98-64 Resolution No. 98-64 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH KANE COUNTY AND R & S USED OIL BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Joyce A. Parker, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an agreement on behalf of the City of Elgin with Kane County and R & S Used Oil for used motor oil collection, a copy of which is attached hereto and made a part hereof by reference. Kevin Kelly Kevin Kelly, Mayor Presented: March 11, 1998 Adopted: March 11, 1998 Omnibus Vote: Yeas 7 Nays 0 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk .4 AGREEMENT f THIS AGREEMENT entered into this 34-4 day of fe , 1998, by and between the CITY OF ELGIN, a municipal corporation (hereinafter referred to as the "City" ) , KANE COUNTY (hereinafter referred to as the "County" ) and R & S USED OIL, an Illinois corporation (hereinafter referred to as "R & S" ) . WITNESSETH WHEREAS, the City and the County are public agencies within the meaning of the Intergovernmental Cooperation Act; and WHEREAS, the City and the County are also units of local government within the meaning of Section 10 of Article 7 of the Constitution of the State of Illinois; and WHEREAS, the City and the County are authorized to contract among themselves to obtain or share services, or exercise, combine or transfer any power or function in any manner not prohibited by law; and WHEREAS, the County has requested the City host a one-day used motor oil collection event; and WHEREAS, the collection of used motor oil so as to protect the environment is a matter within the government and affairs of the parties; and WHEREAS, the County has contracted with R & S to service used motor oil collection events throughout the county. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the City, County and R & S agree as follows : 1 . That the foregoing recitals are hereby incorporated into this agreement in their entirety. 2 . That the City agrees to host a one-day used motor oil collection event on Saturday, September 19, 1998, from 9 : 00 a.m. to 1 : 00 p.m. The event will be conducted adjacent to the City Salt Storage Facility (north of the public works complex) located at Grove and McBride Street, Elgin, Illinois . 3 . R & S will provide a tanker truck at the collection site and will accept oil at no charge. Participants will bring used oil to the collection point where it will be emptied into 55 gallon drums by County staff . Empty containers will then be immediately discarded in a County dumpster or returned to the participants, if requested. The City will provide a staff member to supervise the activities . 4 . R & S personnel will pump the oil from the drums into the R & S tanker. R & S will clean up any and all spills . 5 . R & S and the County represent and warrant to the City that they each have general liability insurance to cover any and all claims and damages which may result from the used motor oil collection event as described herein. R & S and the County agree to indemnify and hold the City harmless from any and all claims, damages or causes of action which may result from said event. 2 IN WITNESS WHEREOF, the parties have executed this agreement on the date and year first written above . Parker, City Manager SUBJECT: Fourth Used Motor Oil Collection Event PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council information whereby the City Council may authorize participation for a fourth time in the county-wide used motor oil collection program as proposed by Kane County. BACKGROUND The Kane County Department of Environmental Management has proposed a county-wide used motor oil collection event similar tow to previous years. Kane County and the Kane-DuPage Soil and Water Conservation District will coordinate the event . They have again requested that the City of Elgin host the event in September to help meet public demand. Attached is a letter dated January 23 , 1998 from Kane County which outlines the oil collection event . Elgin was one of eight sites, which altogether collected 22 , 000 gallons of oil in 1997 . Staff has suggested that the event be held on Saturday, September 19th, in Elgin adjacent to the salt dome site at the Public Works Complex. Our Legal Department originally drafted an agreement (copy attached) which was approved and signed by Kane County the past three years . COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED Kane County will contact Elgin and Larkin High Schools ' environmental clubs to solicit volunteers to help. eL/ FINANCIAL IMPACT One staff person from the City should be involved from 9 A.M. to 1 P.M. Also, a notice in the Spirit and press releases are requested to help publicize the event . These minor expenses tow are funded within the Public Works Department 1998 budget . Public Works Director City of Elgin 150 Dexter Court Elgin, IL 60120 Dear Gary: Kane County would like to request that the City of Elgin again co-sponsor a used motor oil collection day this spring at your facility. We have tentatively selected Saturday, September 19th as the date of the Elgin collection this year. This would coordinate well with the proposed HHW collection date at ECC on September 26th. Elgin is an important member of our eight site county-wide oil collection network. At f'e` all eight collections last year we collected more than 22,000 gallons from 1,900 vehicles. We also collected some 2,600 used oil filters for recycling. To repeat last year's arrangement, the County will provide for the collection service, publicity, and is listed as an "additionally named insured" on the contractor's liability policy. The City's role is to provide the location and several staff to assist with handling the used oil. This year, the County will have a dumpster provided to accept empty containers. This step should greatly reduce wait times and increase convenience to the public. I look forward to again working with the City on this worthwhile project.
