99-304 Resolution No. 99-304 RESOLUTION APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH WHEELABRATOR WATER TECH. INC. /BIO-GRO FOR THE REMOVAL AND LAND APPLICATION OF LIME RESIDUE AT THE SOUTH MCLEAN FACILITIES WHEREAS, the City of Elgin has heretofore entered into a contract with Wheelabrator Water Tech. Inc . /Bio-Gro for the removal and land application of lime residue at the South McLean facilities; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1, attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that pursuant to Elgin Municipal Code Section 5 . 02 . 0203 (6) the City Council hereby finds that an exception to the requirements of the procurement ordinance is necessary and in the best interests of the city; and BE IT FURTHER RESOLVED that Joyce A. Inc/Bio- Gro has been able to meet their contractual amount of land application of 20,000 dry tons. Since the farm community has accepted this material, the possibility of spreading more material is very good. As one cannot predict weather conditions in future years, it behooves us to take advantage of the good weather and remove much material this year as possible. It is anticipated that up to an additional 4,000 dry tons, at a cost of$49.33 per dry ton, can be removed this fall. • The above changes were not anticipated, for the reasons listed, at the time the contract with Wheelabrator Water Tech. Inc/Bio-Gro was authorized. • It is in the best interest of the City to approve the above changes. • These changes are germane to the intent and scope of the original contract. CHANGES IN CONTRACT AMOUNT Adjustments to the Contract Price resulting from the aforementioned item shall be the following negotiated prices covering all compensation due for the work. Parker, City Manager SUBJECT: Change Order No. 1 to an Agreement with Bio-Gro Corporation PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider Change Order No. 1 to Bio-Gro Corporation for the application of additional lime softening residue. BACKGROUND fow On February 12 , 1997, the City Council awarded a contract to Bio- Gro for the land application of the lime softening residue generated by the Riverside Water Treatment Plant . Due to good weather conditions both in the spring and fall, Bio-Gro has been able to meet their contractual amount of land application of 20, 000 dry tons . They have approached us with the possibility of spreading more material as the farm community has accepted this material . As one cannot predict weather conditions in future years, it behooves us to take advantage of the good weather and remove as much material this year as possible . It is anticipated that an additional 4, 000 dry tons, at a cost of $49 . 33 per dry ton, can yet be removed this fall . COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None . OpLFINANCIAL IMPACT There are sufficient monies in the Water Department ' s cash reserve account to provide the requested funds . At a price of $49 . 33 per dry ton, spreading of an additional 4, 000 dry tons would cost $197, 320 .
