RESOLUTION
AUTHORIZING EXECUTION OF AMENDMENT NO. 1 TO AN AGREEMENT
WITH BAXTER AND WOODMAN, INC. FOR THE
SANITARY SEWER MASTER PLAN UPDATE PROJECT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Joyce A. Parker, City Manager, and Dolonna Mecum,
City Clerk, be and are hereby authorized and directed to execute
an agreement on behalf of the City of Elgin with Baxter and
Woodman, Inc. for professional services for the Sanitary Sewer
Master Plan Update Project, a copy of which is attached hereto
and made a part hereof by reference.

SANITARY SEWER MASTER PLAN UPDATE
ENGINEERING SERVICES AGREEMENT AMENDMENT NT NO. 1 '
This Amendment No. 1 entered into this Z9, day of ,
2001, by and between the City of Elgin, an Illinois Municip 1
Corporation (herein referred to as "CITY" ) and Baxter and
Woodman, Inc. , (hereinafter referred to as "ENGINEER" ) , shall
modify that agreement dated April 2, 2000, (hereinafter referred
to as "AGREEMENT" ) , whereby the ENGINEER was engaged by the CITY
to perform certain professional services in connection with data
collection, conceptual design, preliminary engineering and other
construction related engineering services for the Sanitary Sewer
Master Plan Update Project (hereinafter referred to as
"PROJECT" ) .
Whereas the payment to the ENGINEER for additional engineering
based on the expansion of watershed in the Far West area due to
consideration of Bowes creek Estates Subdivision was not included
in the AGREEMENT, and,
Whereas the CITY desires to include the payments to the ENGINEER
under paragraph IV of the AGREEMENT in connection with the
aforementioned design engineering pertaining to the PROJECT.
Now, therefore, for and in consideration of the mutual
undertakings as contained herein, and the mutual undertakings as
set forth in the original AGREEMENT, and other good and valuable
consideration, the receipt and sufficiency of which is hereby
acknowledged, the parties hereby agree as follows:
1. That section IV of the AGREEMENT of April 2, 2000 is hereby
amended by adding a Subparagraph C thereto to read as
follows:
C. For services listed below the ENGINEER shall be
reimbursed the total amount of $3, 468. 50 as a total
lump sum fee regardless of actual costs incurred by the
ENGINEER.
1. Additional research due to expanded
watershed and alternative evaluation
of the sewer system completed on the $3468.50
Bowes Creek Estates subdivision
TOTAL LUMP SUM FEES, Amendment 1 $3468.50
2. That except as amended herein the terms of the AGREEMENT of
April 12, 2000, between the CITY and the ENGINEER shall
remain in full force and effect.

3. That in the event of a conflict between the terms of this
amendment No. 1 and the terms of the original AGREEMENT of
April 2, 2000, the terms of this Amendment No. 1 shall
control.
IN WITNESS WHEREOF, the undersigned have placed their hands and
seals upon and executed this Amendment No. 1 in triplicate as
though each copy hereof was in original and that there are no
other oral agreements that have not been reduced to writing in
this statement.

SUBJECT: Amendment No. 1 to the Engineering Services Agreement
for Sanitary Sewer Master Plan Update Project
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to consider the authorization
to amend the current contract agreement with the consulting
engineering firm of Baxter & Woodman for the Sanitary Sewer Master
Plan Update Project.
BACKGROUND
The City of Elgin is in the process of updating its Sanitary Sewer
Master plan for future expansion of its sanitary sewers west of the
City. The plan is being prepared by Baxter & Woodman consulting
engineers . The revised plan is based on projected community growth
which covers areas south and west of Elgin and suggests specific
improvements to the sanitary sewer collection system and upgrades
to the Sanitary Sewer Treatment Plant.
The study includes an update of population projections, future
sanitary sewer demand calculations, routing, probable cost of
improvements and recommendations for cost reimbursement .
Recently, there has been a change in plan for areas west of the
City. The proposed Bowes Creek Estates subdivision was annexed and
because the property was not in the planning area for the existing
sewer system, the Baxter & Woodman study had to be expanded to
consider the larger planning area. Staff will utilize the study to
make recommendations to the developers . Recommendations would
include sewer sizes and preferred routing of sewer systems upstream
of Bowes Creek subdivision.

"Staff asked Baxter & Woodman to review proposals submitted by the
developers of the Bowes Creek subdivision.
The review was twofold:
1 . To compare costs of off-site gravity sewer versus lift station
and force main to serve this development .
2 . To compare costs of micro-tunneling versus open cutting
(trenching) to install the trunk sewers serving this
subdivision.
3. Addition of area to the original service area.
The cost of the original master plan update is $43, 250 . 00, to which
the attached amendment will add $3, 468 . 50 .

FINANCIAL IMPACT
The additional work will be funded with existing budgeted funds in
project number 409553, account number 430-4202-772 . 92-93, with the
amendment funded in account number 430-4202-772 . 93-90 .

RECOMMENDATION
It is recommended that City Council authorize the execution of the
agreement for engineering services with Baxter & Woodman for an
amount not to exceed $3, 468 . 50 .
