00-223 Resolution No . 00-223 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH KANE COUNTY FOR FUNDING ASSISTANCE FOR THE HOUSEHOLD HAZARDOUS WASTE COLLECTION PROGRAM BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Joyce A. Parker, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an agreement on behalf of the City of Elgin with Kane County for funding assistance for the household hazardous waste collection and disposal program, a copy of which is attached hereto and made a part hereof by reference . s/ Ed Schock Ed Schock, Mayor Presented: October 11, 2000 Adopted: October 11, 2000 Omnibus Vote : Yeas 5 Nays 0 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk AGREEMENT THIS AGREEMENT entered into this_an-HA-day of B c T, 2000, by and between the CITY OF ELGIN, a municipal corporation (hereinafter referred to as the "City"), and KANE COUNTY (hereinafter referred tp as the "County"). WITNESSETH WHEREAS, the City and the County are public agencies within the meaning of the Intergovernmental Cooperation Act; and WHEREAS, the City and the County are also units of local government within the meaning of Section 10 of Article 7 of the Constitution of the State of Illinois; and WHEREAS, the City and the County are authorized to contract among themselves to obtain or share services, or exercise, combine, or transfer any power or function in any manner not prohibited by law; and WHEREAS, the City has contracted with Curbside, Inc., a subsidiary of the Safety-Kleen Corporation, to provide certain household hazardous waste services for the residents of the City; and WHEREAS, the collection and proper management of household hazardous waste so as to protect the environment is a matter within the government and affairs of the parties; and WHEREAS, the collection of household hazardous waste from residents of the City will also benefit citizens of the County. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the City and County agree as follows: 1. That the foregoing recitals are hereby incorporated into this agreement in their entirety. 2. That the City agrees to enter into an agreement with Curbside, Inc. to provide household hazardous waste services to residents of the City for a period of twelve (12) months, including (a) a referral service for the disposal of used motor oil; (b) a monthly drop-off program at Safety-Kleen facilities for paint, used motor oil, antifreeze, oil filters, and automotive batteries; and (c) door-to-door collection of other household hazardous waste materials. 3. That the City agrees to indemnify and hold the County harmless from any and all claims, damages or causes of action which may result from said services. 4. The County agrees to pay the City $25,000 to support the costs of providing this service for a twelve-month period to residents of the City. The grant from Kane County will be used to offset costs incurred for this year' s program. This revenue source is anticipated in the City' s 2001 Budget . LEGAL IMPACT 0 The agreement has been reviewed and approved by the Legal Department . ALTERNATIVES The City could opt not to accept the grant from Kane County which would result in the City funding the full cost of the HHW Program. RECOMMENDATION erb. It is recommended that the City Council approve the proposed agreement with Kane County to accept the $25, 000 grant and authorize staff to execute the necessary paperwork.
