RESOLUTION
APPROVING CHANGE ORDER NO. 2 IN THE CONTRACT WITH
WHITTAKER EXCAVATING FOR THE WING PARK FAMILY AQUATIC CENTER
WHEREAS, the City of Elgin has heretofore entered into a
contract with Whittaker Excavating for the Wing Park Family
Aquatic Center; and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 2 ,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Joyce A. Parker, City Manager,
be and is hereby authorized and directed to execute Change
Order No. 2 , a copy of which is attached hereto and made a
part hereof by reference .

CHANGE ORDER NO. 2
SCOPE: This Change Order No. 2 will provide additional items necessary to complete the Wing
Park Family Aquatic Center Project in an acceptable manner.
The general contractor for this project is Whittaker Excavating Co. of Earlville, IL
REASONS FOR CHANGE: The circumstances which necessitate the change in performance
. were not reasonably foreseeable at the time the contract was signed because the items were not
apparent when bid documents were completed.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The amount the contract will be
revised is as follows:

The original contract with Whittaker Excavating Co. is $4,653,170. By reason of Change Order
No. 2 the contract for the Wing Park Family Aquatic Center Project will increase in the amount
of eighty seven thousand nine hundred ninety eight and 02/100 ($87,998.02). The new contract
amount, inclusive of Change Order No. 2 is four million seven hundred forty one thousand one
hundred sixty eight and 02/00.

SUBJECT: Change Order No. 2 with Whittaker Excavating
for Wing Park Family Aquatic Center
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to consider Change Order No.
2 for the Whittaker Excavating contract for the Wing Park Family
Aquatic Center construction.
BACKGROUND
In August 1999 the City Council awarded a contract with Whittaker
Excavating for the construction of the Wing Park Family Aquatic
Center in the amount of $4, 653, 170. Project funding remaining
following this contract was $50, 000 for utilities and $144, 000 in
contingency. Change Order No. 1 was approved at the time of
contract approval for an extension on the project completion due to
the floodway mapping and permit approval processing.
Change Order No. 2 involves additional requirements requested from
the Illinois Department of Health, unforeseen circumstances
involving the discovery of an additional pool floor for removal and
disposal and additional piping for ' telocating the pump system to
avoid additional pool renovation, additional tree preservation
work, performance improvements involving extending utilities across
the vehicular bridge for future connections to the east of Tyler
Creek as well as finalized communications and surveillance
equipment, as noted in the bid documents, and utility improvements
as budgeted. The change order cost breakdown is as follows:

Budgeted funds for the Wing Park Family Aquatic Center, project
number 509538, total $5, 694, 300 . To date, $2, 880, 080 has been paid
out and $2, 494, 065 is encumbered, leaving $320, 155 available for
additional expenses . Sufficient funds are available in account
number 276-0000-791 . 92-36 to cover this request of $87, 998 . 02 .
