INTERGOVERNMENTAL COOPERATION AGREEMENT BETWEEN THE TOWNSHIP OF HANOVER AND THE CITY OF ELGIN • This Agreement made and entered this � day of cT(, ,L'/ , 1998, by and between the Township of Hanover and the City of Elgin (collectively, the "parties"). RECITALS WHEREAS, the Township of Hanover (the "Township") is a township located within the County of Cook, Illinois; WHEREAS, the City of Elgin (the "City") is a municipal corporation located within the Counties of Kane and Cook, Illinois; WHEREAS, the Township and the City are units of local government as defined in the Illinois Constitution of 1970, and public agencies as defined by the Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.) (the "Act"); WHEREAS, the parties are authorized pursuant to Article VII, Section 10, of the Illinois Constitution of 1970 and by the Act to enter into intergovernmental agreements; WHEREAS, the City is a home rule municipality having all the powers pursuant to Article VII, Section 6, of the Illinois Constitution of 1970 including the right to exercise any power and perform any function pertaining to its government and affairs; WHEREAS, Section 3 of the Act provides, in part, that any power, privilege or authority that may be exercised by a public agency of Illinois may be exercised and enjoyed jointly with any other public agency of Illinois; WHEREAS, the parties desire to provide a program referred to as "Second Chance" program ("Second Chance;' or the "Program") for youths who have committed an offense which has brought them to the attention of the police and/or court; WHEREAS, the Program is intended to provide youth ("youth(s)" or "candidates") ages 10 to 16 with the opportunity to serve the consequences of their offense by -- performing a service to the community under the trained supervision of their parent(s); and WHEREAS,the parties have determined that the Program is a positive opportunity for the referred youth, their parents and the community in which they live, and should result in increased sense of responsibility by the participant to the community, 1 increasing the youth's self esteem, increasing the parents' involvement and positive influence on their son or daughter, and both youth and parents giving back to their community. NOW, THEREFORE, in consideration of the foregoing and other mutual covenants and agreements herein contained, the parties hereby agree as follows: 1. The Chief of Police of the City, or his or her designee shall appoint a juvenile probation officer or police officer (the "officer") to make referrals of youth and parent(s) for the Second Chance program (the "Program"). The officer shall cause the Police/Probation Department Intake Form ("Intake Form") to be completed and the Authorization for Release of Information ("Release of Information Form") form attached hereto as Exhibits "A" and "B", respectively. The officer shall perform a preliminary screening of youth and parents based on the information provided in the Intake Form and the Release of Information Form. In performing the initial screening, the officer shall also consider the number and nature of offenses committed by the youth and whether the youth is motivated to do the required community service, and whether the youth's parents are willing and have the ability to supervise said community service. As used in this Agreement, the term "parent" means and includes the natural or adoptive parent ' or court appointed guardian of the youth. Notwithstanding any other provision of this Agreement, the officer shall not refer any youth to the Program whom the officer determines would threaten the health or safety of other participants, volunteers, employees, officers or the public. 2. The Township shall cause an additional screening to be performed. Said screening shall be made following sessions between a Township therapist, the youth and the youth's parent(s). The therapist shall determine whether or not a candidate is eligible for the Program based on the therapist's interviews with the youth and his or her parent(s), the factors listed in Exhibit "C", the information provided by the parents and youth in the questionnaires attached hereto as Exhibit "D", and any information and documents provided by the City. In making such determination of eligibility, the therapist shall consider the motivation of the youth, whether the youth and the community would benefit from the program, and whether the parent(s) are capable of adequately supervising the youth. In no event shall the therapist permit a youth to participate in the Program if the therapist determines that the youth would threaten the health or safety of other participants, volunteers, employees, officers or the public. 3. Prior to admitting any youth or parent(s) into the Program, the Township shall cause said youth and parent(s) to execute the Release of Liability form attached hereto as Exhibit "E". 4. The Township shall be responsible for causing youths and parents who remain eligible for the Program following the screening set forth in paragraphs 1 and 2 herein, to attend a training session(s) with other families which is designed to increase families' skills around communication and conflict management in preparation for a successful placement at a community service site. Said training session(s) will be co-led 2 by a Township Youth and Family Service social worker and a City police or probation officer. 5. The Township shall execute an agreement in a form substantially similar to that attached hereto as Exhibit "F" with another unit of local government or a not-for- profit entity (hereinafter, "Agency") that shall provide work assignments and over see the performance of work by eligible youths and parents (i.e., youths and parents who are eligible following the screenings in paragraphs 1 and 2 herein, who complete and execute all necessary forms and documents as provided herein, and who successfully complete the training required herein). 