REPAIRS TO RIVERSIDE D:CK ENGINEERING SERVICES AGREEMENT • ENDMENT NO. 1 This Amendment No. 1 entered into this IS- day of Nov = - , 1999, by and between the City of Elgin, an Illinois Municipal Corporation (hereinaft-r referred to as "CITY") and Walker Parking Consultants, an Illinois Corporation (hereina ler referred to as "ENGINEER"), shall modify that Agreement dated September 14, 1998, (here-1 after referred to as "Agreement"), whereby the ENGINEER was engaged by CITY to perform c:rtain professional services in connection with the preparation of plans, specifications, estimates of cost and construction related engineering services for the Emergency Repairs to Riv-rside Deck (hereinafter referred to as "PROJECT"). Whereas the payment to the ENGINEER for construction eng'neering relative to the project was not included in the Agreement, and, Whereas the CITY desires to include the payments to the ENI NEER under paragraph IV of the Agreement in connection with the aforementioned constructio engineering pertaining to the PROJECT. In response to these additional services, certain revisions mus u be made to the Agreement. The terms and conditions of the agreement are modified as specific ally set out below. All other parts of the Agreement remain unchanged. Section IV of the AGREEMENT is hereby amended to create subparagraph E to read as follows: E. For services provided in connection with items described i paragraph I.B.4 of this AGREEMENT, the ENGINEER shall be reimbursed in accord ance with the itemized work effort attached to and incorporated into this FIRST AMENDMENT 0 THE AGREEMENT as "Exhibit A", with a total fee not-to-exceed $5,200 regardless •f actual cost incurred by the ENGINEER unless substantial modifications to the scope of v-ork are authorized by the City through a change order or written amendment to this AGREE I ENT. The City shall make periodic payments to the ENGINEER based upon actual prog ess within thirty(30) days after receipt and approval of invoice by the CITY. All other provisions of the AGREEMENT shall remain in full force and effect. PREVIOUS WORK Walker has prepared revised plans and specifications in accordance with your letter dated Mcy 10, 1999 that increased the scope of the entir. project. „ OBJECTWE AND SCOPE The objective of our work will be to assist the City of Elgin n the Construction Administration for the repairs as shown on revised cons`u•tion documents. The following is our scope of work: SCOPE OF WORK Our Scope of Work will follow our original scope outlined in our proposal dated June 19, 1998. Prepare change orders and assist the City in negotiation of a reasonable price for changes in the project scope of services to be performe• by the contractor. Also, prepare any clarification drawings and details consider.d necessary to implement the repairs. 3. Review shop drawings and material submittals for confo mance with the construction documents. 4. Review pay requests submitted by the contractor for wor completed to date of pay • request. 5. Provide an experienced part-time project representative "n-site observation of repair work while work is in progress. 6. Furnish progress reports to the City, indicating the status of work completed. 7. Furnish a final punch list upon completion of the specifies work. 8. Assemble all warranties for the work and materials insta led. PROFESSIONAL FEES Construction Administration — We propose to perform the additional construction 'administration on an hourly rate basis based on the attache. rate schedule, plus reimbursable expenses, as follows: Estimated Professional Engineering Fees $5,000.00 Estimated Expenses $200.00 This amount will be added to the original contract amount o $10,300.00. Parker, City Manager SUBJECT: Inspection Services for the Riverside Deck PURPOSE The purpose of this memorandum is to provide the Mayor and Members of the City Council with information to consider authorizing an amendment to the Walker agreement for construction engineering services . BACKGROUND The City entered into an agreement with Walker Parking Consultants in September, 1998 to prepare specifications and plans for the repair of Riverside Deck. The agreement included construction engineering services but the fee was based on a much smaller scope of work. The scope of work was increased to include the much needed repair of the ramp from Chicago Street to Riverside Deck and replace nearly three times the amount of plank replacement . The demolition of the old planking has been completed and to date the engineering fees have been taken from the original agreement . A copy of the amendment is attached as Exhibit A. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None . FINANCIAL IMPACT The cost of the remaining inspection is $5, 200 . 00 bringing the total engineering agreement to a not to exceed amount of $15, 500 .
