02-27 Resolution No. 02-27 RESOLUTION APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH GILBANE BUILDING COMPANY FOR THE CENTRE WHEREAS, the City of Elgin has heretofore entered into a contract with the Gilbane Building Company for The Centre; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1, attached hereto. Parker, City Manager SUBJECT: Change Order No. 1 and No. 2 for The Centre PURPOSE The purpose of this memorandum is to provide the Mayor and members of City Council with information to consider Change Order No. 1 and No. 2 to the contract with Gilbane for "The Centre" construction project . BACKGROUND On June 14, 2000 , the City Council approved a contract with Gilbane Building Company to provide construction management services for the construction of "The Centre" . On July 11, 2001 and on July 25, 2001, the City Council approved amendments one and two respectively. Amendments one and two established guaranteed maximum prices (GMP) current with the bid results for the project at the time the amendments were presented to City Council . The City' s contract with Gilbane includes a process for change orders to the established GMP. Attached are Change Order No. 1 and Change Order No. 2 for electrical conduit protection and sewer work adjustments, respectively. In both cases, there is no increase to the cost of the project as a result of the change orders . Change Order No. 1 authorizes Gilbane to compensate the concrete contractor, Corona, for additional work to protect a Commonwealth Edison electrical duct adjacent to the north side of the parking structure in Symphony Way. The location of this electrical duct was not identified until Corona began excavation for the parking structure footings . Staff worked with Commonwealth Edison to put together a plan to protect the duct line in lieu of relocating the electrical lines . The plan consisted of driving steel piles adjacent to the duct to retain the soil surrounding the duct lines . The cost to perform this work was estimated to be a less expensive alternative to relocating the lines . Change Order No. l & 2 for The Centre December 14 , 2001 Page 2 The City' s franchise agreement with Commonwealth Edison requires the utilities to be relocated or protected at the utility companies expense if a conflict is encountered in the public right of way. Staff worked closely with Paul Calligan of Commonwealth Edison. Mr. Calligan is the Community Relations Director for the Elgin area. Through the work of Mr. Calligan, Commonwealth Edison did accept responsibility for the work and has made payment to the City in the amount of $50, 280 . The total cost of the work authorized by Change Order No. 1 is $54 , 302 . The $4 , 022 balance is for Gilbane' s management oversight of the work. Change Order No. 2 authorizes Gilbane to compensate the plumbing contractor, Jenson' s Heating and Plumbing for work to relocate a sewer line from Douglas Avenue onto the east side of the recreation center site . Relocation of the storm sewer was necessary because the pre-existing storm sewer ran through the site and needed to be relocated for the building placement on site . The initial planned location for the relocated storm sewer was within the Douglas Avenue pavement . This location became problematic due to an existing sanitary sewer line which exists within Douglas Avenue and is much closer than earlier thought to the west curb. When the plumbing work was being bid, Gilbane requested an alternate bid price to relocate the storm sewer from the planned Douglas Avenue location to within the recreation center property. The cost to relocate the storm sewer by Jenson Heating and Plumbing is $21, 870 . The cost to initially place the sewer within Douglas, as bid by the site utility contractor, Advanced Mechanical, was $44, 000 . Gilbane is currently negotiating a change order deduct with Advanced Mechanical to remove the sewer relocation work from their scope . The change order deduct with Advanced Mechanical will be greater than the change order cost with Jenson' s Heating and Plumbing. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None. FINANCIAL IMPACT All costs associated with the subject change orders will be funded through the GMP already established with Gilbane . Elgin, IL 60120 Re: Garage Foundation/ComEd Duct Dear Dave, For nearly the past two weeks we have been discussing the ComEd obstruction with the north face of the garage foundation. There also was an existing water line conflict as well that was removed by Public Works as it had no purpose due to the new water main work being installed later this year. In our opinion, we have researched every option to work around the duct bank and continue digging. Today the discovery process was completed. The corrective options included, reducing the footing size, moving the building, and shoring the duct bank. A combination of reducing the footing size and shoring is the most feasible. As you witnessed today, moving the building only would entail approximately an 8' shift to the south due to poor soil conditions under the duct bank. This would add approximately$26,000 to the cost of the pedestrian bridge alternate and would not guarantee future undermining. Shoring could ultimately be required as the bottom elevation of the duct bank raises as the foundation excavation would continue to the east making the soil slope increase(opposite of the desired condition). Attached is various documentation showing a section through the area, excavation standards and a letter from Corona Construction. This letter was received after Gilbane indicated to Corona that the A/E would reduce the footing size to provide additional clearance. We also sent Williams a letter on May 3'summarizing the problem and requesting direction. In our opinion, taking into account the entire bid document information, it is not reasonable to assume this obstruction could have been determined and taken into account during the bid process. The shoring cost, including the mark-ups, is approximately $37,000. An immediate decision is required as to the direction to be taken as our schedule as already been eroded by approximately a month due to this issue, the foundation rebar-alternate level problem and the Nicor gas relocation.
