RESOLUTION
AUTHORIZING EXECUTION OF AN AMENDED AGREEMENT FOR
ARCHITECTURAL SERVICES WITH BERNA ARCHITECTS AND DESIGN
FOR THE BLUFF CITY CEMETERY OFFICE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Joyce A. Parker, City Manager, and Dolonna Mecum,
City Clerk, be and are hereby authorized and directed to execute
an Amended Agreement for Provisions of Architectural Services on
behalf of the City of Elgin with Berna Architects and Design for
the Bluff City Cemetery office addition, a copy of which is
attached hereto and made a part hereof by reference .

AMENDED AGREEMENT FOR PROVISIONS OF ARCHITECTURAL SERVICES
WITH BERNA ARCHITECTS AND DESIGN
This AMENDED AGREEMENT is made and entered into this gr,tday of /h A-, c FL
F-,&6ftra-iy-2001 , by and between the CITY OF ELGIN, an Illinois municipal corporation
(hereinafter referred to as the "City") and Berna Architects and Design a Sole
Proprietorship (hereinafter referred to as "Architect").
WHEREAS, the City and Architect have previously entered into an Agreement
dated April 14, 2000, relating to the Architect providing certain professional services for
the City's proposed Downtown Walkway Rehabilitation, Parks Office Facade, Tuck
Pointing Specifications, Sign Replacement at Spring Street Parking Deck, Space Need
and Cost Estimates for the Cemetery Office Addition (hereinafter referred to as the
"Agreement" which is attached hereto); and
WHEREAS, the City has requested and the Architect has agreed to change the
Scope of Services required by said Agreement; and
WHEREAS, Section IV of the Agreement provides that additional services by the
Architect beyond the scope of work of the Agreement requires prior written approval of
the City Council.
NOW, THEREFORE, for and in consideration of the mutual undertakings as
contained herein, and the mutual undertakings as contained in the Agreement between
the City and the Architect of April 14, 2000, and other good and valuable consideration,
the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree
as follows:
1. That the foregoing recitals are incorporated into this Amended Agreement
in their entirety.
2. That the Agreement between the City and the Architect dated April 14,
2000, is amended as follows:
Section I entitled "Scope of Services" is amended by removing the
following items from the pedestrian walkway reconstruction proposal:
Design Development Fee $2,450.00
Construction Documents Fee $4,793.00
Bidding Phase Fee $1 ,541.00
Construction Review Fee $1,655.00
Additionally, the following items under the Bluff City Cemetery Office Addition proposal
are added to the Scope of Services in exchange for the sum of money not in excess of
the amount listed opposite the service.
Construction Documents Fee $14,000.00
Provide complete set of architectural drawings and demolition
scope for bidding and construction.
Provide complete set of structural, mechanical, plumbing and
electrical drawings for construction and bidding.
Will address all Federal and State Handicap Accessibility Codes
and phase project if required.
To be completed in Spring of 2001
Bidding Phase Fee $1 ,300.00
Assist in preparing bid documents for contractors.
Administer and coordinate bidding procedure.
Review and verify bids and bidders references.
To be completed in Spring of 2001
Construction Review Fee $2,800.00
Weekly onsite review of construction as needed.
Review shop drawings.
Final project inspection and punch list.
The listed change will result in a Net increase to the Contract of$7,661.00
3. That except as amended herein, the terms and provisions of the
Agreement between the City and the Architect of April 14, 2000, shall
remain in full force and effect.
4. That in the event of any conflict between the provisions of this
Amendment Agreement and the Agreement of April 14, 2000. The terms
of this Agreement shall control.
IN WITNESS WHEREOF the parties have entered into and executed this
Amended Agreement on the date and year first written above.

SUBJECT : Amendment to Professional Services
Contract with Berna Architects and Design
PURPOSE
The purpose of this memorandum is to provide the Mayor and the
members of the City Council with information to consider an
Amendment to the Professional Services Contract with Berna
Architects and Design in relation to the Bluff City Cemetery office
addition.
BACKGROUND
Berna Architects and Design was contracted to provide Architectural
Services for various projects, including schematic design
development and cost projections for an addition to the Bluff City
Cemetery offices . Based on those design and cost estimates, the
addition was approved within the 2001 budget . The Berna Architects
and Design contract also included architectural services for the
reconstruction of the walkway downtown. During the initial phase,
it was discovered that the construction cost for that project would
be far greater than originally anticipated and this project has
been put on hold indefinitely. The contract amendment, a copy of
which is attached for your review, would add service to complete
construction documents, bid review, and construction review for the
office addition at Bluff City Cemetery. The 2001 budget provides
$350, 000 for design and construction. The amendment would also
delete the outstanding work on the downtown sidewalk project .
