RESOLUTION
AUTHORIZING EXECUTION OF AN APPLICATION FOR A GRANT FROM
THE ILLINOIS DEPARTMENT OF NATURAL RESOURCES FOR THE
DEVELOPMENT OF THE HAWTHORNE HILLS PARK
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that the City of Elgin hereby certifies and
acknowledges that it has 100% of the funds necessary (includes
cash and value of donated land) to complete the pending
OSLAD/LWCF project within the timeframes specified herein for
project execution, and that a failure to adhere to the specified
project timeframe or failure to proceed with the project because
of insufficient funds or change in local recreation priorities is
sufficient cause for project grant termination which will also
result in the ineligibility of the local project sponsor for
subsequent Illinois DNR outdoor recreation grant assistance
consideration in the next two (2) consecutive grant cycles
following project termination.
Acquisition Projects
It is understood that the local project sponsor
has twelve (12) months following project approval to
acquire the subject property (petition to condemn must
be filed for acquisitions involving eminent domain) and
three (3) months to submit a final reimbursement
billing request to the IDNR (excluding eminent domain
cases) .
Development Projects
It is understood that the local project sponsor
has six (6) months following project approval to
initiate project development and a total of 24 months
to complete said development with a Final Billing
request submitted to IDNR within three (3) months
following completion.
BE IT FURTHER RESOLVED that the City of Elgin further
acknowledges and certifies that it will comply with all terms,
conditions and regulations of 1) the Open Space Lands Acquisition
and Development (OSLAD) program (17 IL Adm. Code 3025) or federal
Land & Water Conservation Fund (LWCF) program (17 IL Adm. Code
3030) , as applicable, 2) the federal Uniform Relocation
Assistance & Real Property Acquisition Policies Act of 1970 (P.L.
91-646) , and/or Illinois Displaced Persons Relocation Act (310
ILCS 40 et seq. ) as applicable, 3) the Illinois Human Rights Act
(775 ILCS 5/1-101 et seq. ) , Title VI of the Civil Rights Act of
1964, (P.L. 83-352) , the Age Discrimination Act of 1975 (P.L. 94-
135) , the Civil Rights Restoration Act of 1988, (P.L. 100-259)
and 7) the Americans with Disabilities Act of 1990 (P.L. 101-
336) ; and will maintain the project area in an attractive and
safe condition, keep the facilities open to the general public
during reasonable hours consistent with the type of facility, and
obtain from the Illinois DNR written approval for any change or
conversion of approved outdoor recreation use of the project site
prior to initiating such change or conversion; and for property
acquired with OSLAD/LWCF assistance, agree to place a covenant
restriction on the project property deed at the time of recording
that stipulates the property must be used, in perpetuity, for
public outdoor recreation purposes in accordance with the
OSLAD/LWCF programs and cannot be sold or exchanged, in whole or
part, to another party without approval from the Illinois DNR.
BE IT FURTHER RESOLVED that the City of Elgin certifies to
the best of its knowledge that the data provided within the
attached application is true and correct .

SUBJECT: Hawthorne Hills OSLAD Grant Application
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to consider applying for a
OSLAD (Open Space, Land Acquisition, and Development) grant for the
development of Hawthorn Hills Park.
BACKGROUND
Funding is available through the 2001 OSLAD grant program from the
Illinois Department of Natural Resources (IDNR) for the development
fek of the Hawthorne Hills Park located east of Randall Road and north
of the Route 20 by-pass .
The OSLAD grant is a (50/50) matching grant with a maximum limit of
$400, 000 for the development . The proposed project would consist
of a nature center, nature trails , parking, picnic area, lighting,
board walks, ADA accessible fishing pier, and a rustic
amphitheater.
Originally a Girl Scout camp, the Hawthorne Hills Park site was
purchased by the City in 1976 with assistance of a LAWCON (Land and
Water Conservation) Fund from the Illinois Department of
Conservation (now the IDNR) . As part of the grant agreement with
the IDNR, the site must be developed as a natural area for nature
studies, hiking, picnicking, camping and nature center. In
conjunction with the grant agreement, the site was to remain open
to the public .
Staff toured five nature centers in the northern Chicagoland area.
The nature facility would accommodate exhibit/interpretive space,
retail/rental, general program area, facility administration,
public/private common area and utility space . Hawthorne Hills Park
development is highly rated for development (1B - high
priority/short term 3-5 years) in the Parks and Recreation Master
eft' Plan. Attached is a copy of the site design and grant agreement .

The total cost of the project is $1, 080, 800 . The maximum amount of
an OSLAD grant is $400, 000 . In addition, funding will be requested
through Kane County government and C 2000 Fox River Eco-system
Partnership (FREP) grants .

COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
As part of the planning process, staff held three public meetings
for input and support from the community on the development of the
property. In addition, input was received from Steve Byers,
tow Illinois Nature Preserve as well as Hillcrest School , the Parks and
Recreation Advisory Board and the City' s Grant Consultant, Charles
Schrader & Associates .
FINANCIAL IMPACT
The matchingfunds of $400 , 000 - $680 , 000 will be designated from

the Park Impact Fee Funds, account numbers 010-0000-231 . 15-10 , 010-
0000-231-15 . 32 and 010-0000-231 . 15 . 51, if no additional funds are
obtained. The final matching funds needed will be determined by
the total amount of grant funding received.
