02-358 Resolution No. 02-358 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH KANE COUNTY FOR FUNDING ASSISTANCE FOR THE HOUSEHOLD HAZARDOUS WASTE COLLECTION PROGRAM BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Olufemi Folarin, Interim City Manager, be and is hereby authorized and directed to execute an agreement on behalf of the City of Elgin with Kane County for funding assistance for the household hazardous waste collection and disposal program, a copy of which is attached hereto and made a part hereof by reference . s/ Ed Schock Ed Schock, Mayor Presented: November 6, 2002 Adopted: November 6, 2002 Vote : Yeas : 7 Nays : 0 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk AGREEMENT THIS AGREEMENT entered into this Fitt day of AM U , 2002, by and between the CITY OF ELGIN, a municipal corporation(hereinafter referred to as the "City"), and KANE COUNTY (hereinafter referred tp as the "County"). WITNES SETH WHEREAS, the City and the County are public agencies within the meaning of the Intergovernmental Cooperation Act; and WHEREAS, the City and the County are also units of local government within the meaning of Section 10 of Article 7 of the Constitution of the State of Illinois; and WHEREAS, the City and the County are authorized to contract among themselves to obtain or share services, or exercise, combine, or transfer any power or fu action in any manner not prohibited by law; and WHEREAS, the City has contracted with Curbside, Inc., a subsidiary of the Safety-Kleen Corporation, to provide certain household hazardous waste services for the residents of the City; and WHEREAS, the collection and proper management of household hazardous waste so as to protect the environment is a matter within the government and affairs of the parties; and WHEREAS, the collection of household hazardous waste from residents of the City will also benefit citizens of the County. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the City and County agree as follows: 1. That the foregoing recitals are hereby incorporated into this agreement in their entirety. 2. That the City agrees to enter into an agreement with Curbside, 111c. to provide household hazardous waste services to residents of the City for a period twelve (12) months.. 3. FROM: Olufemi Folarin, Interim City Manager AND OLALITYINFRASTRUCTURE SUBJECT: Agreement with Kane County Accepting a Grant For Household Hazardous Waste Collection Services PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to execute an agreement with Kane County to accept $25, 000 in funding for the City' s Household Hazardous Waste Collection Program. BACKGROUND erm. Kane County has provided the City with $25, 000 annually since 1999 in order to help fund the City' s Household Hazardous Waste Collection Program. The City currently contracts with Curbside, Inc . to provide household hazardous waste disposal services to residents . These services include home pick-up of hazardous waste materials, local used motor oil collection centers and a mail-in program for medical syringes . There is no charge to residents to utilize these services . rilA--- FINANCIAL IMPACT A total of $81, 000 has been budgeted in the 2002 Public Works/Refuse Services Budget, Account Number 010-3331-754 . 33-05 for Hazardous Waste Services, of which, $55, 000 has been allocated for this program. The grant from Kane County is used to partially offset the 2002 Household Hazardous Waste Program expenditures. The current contract agreement with Curbside, Inc. for household hazardous waste collection is effective through March 31, 2003 in an amount not to exceed $55, 000 . Approximately $17, 000 remains encumbered but not spent to cover program expenses through the end of this fiscal year. emk f Kane County Grant for HHW Services November 1, 2002 Page 2 LEGAL IMPACT %\ None. ALTERNATIVES 1 . Approve the agreement with Kane County and accept the grant . 2 . Not approve the agreement with Kane County and refuse the grant . Not accepting the grant would result in the City funding a larger portion of the cost of the HHW Program. RECOMMENDATION It is recommended that the City Council approve the agreement with Kane County to accept grant funding in the amount of $25, 000 for the City' s household hazardous waste collection program and authorize staff to execute the necessary paperwork.
