(s)that does not restrict the flow of traffic but affords the most
safety for the spotter. .

2. The spotter(s) shall be outside of their vehicle to afford the best possible vantage point to observe
violations. .
3. The spotter(s)shall be easily recognizable to the public. Use of signs, reflective vests, and traffic
cones is recommended.
4. If the spotter's vehicle is parked near the observation spot,discretion shall be exercised if utilizing the
emergency lighting on the vehicle so as to not burden the flow of traffic or create potential violations.

6. A vehicle that spotter directs to be stopped shall remain in constant sight until an officer in the zone
has stopped the vehicle.
a. This will ensure that the vehicle and the observed violation are properly identified.
E. Responsibilities of Officers Assigned to Write Citations
1. Officers assigned to issue citations for observed violations shall occupy location(s)that do not restrict -
the flow of traffic and that afford the most safety for the officer.
2. Officers assigned to issue citations for observed violations shall be outside of their vehicles in the
seatbelt enforcement zone unless the location necessitates a moving traffic stop.
3. Officers assigned to issue citations shall direct vehides identified by spotters to a safe area to issue
citations.
4. A citation shall be issued for all passenger restraint violations that are stopped in the seatbelt
enforcement zone.
5. Vehicles stopped in the seatbelt enforcement zone will be detained for a minimum amount of time.
The driver of a vehicle,or a passenger in a vehicle may not be inspected,searched or detained
longer than is necessary to issue a citation solely because of a passenger restraint violation.
6. Officers may act upon other violations or crimes only if a reasonable suspicion or probable cause of
other violations or crimes is present.
F. Responsibilities of Vehicle Count Officer(optional)
1. Officers assigned to count vehicles shall occupy location(s)that do not restrict the flow of traffic but
afford the most safety for the officer.
2. Officers assigned to count vehicles shall count all vehicles that pass through the seatbelt enforcement
zone and keep a separate count of the number of vehicles stopped in the seatbelt enforcement zone.
G. Seatbelt Enforcement Zone Procedures
1. All safety precautions,including squad cars properly parked,signs in place, and assigned officers,
shall be in position prior to'starting the seatbelt enforcement zone.
2. Assigned officers should expect some questions from the motorists and should be prepared to give.
the precise purpose of the seatbelt enforcement zone.All complaints should be directed to the Officer
in Charge(O.I.C.j. '
3. in accordance with the Department policy,only passenger motor vehicles will be subject to
enforcement action regarding passenger restraint violations during a Safety Belt Enforcement Zone
detail. (optional to exclude 2nd Division Vehicles)
4. Violator's will be detained for a minimum amount of time in order to issue a citation.
H. Reporting Procedures

1. Conduct a minimum of two(2)enforcement zone patrols during the mobilization period.
The Rural Initiative is the month of May. Click It or Ticket is May 23 through June 5,
2005.
2. Staffing: Each patrol must include a minimum of two(2)officers, maximum of six(6)
officers, per detail.
3. Time length per enforcement zone: Minimum of one(1)hour,maximum of two(2)hours.
4. Eligible costs are salaries for enforcement at officer's overtime rate, not to exceed time+
one half. No other costs are eligible for reimbursement.
