RESOLUTION
WAIVING LIMITATION ON ACCRUED VACATION FOR OLUFEMI FOLARIN
WHEREAS, Ordinance No. S6-88 passed June 8, 1988, as amended by
Ordinance No. 514-97, passed on October 8, 1997, provides in relevant
part as follows :
Section 3 . Any officer or employee who commences
employment on or after July 1, 1988 may accrue vacation
leave for a period not to exceed the equivalent of one year
of vacation accrual into a subsequent year.
Section 5 . That all unused vacation leave in excess
of the amount permitted to be accumulated which is not taken
shall be forfeited.
Section 6 . The limitation on the accumulation of
vacation leave may be waived by the City Council upon
recommendation by the City Manager when he shall determine
that due to the needs of the city or because of unforeseen
circumstances beyond the control of an officer or employee
he has been prevented from the timely use of vacation leave .
and
WHEREAS, due to a medical leave of the City Manager, Olufemi
Folarin has acted as Acting City Manager and due to the time required
as a result thereof has been unable to use his accrued vacation leave
which has accrued in excess of the equivalent of one year of vacation
accrual which would be forfeited pursuant to Ordinance No. 56-88, as
amended.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that Olufemi Folarin shall be paid for his accrued
vacation leave for the amount of accrued vacation leave in excess of
the equivalent of his one year of vacation accrual .
