01-14 Resolution No. 01-14 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE BARRINGTON ROTARY CLUB TO PROVIDE FOR THE DONATION AND DISPOSITION OF USED POLICE BODY ARMOR VESTS WHEREAS, the Barrington Rotary Club has requested that the City donate to the Barrington Rotary Club certain used police body armor vests which will thereafter be donated by the Barrington Rotary Club to Club Rotario De Leon, of Gto. , Mexico for use by Mexican police; and WHEREAS, it is the opinion of the corporate authorities of the City of Elgin that the subject police body armor vests are no longer necessary or useful to the City of Elgin; and WHEREAS, said police body armor vests are declared surplus property without value; and WHEREAS, said police body armor vests are needed and useful to police officers in Mexico. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Ed Schock, Mayor, is hereby authorized and directed to execute an agreement with the Barrington Rotary Club and the Bill of Sale attached thereto to transfer all right, title, interest and possession of said used police body armor vests to the Barrington Rotary Club for distribution to the Club Rotario de Leon, of Gto. , Mexico, for use by Mexican police officers . s/ Ed Schock Ed Schock, Mayor Presented: January 24 , 2001 Adopted: January 24 , 2001 Omnibus Vote : Yeas 5 Nays 0 Recorded: Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk AGREEMENT THIS AGREEMENT made and entered into this day of J401AQ-') 2001, by and between the City of Elgin, Illinois, an Illinois municipal corporation, (hereinafter referred to as the "City"), and The Barrington Rotary Club of Barrington, Illinois, (also known as Barrington Rotary Charities, Inc., an Illinois not-for-profit corporation and hereinafter referred to as the "Barrington Rotary Club") WITNESSETH: WHEREAS, the Barrington Rotary Club has requested that the City donate to the Barrington Rotary Club 101 used police armor vests so as to allow the Barrington Rotary Club to distribute said used police armor vests to the Club Rotario de Leon of Gto Mexico to be used by police in Mexico; and WHEREAS, the City Council of the City of Elgin has determined that the manufacturer warranties have expired on such used police body armor and such used body armor is no longer necessary or useful to the City of Elgin; and WHEREAS, the City has agreed to donate to the Barrington Rotary Club the subject used body armor pursuant to the terms and conditions of this agreement NOW, therefore, for and in consideration of the mutual undertakings contained herein, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows: 1. That the foregoing recitals are incorporated in this agreement in their entirety. 2. That the City hereby agrees to donate to the Barrington Rotary Club 101 used police body armor vests. Upon execution of this agreement by both parties hereto the City will execute and deliver to the Barrington Rotary Club the Bill of Sale attached hereto as Exhibit A and the subject used police body armor vests. 3. That it is understood and agreed that the subject used police body armor vests are being donated to the Barrington Rotary Club in "AS IS" CONDITION. IT IS FURTHER AGREED AND UNDERSTOOD THAT ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF QUALITY, FITNESS AND MERCHANTABILITY ARE HEREBY EXCLUDED AND EXPRESSLY DISCLAIMED BY THE CITY. 1 4 That the Barrington Rotary Club further understands, acknowledges and agrees that the manufacturer's warranties for the subject used police body armor vests have expired. 5. Parker, City Manager SUBJECT: Donation of Used Body Armor PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider donating used police body armor to Club Rotario De Leon, GTO. Mexico BACKGROUND The Police Department has been contacted by Sal Camacho, the Low International Coordinator of the Barrington Rotary Club. This club has been focusing on obtaining used equipment for use in impoverished areas of Mexico. The purpose of the request is to authorize the Police Department to donate the surplus body armor to the Barrington Rotary so they can send the armor to the Club Rotario De Leon, Mexico, who will then turn them over to the Leon Police Department . Mr. Camacho advises that at this time the city, which currently has a population of over 1 . 3 million people, cannot afford to equip their law enforcement officers with armor. The department only has three or four security vests for their entire force. The Elgin Police Department currently has over 100 used vests that are boxed up in storage. The vests have no residual value in the United States because their manufacturer warranties have expired after five years of daily wear. These vests cannot be sold at auction due to the possibility they will fall into the hands of criminals . Mr. Camacho states that he guarantees that between the Barrington Rotary club and himself that the used armor will be given to the City of Leon, GTO. ALTERNATIVES The department can continue to store the body armor until another source for disposal is located. RECOMMENDATION It is recommended that the Police Department be authorized to transfer ownership of the used ballistic body armor to the Barrington Rotary Club for their distribution to the Rotary Club of LP Leon, Gto. The most recent petition comes from the Rotary Club of Leon, Gto. Mexico, by President Elect Ing. Humberto M. Luce Najar of Leon. Leon is a city with a population of 1.3 million people. At the present time to my knowledge they have only 3 or 4 of these security vests. I am requesting your help and cooperation in this matter, hoping that you could see it possible to donate some of your used safety equipment with a guaranty of the Barrington Rotary Club and myself that this safety equipment will be given to the mentioned city.
