RESOLUTION
AUTHORIZING THE SALE OF K-9 DUKE TO OFFICER ROBERT CHRIST
WHEREAS, in the opinion of the corporate authorities of the
City of Elgin it is not necessary, useful, or in the best interests
of the City of Elgin to retain ownership of the seven year old male
German Shepherd dog commonly known as "Duke" now owned by it; and
WHEREAS, Officer Robert Christ has offered to purchase said
dog for the sum of $1 . 00 .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS, that the City Council finds that the dog now
owned by the City of Elgin is not necessary or useful to the City
of Elgin and the best interests of the City of Elgin will be served
by its sale.
BE IT FURTHER RESOLVED that Joyce A. Parker, City Manager, and
Dolonna Mecum, City Clerk, be and are hereby authorized and
directed to execute a Sales Agreement on behalf of the City of
Elgin with Officer Robert Christ for the sale of K-9 Duke for the
sum of one dollar, a copy of which is attached hereto and made a
part hereof by reference .

SALES AGREEMENT
THIS AGREEMENT is hereby made and entered into this 28th day
of November, 2001, by and between the CITY OF ELGIN, a municipal
corporation (hereinafter referred to as "City" ) , and ROBERT CHRIST
(hereinafter referred as "Christ" ) .
WHEREAS, City owns a seven year old male German Shepherd dog
known as Duke Vanmeter (hereinafter referred to as "Duke" ) ; and
WHEREAS, Duke has performed various services for the City
through the City' s Police Department during the period of City' s
ownership of Duke; and
WHEREAS, due to Duke' s age and physical condition, Duke is no
longer capable of performing such services; and
WHEREAS, Christ has acted as Duke' s handler during the period
of City' s ownership of Duke, and conveyance of ownership of Duke to
Christ constitutes the most humane disposition of Duke; and
WHEREAS, City has adopted Resolution No. 01- 322 finding that
Duke is not necessary or useful to the City, and the best interests
of the City will be served by Duke' s sale as provided herein.
NOW, THEREFORE, in consideration of the mutual promises and
covenants contained herein, the receipt and sufficiency of which
are hereby acknowledged, the parties hereto hereby agree that the
City shall hereby sell and convey to Christ, and Christ shall
hereby purchase and accept receipt and ownership of Duke for the
sum of One Dollar ($1 . 00) .

SUBJECT: Retirement/Sale of K-9 Duke
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to consider the sale of the
K-9 dog Duke to retired police officer Robert Christ .
BACKGROUND
Robert Christ retired from the Elgin Police Department in January
ew of 2001 as a full-time police officer. He remained employed with
the City as a part-time officer and maintained the department' s
K-9, Duke, for our use until a replacement dog and handler could be
trained. The replacement dog and handler are now in place and we no
longer have any need to maintain Duke for police work. Duke cannot
be re-trained for use by the department with another handler and
must be disposed of in some way. The most appropriate means of
disposing of this animal is the sale of the dog to the former
handler, Robert Christ .
This is consistent with our past practice and recommendations from
police dog organizations .
COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
None.
FINANCIAL IMPACT
Duke has no residual value to the department and the sale of Duke
to Robert Christ will end our requirement to pay Robert Christ for
the animal' s care .
LEGAL IMPACT
The sale agreement was prepared by the City' s legal staff .

ALTERNATIVES
The City can maintain Duke and continue to pay for his care.
RECOMMENDATION
It is recommended that the K-9, Duke, be sold to Robert Christ and
that the City Manager be authorized to execute a sales agreement .
