00-26 Resolution No . 00-26 RESOLUTION AUTHORIZING EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT FOR THE MAINTENANCE OF ELECTRONIC TRAFFIC SIGNALS WITH THE COUNTY OF KANE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Ed Schock, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an Intergovernmental Agreement for the Maintenance of Electronic Traffic Signals on behalf of the City of Elgin with the County of Kane for maintenance of the traffic signals at Randall Road and Big Timber Road and Randall Road and Royal Boulevard, a copy of which is attached hereto and made a part hereof by reference . s/ Ed Schock Ed Schack, Mayor Presented: February 9, 2000 Adopted: February 9, 2000 Omnibus Vote : Yeas 5 Nays 0 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk STATE OF ILLINOIS COUNTY OF KANE RESOLUTION NO 00 - APPROVING INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF ELGIN (MAINTENANCE OF ELECTRONIC TRAFFIC SIGNALS) WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and 5 ILCS 220/1 et seq. authorizes the County of Kane and the City of Elgin to cooperate in the performance of their respective duties and responsibilities by contract and other agreements; and, WHEREAS, the County is interconnecting and synchronizing the traffic signals on Randall Road to facilitate the safe and efficient flow of traffic; and, WHEREAS, the City is responsible for traffic signal timing and maintenance of traffic signals at the intersections of Randall at Big Timber Road and Randall at Royal Boulevard; and, WHEREAS, the County desires to assume the responsibility of the traffic signal timing and maintenance of all traffic signals on Randall Road consistent with the requirements of the County Access Control Regulations; and WHEREAS, the County and the City agree that the County should operate and maintain the traffic signals on Randall Road. NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereof is hereby authorized and directed to execute an Intergovernmental Agreement for the Maintenance of Electronic Traffic Signals with the City of Elgin (a copy of which is on file with the County Clerk's Office). Sava, K n� elsoant Clerk Y • • INTERGOVERNMENTAL AGREEMENT FOR THE MAINTENANCE OF ELECTRONIC TRAFFIC SIGNALS This Agreement entered into this e'- day of 2000 by and between the County of Kane (hereinafter the "County") a body corpora e and politic of the State of Illinois and the City of Elgin (hereinafter the "City") a municipal corporation of the State of Illinois. WITNESSETH WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and 5 ILCS 220/1 et seq. authorizes the County and the City to cooperate in the performance of their respective duties and responsibilities by contract and other agreements; and, WHEREAS, the City has certain maintenance responsibilities for County owned traffic signals on Randall Road; and, WHEREAS, the City and the County desire to provide for the maintenance of said traffic signals on Randall Road under the yearly maintenance contract of the County; and, WHEREAS, the County and the City desire to perform the traffic signal maintenance as contemplated in that it will be of immediate benefit to the citizens of the County of Kane in that it shall facilitate the safe and efficient movement of traffic and shall provide for the safety of the motoring public and shall be permanent in nature; and, WHEREAS, the cost per year for the performance of the maintenance of said traffic signals is estimated to be ninety two dollars and fifty cents ($92.50) per signal, per month; and, WHEREAS, the County and the City desire to cooperate among themselves to accomplish the maintenance of traffic signals on Randall Road. NOW, THEREFORE, in consideration of the above preambles and the mutual promises and covenants as contained herein and for other good and valuable consideration the sufficiency of which is agreed to by the parties hereto, both the County and the City covenant, agree and bind themselves as follows: 1. Both the County and the City acknowledge that the City has, pursuant to previous agreements with the County has certain maintenance responsibilities for the traffic signals at the following locations: Randall Road at Big Timber Road, Randall Road at Royal Boulevard, Said traffic signals hereinafter referred to as the "Traffic Signals". , .i 2. The County agrees to maintain the Traffic Signals. When the County lets its annual contract for the maintenance of County traffic signals, the County agrees that it shall include in the bid specifications therefore the maintenance responsibilities for the Traffic Signals. 3. The County agrees to pay one hundred percent (100%) of the actual cost of the maintenance of the Traffic Signals. 4. Both the County and the City acknowledge that the maintenance of the Traffic Signals performed under said annual traffic signal maintenance contract shall be in accordance with the standards of the Illinois Department of Transportation (hereinafter "IDOT"). 5. The County and the City acknowledge that the provisions of this Agreement do not in any way modify, amend, or relieve the City of any of its duties, responsibilities, or obligations to the County pursuant to the terms of any other traffic signal maintenance agreement(s). 6. This agreement shall be effective upon approval by the respective legislative bodies of the County and the City. 7. The failure of the County, at any time, to insist upon performance or observation of any term, covenant, agreement, or condition contained herein shall not in any manner be construed as waiver of any right to enforce any term, covenant, agreement, or condition herein contained. 8. No purported oral amendment, change, or alteration hereto shall be allowed. Any amendment hereto shall be in writing, approved by the governing body of each party hereto and signed by their respective president, chairman, or mayor. 9. This agreement shall inure to the benefit of the parties hereto their heir's successors and assigns. Parker, City Manager SUBJECT: Proposed Intergovernmental Agreements with Kane County - For the Maintenance of Electronic Traffic Signals PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider the proposed intergovernmental agreement with Kane County with respect to the Randall Road - the Big Timber Road and the Randall Road Royal ,,,, Boulevard intersections . BACKGROUND em. The execution of the intergovernmental agreement (attached as Exhibit A) will turn the responsibility and cost of maintaining two electronic traffic signal systems over to the County. Kane County has prepared an agreement requesting that maintenance of the Big Timber/Randall intersection and the Royal/Randall intersection be turned over to the County Highway Department . Turning over the maintenance to the County will allow the County to proactively monitor and adjust the signal timings as needed to increase the overall efficiency of the Randall Road Corridor. The County' s acceptance of the maintenance is also relative to their plans to install a signal interconnection system from Hopps Road to Illinois Route 72 . COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED Representatives from Kane County Division of Transportation. INANCIAL IMPACT Orl"--" The City will realize a reduction in its annual maintenance costs of approximately $2, 220 . Kane County will now be fully responsible for the maintenance and related costs of the two traffic signal systems .
