BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS that a 1999 scavenger license be and is hereby

SUBJECT: Scavenger Resolution
I am attaching a memorandum from Brad Bohner regarding an
additional company which has recently met requirements for
obtaining a scavenger license . We had a similar situation and
did a resolution for the July 9, 1997, meeting.
Accordingly, please prepare the appropriate resolution and
place it under "Other Business" on the September 8 , 1999,
Council agenda. We probably should attach Brad' s memorandum
too.

SUBJECT: Proposed Amendments to Scavengers Ordinance
PURPOSE
The purpose of this memorandum is to provide information for
the Mayor and members of the City Council to consider
modifying the scavengers ordinance by amending license
issuing responsibility, safety inspection requirements and
overnight vehicle storage requirements.
BACKGROUND
The Department of Code Administration annually conducts a
licensing inspection to verify that each scavenger truck
emoperating within the City of Elgin meets minimum mandated
. , safety guidelines, is insured, has a current vehicle license
and is maintained in a nuisance-free condition (i .e . leaking,
odors) . Issuance of a scavenger license was withheld in one
instance over the past ten years . This eliminates marginal
operators from working in the City.
Upon the City Clerk ' s recommendation, section one of the
proposed ordinance amends section 6 . 54 . 020, eliminating the
CityClerk ' s responsibility to issue scavenger licenses after
City Council approval . Over time, this function evolved and
is now the responsibility of the Department of Code
Administration. The amendment of this section simply
reflects current in-house procedures .
Section two amends section 6 . 54 . 040 .0 to provide some
flexibility for scavenger companies as to what agencies are
allowed to inspect their vehicles . This amendment provides
that each licensed vehicle display either a certificate of
safety by the state in which the vehicle is licensed, or any
certificate of safety issued by a federal regulatory agency.
The scavengers ordinance currently requires only a State of
Illinois safety inspection sticker. This will ease the
licensing requirements for the nine scavenger companies
currently doing business with customers in the City of
Elgin. All of these companies except BFI are located outside
of the City of Elgin.

ri- Section three amends section 6 . 54 . 050, allowing scavenger
companies to park their vehicles outside in a commercial
operations yard when not in use. The current ordinance
requires scavenger vehicles to remain in an enclosed building
when not in use. The current requirement was not noted in
the plan review process of the Browning Ferris Industries of
Illinois (BFI) site on Gasket Drive when they developed their
site in 1997 . This oversight was brought to the Department
of Code Administration' s attention when staff was conducting
the annual scavenger truck licensing inspection. The
ordinance amendment would bring BFI into compliance by
allowing their vehicles or equipment to be stored in a
commercial operations yard, instead of inside a building,
when located within a General Industrial zoning district .
This would also allow the scavenger ordinance to be
consistent with other City ordinances that do not require
companies with a large fleet of vehicles to store their
vehicles inside .
Staff does not anticipate any negative impacts to adjoining
properties as a result of this amendment . No complaints
regarding this site have been received by the Department of
Code Administration in the past nine months since BFI began
operations at this site . BFI currently stores approximately
100 scavenger trucks in its commercial operations yard which
r is not in an enclosed building. Trucks that require
maintenance are stored within an enclosed building. Due to
mechanical breakdown or landfills closing, scavenger trucks
cannot be emptied before returning to the yard. These trucks
are emptied within 24 hours, as mandated by the Environmental
Protection Agency. BFI also features a truck washer. The
scavenger trucks are washed on a seven-day cycle. The
vehicles must be maintained so as they will not create an
insect, rodent or offensive odor problem. All of these items
are reviewed annually by City staff to ensure compliance .
BFI has not been cited for any violations . BFI is the only
scavenger company currently located within the City of Elgin
so these proposed changes will not affect any other scavenger
companies.
COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
Browning Ferris Industries of Illinois is a scavenger company
in Elgin with a large fleet of vehicles . They agree with the
proposed changes in this ordinance.

ALTERNATIVES
An alternative is to leave the ordinance as it currently
exists and mandate that BFI store scavenger trucks within an
enclosed building.
RECOMMENDATION
The recommendation is to approve the discussed changes in the
scavengers ordinance .
