Parker, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute Amendment No. 1 to an Engineering Service Agreement on behalf of the City of Elgin with Clark Dietz, Inc. for Phase II Final Engineering for the Spartan Drive extension, a copy of which is attached hereto and made a part hereof by reference. s/ Ed Schock Ed Schock, Mayor Presented: May 12, 1999 Adopted: May 12, 1999 Omnibus Vote: Yeas 6 Nays 0 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk CITY OF ELGIN,ILLINOIS SPARTAN DRIVE EXTENSION-PHASE II FINAL ENGINEERING ENGINEERING SERVICES AGREEMENT ENGINEERING SERVICES AGREEMENT AMENDMENT NO. 1 THIS AMENDMENT NO. 1 entered into this ;ollfday of 1999, by and between the City of Elgin, an Illinois municipal corporation (herein er referred to as "City"), and Clark Dietz, Inc., an Illinois Business Corporation (hereinafter referred to as "ENGINEER"), shall modify that Agreement dated 21 January 1998 (hereinafter referred to as "Original Agreement") whereby the ENGINEER was engaged by CITY to perform certain professional services in connection with the completion of Phase I - Preliminary Engineering for the extension of Spartan Drive (hereinafter referred to as "PROJECT". This change is germane to the original contract as signed. WHEREAS, THE ENGINEERS completed the Phase I - Preliminary Engineering for the PROJECT which presented the preferred alignment for the extension of College Green Drive and the proposed intersection improvements with Randall Road and College Green Drive. AND WHEREAS, the CITY desires the ENGINEER to prepare Phase II - Final Engineering Design Services for the preferred alignment for the extension of Spartan Drive. In response to these changes, certain revisions must be made to the Original Agreement. In compliance, therefore, the terms and conditions of the Original Agreement are modified as specifically set out below. All other parts of the Original Agreement remain unchanged. SECTION I of the ORIGINAL AGREEMENT is hereby amended to replace Paragraph C with the following: A detailed Scope of Services is attached hereto as Attachment B - Revised for Phase II. SECTION II of the ORIGINAL AGREEMENT is hereby amended to replace Paragraphs A and B for the Phase II Final Engineering portion of the PROJECT. A. A revised detailed project schedule for the Phase II Final Engineering portion of the PROJECT is included as Attachment C, attached hereto. The ENGINEER will submit to the CITY a monthly Progress Report outlining the status of the project, including a brief narrative of progress, findings, and outstanding issues. SECTION IV of the ORIGINAL AGREEMENT is hereby amended to replace paragraph A. A. For services provided the ENGINEER shall be reimbursed at the billing rates attached hereto in Attachment A times the hours provided by the personnel employed on this PROJECT, with the total fee not to exceed $129,050, including outside services and job related expenses, regardless of the actual costs incurred by the ENGINEER unless substantial modifications to the scope of the work are authorized in writing by the DIRECTOR. All other provisions of the ORIGINAL AGREEMENT shall remain in full force and effect. IN WITNESS whereof, the undersigned have placed their hands and seals upon and executed AMENDMENT NO. 1 in triplicate as though each copy hereof was an original and that there are no other oral agreements that have not been reduced to writing in this statement. Plat of Survey - Parcel A-1 The following is a scope of the survey which shall be completed for the property designated as Parcel A-1,which is being conveyed from the Elgin Community College to the City of Elgin. A plat of survey of the Real Estate dated subsequent to the date hereof, made, and so certified by the surveyor to the City of Elgin and Chicago Title Insurance Company as having been made in accordance with the Minimum Standard Detail requirements for LTA/ASCM Land Title Surveys and Mapping, 1992, including, without limitation, all items (except for items 5, 7, 9, 10 and 12 in Table A thereof with accuracy standards appropriate to suburban settings and for the City of Elgin's intended use of the Real Estate). The survey shall also include a certification by the surveyor(i) as the square footage of the Real Estate (excluding any portion thereof lying in a public right-of-way) and (ii) that the Real Estate is not located in a flood plain,wetland or special flood hazard zone. Such survey shall indicate all building or improvements and further indicate all applicable easements and rights-of-way. Parker, City Manager SUBJECT: Amendment No. 1 to an Agreement with Clark Dietz Inc. for the Spartan Drive Extension-Phase II Design Engineering PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider Amendment No. 1 to an agreement with Clark Dietz Inc . (CDI) for the completion of Phase II - Design Engineering for the completion of plans, specifications and bid documents for the Spartan Drive extension project . BACKGROUND rft- The original agreement with CDI ($118, 000) for the Phase I Preliminary Engineering to determine the location of the Spartan Drive extension was authorized by the City Council at its December 17, 1997 meeting. CDI was selected from several firms to perform preliminary engineering (Phase I) and plan and bid document preparation (Phase II) . This amendment incorporates Phase II work into the contract . The Phase II amendment is consistent with the original proposal . Amendment No. 1 ($129, 050) will add the Phase II Design Engi- neering to the agreement with CDI for the subject project . Design Engineering services include the completion of plans, specifications, bid documents and bidding assistance . A copy of Amendment No. 1 is attached as Exhibit A. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None. FINANCIAL IMPACT rtk/ Funds for Phase I and Phase II engineering are budgeted in account number 270-0000-791 . 93-80 ($220, 000) and account number 276-0000-791 . 93-80 ($50, 000) , project number 339514 . The original agreement with CDI is in the amount of $118, 000 . Amendment No. 1 will add $129, 050 to the agreement with CDI for a total not-to-exceed fee of $247, 050 .
