03-195 Resolution No. 03-195 RESOLUTION AUTHORIZING EXECUTION OF A GRANT APPLICATION FROM THE ILLINOIS DEPARTMENT OF NATURAL RESOURCES FOR THE MULBERRY GROVE NEIGHBORHOOD PARK PROJECT BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Ed Schock, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute a grant application on behalf of the City of Elgin from the Illinois Department of Natural Resources for the development of the Mulberry Grove Neighborhood Park under the Open Space Lands Acquisition and Development (OSLAD) program and the Land & Water Conservation Fund (LWCF) program, a copy of which is attached hereto and made a part hereof by reference. s/ Ed Schock Ed Schock, Mayor Presented: June 25, 2003 Adopted: June 25, 2003 Vote: Yeas : 7 Nays : 0 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk STATE OF IWNOIS/IDNR OSLADV!WCF PROJECT APPLICATION 1. Code 3025), or federal Land & Water conservation Fund (LWCF) program (17 IL Adm. Code 3030). as applicable, 2) the federal Uniform Relocation Assistance & Real Property Acquisition Policies Act of 1970 (P.L. 91-848), and/or the Illinois Displaced Persons Relocation Act (310 ILCS 40 et. seq.) as applicable, 3) the Illinois Human Rights Act (775 ILCS 6/1-101 et.aeq.), 4) Title VI of the Civil Rights Act of 1964,. (P.L. 63- 352), 5) the Age Discrimination Act of 1975 (P.L. 94.135), 8) the Civil Rights Restoration Act of 1988, (P.L 100-259) and 7)the Americans with Disabilities Act of 1990 (P.L. 101-338); and will maintain the project area in an attractive and safe condition, keep the facilities open to the general public during reasonable hours consistent with the type of facility, and obtain from the Illinois DNR written approval for any change or conversion of approved outdoor recreation use of the project site prior to initiating such change or conversion; and for property acquired with OSLAD/LWCF assistance, agree to place a covenant restriction on the project property deed at the time of recording that stipulates the property must be used, in perpetuity, for public outdoor recreation purposes in accordance with the OSLAD/LWCF programs and cannot be sold or exchanged, in whole part, to another party without approval from the Illinois DNR. F.ft i 1 I/17F NIS Monica Meyers, Director of Parks and Recreation SUBJECT: Illinois Department of Natural Resources (IDNR) and OSLAD Grant Application for Mulberry Grove Park PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information regarding the application of an IDNR (Illinois Department of Natural Resources) OSLAD (Open Space, Land Acquisition and Development) grant for the development of Mulberry Grove Park. BACKGROUND On November 15, 2000, the City Council accepted the annexation agreement with Concord Homes for the Mulberry Grove subdivision by approving ordinance S12-00 . As part of the agreement, the developer will set aside approximately five acres of land to provide active recreation opportunities for the residents of the subdivision. On May 15, 2003 , the Parks Division held a public meeting at 31 S . Grove, to obtain public input on the recreation elements the citizens would like for the new park. Thirty six (36) residents attended the meeting. The residents requested a number of elements including soccer practice fields, baseball area, tennis courts, 1/2 court basketball area, walking paths, playground units, fitness trail and a skate path. Parks developed a plan from this meeting and presented the plan to the public at the Parks and Recreation Advisory Board meeting on May 27, 2003 . The OSLAD Grant is a 50/50 funding program managed by the Illinois Department of Natural Resources (IDNR) . The total cost of the development is estimated at $446, 490 . The Parks and rw Recreation Department is requesting City Council approval to apply for the $223 , 245 grant from the IDNR to assist in development of the park. , . COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED Parks and Recreation Advisory Board and the residents of Mulberry Grove neighborhood. FINANCIAL IMPACT The total cost of this project will be $446, 490 . Park Development funds in the amount of $241 , 065 and Neighborhood Park Improvement funds in the amount of $205, 425 will be allocated for funding the project . The remaining funding would need to be included as part of the 2004 Riverboat Fund budget, account number 275-0000-791 . 92-37, project number 509622, Neighborhood Park Improvement . The OSLAD grant program will reimburse 50% of the project costs. In this case, the IDNR will reimburse the city $223, 245 upon completion of this project in 2004 .
