Malm, Interim City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute Amendment No. 2 to an Agreement on behalf of the City of Elgin with Rust Environment & Infrastructure for construction-related engineering and inspection services for the Kimball Street Improvement Project, a copy of which is attached hereto and made a part hereof by reference. s/ Kevin Kelly Kevin Kelly, Mayor Presented: March 12, 1997 Adopted: March 12 , 1997 Omnibus Vote: Yeas 7 Nays 0 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk CITY OF ELGIN, ILLINOIS KIMBALL STREET AND STATE STREET IMPROVEMENTS ENGINEERING SERVICES AGREEMENT AMENDMENT NO, 2 �c(.4 This Amendment No. 2 entered into this may of}�, 1997, by and between the City of Elgin, an Illinois Municipal Corporation (hereinafter referred to as the "CITY") and Rust Environment&Infrastructure, Inc. (Hereinafter referred to as the"ENGINEER"), shall modify that Agreement dated July 17, 1996, whereby the ENGINEER was engaged by the CITY to perform certain professional services in connection with the preparation of plans, specifications, estimates of cost and construction-related services for the Kimball Street and State Street improvement project (hereinafter referred to as"PROJECT"). Whereas certain additional design engineering services were required to complete final plans and bidding documents for the PROJECT, and, Whereas the CITY intends to award a contract for construction of the PROJECT and will require the performance of construction-related engineering services beginning February 27, 1997, and, Whereas the scope of services in the Agreement for the PROJECT did not include payment needed to perform the additional design services or the construction-related services, Therefore, in response to the need for these additional services, certain revisions must be made to the Agreement. In compliance, therefore, the terms and conditions of the Agreement are modified as specifically set forth below. All other parts of the Agreement remain unchanged. Section I "SCOPE OF SERVICES", Subsection B "Design Services" of the Agreement is hereby amended to include the following additional services: B. Design Services: • Redesign traffic signal and bridge plans at the intersection of Kimball Street and State Street as required by IDOT and Metra to improve safety and coordination between the operations of the traffic signal and warning devices at the Metra grade crossing; • Modify Kimball Street median plans between Grove Street and Douglas Avenue including the storm sewer drainage, landscaping,unit pavers and roadway lighting to provide full vehicular access at Brook Street; • Modify storm sewer drainage and pedestrian lighting plans to allow construction of improvements around existing Ameritech telephone ducts on Kimball Street. Section I "SCOPE OF SERVICES", Subsection C "Attachment A" of the Agreement is hereby amended to include the following revisions: On page 6 under the heading titled"Assumptions/Conditions", delete sections A, B, C and D and substitute the following: A. Design services will begin in June 1996 and be completed for bidding purposes by January 1997. Construction services will begin upon award of a contract to the lowest responsible bidder and be completed in June 1998. B. Existing buildings and structures located on land to be acquired for the Kimball Street improvements will be removed from the proposed Kimball Street right of way as part of a separate contract between the City and a demolition contractor. C. The City will provide for material and field testing required to verify contractor compliance with the contract documents through a separate agreement with a material testing consultant under contract directly with the City. D. Construction observation man hours for the resident project representative and inspectors have been estimated as follows: Resident Project Representative: 50 hours for preconstruction services; 1,890 hours for full-time services beginning March 1, 1997 through the substantial completion date of November 30, 1997; 400 hours for part-time services beginning December 1, 1997 through the final completion date of June 30, 1998. Total hours for resident project representative=2,340. Inspectors (two individuals): One individual working full-time for 1,550 hours beginning March 30 through October 31, 1997 (or as-needed depending upon the schedule of construction activities) and a second individual working full-time for 750 hours beginning June 2 through September 12, 1997 (or as-needed depending upon the schedule of construction activities). Total hours for inspectors= 2,300. Section II"PROGRESS REPORTS", Subsection A of the Agreement is hereby amended to revise the project milestone schedule as follows: • Begin Construction 03/17/97 • Substantial Completion 11/30/97 • Final Completion 06/30/98 Section IV"PAYMENTS TO THE ENGINEER" of the Agreement is hereby amended to delete the last sentence in Subsection C, delete Attachment B-2 dated June 13, 1996 and add Subsection D as follows: D. For services required to redesign the plans as detailed in this Amendment and to provide construction-related engineering services, the ENGINEER shall be reimbursed in accordance with the fee breakdown hereto attached as Revised Attachment B-2, dated February 13, 1997. The total fee shall not exceed $419,940 regardless of the actual cost incurred by the ENGINEER unless substantial modifications to the scope of services or changes in the substantial or final completion dates are authorized by the CITY through a change order or amendment to the contract documents. All other provisions of the Agreement shall remain in full force and effect. IN WITNESS WHEREOF,the undersigned have placed their signatures and seals upon and executed this Agreement in triplicate as though each copy hereof was an original and that there are no other oral agreements that have not been reduced to writing in this amendment. Malm, Interim City Manager SUBJECT: Amendment No. 2 to an Agreement with RUST Environment & Infrastructure PURPOSE The purpose of the memorandum is to provide the Mayor and members of the City Council with information to consider Amendment No. 2, to an agreement with RUST Environment & Infrastructure (RUST) to add construction-related engineering and inspection services for. the Kimball Street Improvement project. eft. BACKGROUND At its meeting of June 26, 1996 City Council authorized an agreement in the amount of $153,536 .56 with RUST for the preparation of plans, specifications, estimates and bidding engineering services for the Kimball Street Improvement project. At its meeting of February 12, 1997 City Council authorized Amendment No. 1 in the amount of $19,442 . 00 for the design of an decorative railing for the Kimball Street bridge. This Amendment No. 2 will add the construction engineering and inspection services to the agreement with RUST for the subject project. Amendment No. 2 to RUST' s agreement has been prepared and is included as Exhibit A. RUST' s current agreement, Amendment No. 1 and the Council 's Memorandum' s are included as Exhibit B for your information. The construction of the Kimball Street Improvement Project is on the agenda for award by City Council on February 26, 1997 .