6. a. The Township shall protect, indemnify, hold and save harmless and defend the City, its officers, officials, employees, volunteers, and agents against any and all claims, costs, causes, actions and expenses, including but not limited to attorney's fees incurred by reason of a lawsuit or claim for compensation arising in favor of any person, including the employees, volunteers, officers or agents of the Township, the City, or the Agency on account of personal injuries or death, or damages to property occurring, growing out of, incident to, or resulting directly or indirectly from (i) any activity done or permitted by the Township in violation of its obligations under this Agreement; • or (ii) any negligent, tortious or illegal act or omission of the Township, its agents or employees, except where caused by the negligent or intentional acts of the City, its employees or agents. b. The City shall protect, indemnify, hold and save harmless and defend the Township, its officers, officials, employees, volunteers, and agents against any and all claims, costs, causes, actions and expenses, including but not limited to attorney's fees incurred by reason of a lawsuit or claim for compensation arising in favor of any person, including the employees, volunteers, officers or agents of the City, the Township, or the Agency on account of personal injuries or death, or damages to property occurring, growing out of, incident to, or resulting directly or indirectly from (i) any activity done or permitted by the City in violation of its obligations under this Agreement; or (ii) any negligent, tortious or illegal act or omission of the City, its agents or employees, except where caused by the negligent or intentional acts of the Township, its employees or agents. 7. a. This Agreement supersedes all prior agreements and understandings, both written and oral, of the parties with respect to the subject matter hereof. b. Changes in the number, gender and grammar of terms and phrases herein when necessary to conform this Agreement to the circumstances of the parties hereto shall in all cases, be assumed as though in each case fully expressed therein. c. This Agreement shall be construed, governed and enforced according to the laws of the State of Illinois. 3 d. Any recitals herein or exhibits attached hereto are hereby incorporated into this Agreement by this reference. e. If any clause, phrase, provision or portion of this Agreement or the application thereof, to any person or circumstance, shall be invalid or unenforceable under applicable law, such event shall not affect, impair or render invalid or unenforceable the remainder of this Agreement, nor shall it affect the application of any other clause, phrase, provision or portion hereof to other persons or circumstances. The Township shall comply with the terms and conditions set forth in the Intergovernmental Cooperation Agreement attached hereto as Exhibit "A". 2. The Township shall cause all youths and parent(s) to execute the Release of Liability form attached hereto as Exhibit "B" releasing from liability and holding harmless the Agency. As used herein, the term "parent" means and includes the natural or adoptive parent or court appointed guardian of the youth. 1 3. The Agency shall provide work assignments that can be completed by youths and that do not pose a danger to the youths, parents, employees, volunteers, or the public. The Agency shall provide specific job descriptions, orientation regarding job expectations, and a contact person who will be on site when participants are doing work pursuant to this Agreement (the Agency Official"), and who shall ensure that work is performed in a safe and satisfactory manner and shall check work completion/sign off on time cards. Notwithstanding any other provision of this Agreement, the Agency shall have the absolute and sole discretion to deny community service opportunities to any participant that the Agency deems a threat to the health or safety of any person and/or property. 4. The Agency shall immediately remove from the Program any youth and/or parent who the Agency reasonably determines has harmed, attempted to harm, or threatened to harm any person or property. The Agency also has the discretion to remove any youth and/or parent from the Program who violates any applicable federal, state, or local rule, regulation, statute, or ordinance, or who otherwise refuses to follow directions, orders or rules of the Agency. The Agency shall allow the youth and parents an opportunity for informal hearings before dismissing a participant from the Program, unless the Agency determines the participant should be removed immediately in order to protect the health and safety of any person or property. In such event, informal hearings shall occur as soon as reasonably practical after the participant has been removed from the Program. All hearings shall be held before the Township Director of Youth Services (the "Director"). At the hearing, the youth and parents shall be permitted to present evidence. The Director shall determine whether or not a particular youth and parent remains eligible to participate in the Program. However, nothing herein shall require the Agency to permit any youth and parent to perform community service work in the event that the Agency reasonably determines is a threat to the health or safety of any person and/or property. 5. Whenever possible, youth shall perform their community service hours in a small group with other referred youth. The Township shall arrange for one parent supervisor for every two participants with a maximum of five youths per site. The Agency shall be responsible for contacting the Township within five business days following each scheduled community service assignment to verify that work has been performed satisfactorily and to see whether the Township has any concerns. 