This agreement may be terminated at any time by either party hereto upon fifteen (15) days written notice . 10 . The terms of this agreement shall be severable. In the event any of the terms or provisions of this agreement shall be deemed to be void or otherwise unenforceable for any reason, the remainder of this agreement shall remain in full force and effect . 11 . This agreement shall be subject to and governed by the laws of the State of Illinois . Venue for the resolution of any disputes or the enforcement of any rights arising out of or in connection with this agreement shall be in the Circuit Court of Kane County, Illinois . 12 . G 1 { � TO: Mayor and Members of the City Council N FROM: Joyce A. Parker, City Manager SAFE COMMUNITY SUBJECT: Agreement to Utilize Range Privileges for Police Department S.W.A.T. Team PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to enter into an agreement with Joan Bakley and Harris Bank of Woodstock for Elgin Police Department S .W.A.T. Team training purposes . BACKGROUND The Elgin Police Department S .W.A.T. (Special Weapons and Tactics) Team is designated to handle unusual occurrences and high risk situations . Subsequently, the team needs to carry special weaponry to handle such situations . Included in the weaponry are high powered rifles and automatic weapons . In order to stay proficient with these weapons, the S .W.A.T. Team trains with them (in addition to the regular monthly training) at least quarterly. The range inside the Elgin Police Department is an excellent training site for handgun and some shot gun training, but is not designed to handle most rifle caliber ammunition. In addition, the S.W.A.T. Team needs to practice long-range shooting and moving drills which cannot be performed in the indoor Elgin Police Department range. In the past, the team has trained at the Fox Valley Rifle Range and the State Police/District 2 range. However, the Fox Valley Rifle Range has closed and the State police range is currently under- going renovations and the range is booked after the renovations are complete . Subsequently, the team began looking for a new training site and learned that the Huntley Police Department currently trains at a gravel pit/quarry on the northeast corner of Square Barn/Huntley Road in the unincorporated Gilberts area. The owner of the property is Joan Bakley and Harris Bank of Woodstock as Trustee under Trust #2464 . The owner of the property was contacted and indicated that she would allow the Elgin Police Department to train on the property for no charge . The area has limited access with F S .W.A.T. Team Training August 3, 2001 Page 2 locked gates which would prevent people from entering the area during training. Additionally, the area has deep quarries and large berms which make it a very safe environment for shooting rifles and other firearms . There is no record of any firearms related accidents at the proposed site . Furthermore, the S .W.A.T. Team has several very experienced, certified range officers who take many safety precautions during training. During the thousands of hours of training done by the S .W.A.T. Team, there has never been a firearms-related accident . However, the owner of the property would like to have some type of waiver prepared to limit her liability in the unlikely chance that an accident occurred. The S .W.A.T. officers are scheduled for training during normal duty time and this includes any travel time to a site outside the city limits . COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED rft. RECOMMENDATION It is recommended that the members of the City Council authorize an agreement for the use of the site located at Huntley and Square Barn Roads for Elgin Police Department S .W.A.T.