6. a. The Township shall protect, indemnify, hold and save harmless and defend the Agency, its officers, officials, employees, volunteers, and agents against any and all claims, costs, causes, actions and expenses, including but not limited to attorney's fees incurred by reason of a lawsuit or claim for compensation arising in favor of any person, including the employees, volunteers, officers or agents of the Township, the Village, or the Agency on account of personal injuries or death, or damages to property occurring, growing out of, incident to, or resulting directly or indirectly from (i) any activity done or permitted by the Township in violation of its obligations under this Agreement; or (ii) any negligent, tortious or illegal act or omission of the Township, its agents or employees, except where caused by the negligent or intentional acts of the Agency, its employees or agents. 2 b. The Agency shall protect, indemnify, hold and save harmless and defend the Township, its officers, officials, employees, volunteers, and agents against any and all claims, costs, causes, actions and expenses, including but not limited to attorney's fees incurred by reason of a lawsuit or claim for compensation arising in favor of any person, including the employees, volunteers, officers or agents of the Agency, the Township, or the Village on account of personal injuries or death, or damages to property occurring, growing out of, incident to, or resulting directly or indirectly from (i) any activity done or permitted by the Agency in violation of its obligations under this Agreement; or (ii) any negligent, tortious or illegal act or omission of the Agency, its agents or employees, except where caused by the negligent or intentional acts of the Township, its employees or agents. As used herein, the Village means the unit of local government that has referred youth(s) and parent(s) to the Township pursuant to an Intergovernmental Cooperation Agreement similar to that described in Exhibit "A" for the performance of community work service, where said work is to be performed pursuant to this Agreement. 7. In the event, that the Agency is not a unit of local government as defined in the Illinois Constitution of 1970, then the Agency shall procure and maintain for the duration of this Agreement, insurance for injuries to persons and damage to property which may arise from or in connection with the performance of community service pursuant to this Agreement. The cost of such insurance shall be borne by the Agency, and such insurance shall be in a form acceptable to the Township attorney and with limits of not less than: a. General Liability. $1,000,000 combined single limit per occurrence for bodily injury, personal injury, and property damage. b. Workers' Compensation and Employers' Liability: Workers' compensation limits as required by statute and Employer's Liability limits of$500,000 per accident and $500,000 per disease. The Agency shall furnish the Township and Village with certificates of insurance naming Hanover Township and the Village as Certificate Holders and effecting coverage required herein. The certificates for each insurance policy are to be signed by a person authorized by that insurer to bind coverage on its behalf. The Township and Village reserve the right to require complete, certified copies of all required insurance policies, at any time. All insurance shall be from an insurance company or companies licensed to do business in the State of Illinois, with a policy holder's rating of not less than "A-" and a financial rating of at least "VII" in the latest edition of the Best Insurance Guide. Each insurance policy required herein shall not be suspended, voided, cancelled, reduced in coverage or in limits except after ten (10) days prior written notice by certified mail, return receipt requested has been given to the Township and the Village. 3 8. a. Accordingly, and by this release, I hereby waive and release (the Agency), and its officials, officers, agents, servants, volunteers and employees, from any and all claims, demands or causes of action, or liabilities of any type, nature or variety arising out of said child's participation in Second Chance, and further agree to be fully responsible for any and all costs arising out of accident or illness sustained by said child by reason of participation in this program. I further authorize, in the event of my absence, any of the parent supervisors on site to secure any necessary emergency medical, hospital or surgical treatment in the event of any medical emergency arising out of the child's participation in this program. Parker, City Manager SUBJECT: Intergovernmental Agreement with Hanover Township PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider an Intergovernmental Cooperation Agreement with Hanover Township for a new youth program known as Second Chance . BACKGROUND The Hanover Township Youth and Family Services has established a new youth program known as Second Chance . Referrals are made by police officers from the Elgin Police Department Juvenile Division and probation officers from the Department of Correc- tions . These referrals include first-time offenders or those with limited contact with Juvenile Court Service . The offender must be between the ages of 10-16 and his/her family must volunteer for the program after being selected by the juvenile officer. A description of the program is attached. Our Juvenile Division currently utilizes two similar programs (Peer Jury and Consequences) which have been on-going for two years . Second Chance could be used to supplement those pro- grams involving youth residing in the Cook County portion of the City. The program would focus on increasing the youth' s sense of responsibility to the community by increasing the youth' s self-esteem; increasing the parents ' involvement resulting in a positive influence on their son or daughter; and providing the opportunity for both the youth and the parents to give back to their community. Based on the current use of the other two programs, we believe the program would be utilized by two or three juveniles per month from the Cook County portion of the City. Hanover Park, Streamwood and Bartlett have signed this Intergovernmental Cooperation Agreement .
